A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING TENTATIVE TRACT NO 10560 -
WITH CONDITIONS
WHEREAS an application was made by the Robert P Warmington Company
to divide 9 acres of land into 15 lots located at 9141 Valley View Street
and
WHEREAS, the City Council considered evidence presented by the
applicant City staff and other interested parties at a public meeting held
with respect thereto
NOW THEREFORE, the City Council of the City of Cypress, DOES
HEREBY RESOLVE as follows.
1 The proposed map is compatible with the objectives, policies, general
land uses and programs specified in the General Plan of the City of Cypress
in that:
a The map will provide for the development of the subject property
with commercial and light industrial uses in accordance with the Land
Use Designation of the General Plan
b The map as proposed will provide for the full extension and
improvement of the adjacent arterial street in accordance with the
standards contained in the Circulation Element of the General Plan
2 The design and improvement of the proposed subdivision as designated
on the tentative tract map and supplemented by the conditions attached hereto
as Exhibit "A" and incorporated herein by reference, are compatible with
the objectives policies general land uses and programs specified in the
General Plan of the City of Cypress in that.
a The design of the proposed map and the size of the lots
contained therein will promote the establishment of commercial and light
industrial uses compatible with one another and adjacent ownerships and
land uses and will be compatible with the objectives of the Land Use
Element of the General Plan
b Off-site improvements including streets and utility extensions
will be provided in accordance with the Circulation and Public Facilities
Elements of the General Plan
3 None of the findings set forth in Government Code Section 66474 can
be made
4 The discharge of waste from the proposed subdivision into the existing
community sewer system shall not result in a violation of the existing
requirements prescribed by the California Regional Water Quality Control Board
having jurisdiction over the proposed subdivision pursuant to the provisions of
Division 7 of the California Water Code (Sections 13000 et seq ) Denial
of a subdivision for violation of the proposed waste discharge standards or
an addition to an existing violation thereof is a ground for denial of the
tentative subdivision map although such denial is not mandatory
NOW THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Tentative Subdivision Map No 10560 subject
to the conditions attached hereto as Exhibit "A"
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cypress on the 23rd day of October, 1978

TENTATIVE TRACT MAP NO 10560
1 The developer shall conform to all applicable provisions of the City
Code All requirements of the State Subdivision Map Act and the City's
Subdivision Ordinance shall be satisfied
2 Drainage shall be solved to the satisfaction of the City Engineer A
grading plan shall be submitted for approval A topograph of the area
surrounding this development shall be made to establish existing drainage
flow patterns If the existing natural flow of any adjoining parcel is
across the land of this development a drainage easement shall be granted
and drainage facilities provided for that property to the satisfaction of
the City Engineer All on-site drainage conveyed to the street shall be
by means of an undersidewalk drain, per City standards All lots shall
have a slope gradient of between one percent (1%) and three percent (3%)
from rear lot line to the street
3 A landscape and irrigation plan shall be submitted for approval by the
City and a bond posted by the applicant to guarantee against any defects
in plant materials and workmanship A soils report for all planting
areas by a qualified agricultural laboratory, shall be submitted to the
Public Works Department for approval at least thirty days prior to planting
date Test results shall include concentration of nitrogen phosphorus
potassium pH salinity sodium status and boron saturation extract
4 Wheelchair and handicap access facilities shall be installed on-site and
off-site in accordance with State of California and City of Cypress
Building Department standards
5 On-site security lighting shall be arranged so that direct rays shall not
shine on adjacent properties or produce glare for street traffic All
roof -mounted equipment, such as heating and air conditioning units, shall
be adequately screened from public view subject to the approval of the
City staff Commercial or industrial developments shall construct noise
bafflers and/or deflectors on all mechanical equipment mounted outdoors to
the satisfaction of the City staff
6 Lakeshore Drive and Street "B" shall be dedicated and fully improved with
curb gutter sidewalk driveway paving etc in accordance with the
Master Plan of Streets and Highways Lakeshore Drive and Street 'B'
shall have a total right-of-way width of sixth feet (60') Both cul-de-
sacs shall have a property line radius of fifty feet (50') Curb returns
at the intersection of Lakeshore Drive and Valley View Street shall have
a radius of thirty-five (35) feet
7 Street structural sections shall be based on the recommendation and soils
report prepared by an engineering firm acceptable to the City Engineer
with street structural sections to be determined by using an applicable
T I (Traffic Index) The minimum flowline grade in streets
shall be 0 20% All existing public improvements at the development site
which are damaged cracked or otherwise below standard shall be removed
and replaced to the satisfaction of the City Engineer
8 The number, location, width and type of driveways shall be subject
to the approval of the City Engineer An effective sight distance for
vehicular traffic shall be maintained at the intersection of the driveway
entrances with Lakeshore Drive and Street "B" No landscaping will be
allowed in the area of the curb returns Adequate sight distance also
shall be maintained within the development at all driveway intersections
to the satisfaction of the City Engineer All access rights to Valley
View Street shall be dedicated to the City of Cypress except at the
intersection of Lakeshore Drive with Valley View Street and adjacent to
future Lot ##16

9 All secondary and primary utility services shall be underground The
street in front of this development shall be resurfaced with one i4ch
(1") minimum thickness asphalt concrete from curb to curb if it is riecessary
to open cut the street in more than one place Any open cut shall be
backfilled per City of Cypress Standard No 110
10 Street lights shall be installed per City standards Street name signs
and traffic signs shall be installed per City standards Necessary fire
hydrants shall be installed in accordance with Fire Department requirements
and City standards
11 Street trees (15 gallon) forty feet (40') on center shall be installed
along streets in conformance with the street tree policy of the Public
Works Department The type of trees shall be as required under the Townscape
and Urban Design Element of the General Plan
12 A master plan of sewers shall be submitted for approval by the City
Engineer with plan check and inspection by the City's Engineering Division
subject to plan checking and inspection fees Sewer laterals connecting
existing houses at this property shall be plugged at the property line
13 Traffic signal modification and related improvements shall be done in
accordance with plans and specifications provided by the City The
proposed centerline of west Lakeshore Drive shall be aligned with the
centerline of the existing east Lakeshore Drive
14 A left -turn pocket shall be required in the median island on Valley View,
south of Lakeshore Drive, to the specifications of the City Engineer
15 The developer shall post a cash bond to pay for one-half of the cost of
the landscaping and irrigation needed for the median islands on Valley
View Street in front of the proposed development
16 All existing landmark trees located on the subject property shall be
retained to the maximum extent possible Trees which are proposed to
be retained shall be inspected by a qualified tree specialist and shall
be trimmed and topped as necessary A report on the condition of the
trees and the steps necessary for their preservation shall be filed for
review by the City staff
17 The following fees shall be paid
a Final subdivision map filing fee (Per Resolution 111713 )
b Engineering plan checking and inspection fee (Per Resolution 111713 )
c Drainage fee for Master Drainage Plan (Per Resolution 111717 )
d Sanitary sewer connection fee (Per Orange County Sanitation District
113 Resolution 11303 )
e Developer's Tax ($50 00 per unit )
f Advanced street light energy charges shall be paid (for a one-year
time period )
g All applicable building department fees shall be paid
