Resolution No. 2022RESOLUTION NO 2022 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO 78-18 - WITH CONDITIONS 3` THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES DETERMINES AND ORDERS AS FOLLOWS 1 That an application was filed for a conditional use permit in accordance with the provisions of Section 17 2 of the Zoning Ordinance of the City of Cypress to establish a formal dining restaurant with on-site sales of alcoholic beverages and a convenience market with off-site sales of alcoholic beverages 2 That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law 3 That the City Council hereby finds that* a The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is To provide appropriately located areas for office uses, retail stores service establishments, and wholesale businesses offering commodities and services required by residents of the City and its surrounding market areas b The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that 1 The proposed uses will be located as an integral part of a new shopping center development wherein adequate off-street parking will be provided to accommodate vehicular traffic generated by the use and adjacent arterial streets will have more than adequate capacity to accommodate projected traffic volumes The resulting traffic flow patterns will not infringe on the rights to use of any adjacent properties 2 The design of the project will be such as to contribute to the physical improvement of properties along Lincoln Avenue and will compliment all adjacent properties within the neighborhood 3 The establishment of additional commercial uses will contribute to the City s tax base and concomitantly to the general welfare of the community c The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments 4 The City Council DOES HEREBY GRANT said conditional use permit subject to the conditions attached hereto as Exhibit "A " PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 10th day of October, 1978 ATTEST* 4.r1 ./!/1O CITY LERK F HE CITY OF CYPRESS ra„, MAYOR OF TH CITY OF CYPRESS 35 STATE OF CALIFORNIA ) ss COUNTY OF ORANGE ) I, DARRELL ESSEX City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the 10th day of October 1978 by the following roll call vote. AYES NOES ABSENT: 3 COUNCIL MEMBERS: MacLain Rowan and Hudson 2 COUNCIL MEMBERS Evans and Lacayo 0 COUNCIL MEMBERS None CI CITY OF CYPRESS EXHIBIT "A" CONDITIONAL USE PERMIT NO 78-18 35:'. 1 The building elevations floor plans and construction drawings shall be submitted for Planning Commission review and approval prior to this Conditional Use Permit becoming effective and issuance of a building permit The architecture of the proposed building D shall be compatible with the existing development within the surrounding area and the shopping center, of which it is a part now under construction 2 The applicant shall comply with all regulations established by the State of California Department of Alcoholic Beverage Control 3 The restaurant shall be operated in a manner not to disturb local residential development The hours of operation shall be subject to Planning Commisison review and approval 4 All those original conditions of approval as required by the Planning Commission in their approval of the shopping center site plan and eleva- tions shall apply to this Use Permit where applicable 5 Any service yard or outdoor storage area provided for the restaurant in building D shall be completely enclosed with masonry walls and solid gates to prohibit the interior view by the public c
