Resolution No. 2033'a33 -r 373 RESOLUTION NO 2033 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING TENTATIVE TRACT MAP NO 10584 - WITH CONDITIONS WHEREAS an application was made by Mr Charles Schmuck to divide 0 44 acres of land into seven lots yielding a density of 15 9 units per acre to be located at 9541 Graham Street, Cypress, and WHEREAS, the City Council considered evidence presented by the applicant City staff and other interested parties at a public meeting held with respect thereto NOW, THEREFORE the City Council of the City of Cypress DOES HEREBY RESOLVE as follows 1 The proposed map is compatible with the objectives policies general land uses and programs specified in the General Plan of the City of Cypress in that: a The map will provide for the subdivision and development of the subject property in a manner which is compatible with the Land Use Element of the General Plan b The density of development for the residential portions of the subdivision will be in conformance with the requirements of the Zoning and Subdivision Ordinances and within the density limitations of the Land Use Element of the General Plan c Approval of the map will facilitate the development of housing units which will incrementally increase the supply of housing within the City in accordance with the broad objectives of the Housing Element of the General Plan 2 The design and improvement of the proposed subdivision as designated on the tentative tract map and supplemented by the conditions attached hereto as Exhibit 'A', and incorporated herein by reference are compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that The map will provide for the subdivision of the subject property in a manner which is compatible with surrounding land use patterns and will result in the installation and extension of public iliprovements and utilities in accordance with the long-range oectives of the Land Use Element Housing and Circulation Elements of the City's General Plan 3 None of the findings set forth in Government Code Section 66474 can be made 4 The discharge of waste from the proposed subdivision into the existing community sewer system shall not result in a violation of the existing requirements prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code (Sections 12000 et seq ) Denial of a subdivision for violation of the proposed waste discharge standards or an addition to an existing violation thereof, is a ground for denial of the tentative subdivision map although such denial is not mandatory 374 NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Tentative Tract Map No 10584 subject to the conditions attached hereto as Exhibit "A" PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cypress on the 13th day of November, 1978 ATTEST CITY CLERK OF THE C OF CYPRESS STATE OF CALIFORNIA ) SS COUNTY OF ORANGE ) MAYOR OF THS CITY OF CYPRESS I, DARRELL ESSEX, City Clerk of the City of Cypress DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the 13th day of November, 1978, by the following roll call vote AYES: 5 COUNCIL MEMBERS. None /a>141/Atae CITY CLERK OF THE CITY vF CYPRESS EXHIBIT "A" TENTATIVE TRACT MAP NO 10584 375 1 The developer shall conform to all applicable provisions of the City's Municipal Code All requirements of the State Subdivision Map Act and the City's Subdivision Ordinance shall be satisfied 2 All applicable conditions of approval of Conditional Use Permit No 78-22 shall be included in the conditions of this map 3 Prior to recordation of the map water improvement plans shall be approved by the Fire Warden for fire protection and financial security posted for the installation The adequacy and reliability of water system design, location of valves, and distribution of fire hydrants will be evaluated in accordance with Public Utilities Commission (PUC) General Order No 103 c
