RESOLUTION NO 2001
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CYPRESS APPROVING CONDITIONAL USE PERMIT
NO 78-11 - WITH CONDITIONS
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES
DETERMINES AND ORDERS AS FOLLOWS
1 That an application was filed for a conditional use permit in
accordance with the provisions of Section 17 2 of the Zoning Ordinance of
the City of Cypress to allow the sale of animal feed (hay) at 4252 Crescent
Avenue, in the RS -15000 Residential Single Family Zone
2 That the City Council after proper notice thereof, duly held a
public hearing on said application as provided by law
3 That the City Council hereby finds, that
a The proposed location of the conditional use is in accord with
the objectives of the Zoning Ordinance and the purpose of the zone in
which the site is located is.
To reserve appropriately located areas for family living at a
broad range of dwelling unit densities consistent with the
General Plan and with sound standards of public health, safety
and welfare
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health safety or welfare or be materially injurious to
properties or improvements in the vicinity in that.
1 The sale of hay is intended primarily as a convenience to
adjacent neighbors, particularly those property owners located
in the same zone classification as the subject property
The storage of the hay will be maintained a minimum distance
from any adjacent single-family dwelling in order to reduce
impacts on adjacent properties
2 All deliveries of hay and any other traffic which may be generated
by this use can be readily accommodated by the adjacent «rterial
street No traffic will be generated along Acacia Drive the
adjacent rural street
c The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments
4 The City Council DOES HEREBY GRANT said Conditional Use Permit, subject
to the conditions attached hereto as Exhibit "A "
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 10th day of July., 1978

1 The hours of operation for this accessory business shall be conducted
so as not to constitute a nuisance to adjacent residences and properties
2 Deliveries of hay to the premises shall not be permitted on Sundays
3 No signs shall be allowed on the subject property This condition has
particular reference to signs relating to the conduct of the business
as permitted
4 This Use Permit is limited to the sale of hay only on lots #2 and #3
Block A, of Tract 812
5 A business license shall be obtained from the City of Cypress
6 The Planning Commission shall maintain ongoing jurisdiction over this
Conditional Use Permit Should the Planning Commission determine that
the sales has become the principal land use, this Use Permit shall be
revoked by the Planning Commission
7 The dilapidated building located on the corner parcel shall be
demolished and removed, or, if to be retained, shall be upgraded in
accordance with the requirements of the Building Code providing all
legal restrictions regarding the removal or use of this structure can be
satisfied The subject property in general shall be kept in a clean and
orderly manner free of weeds and debris visible from the public streets
8 This Conditional Use Permit shall not become effective until Ordinance
No 615 becomes effective permitting the subject land use
9 The storage of hay shall not encroach closer than 50 feet to any
adjacent dwelling nor shall said hay be stored to a height in excess
of 15 feet
