RESOLUTION NO 2046
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS GRANTING CONDITIONAL USE PERMIT NO 78-28 -
WITH CONDITIONS
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES AND ORDERS AS FOLLOWS:
1 That an Application was filed for a conditional use permit in
accordance with the provisions of Section 17 2 of the Zoning Ordinance
of the City of Cypress to establish a recreational vehicle storage yard
and the rental space for private party vehicle sales at 5032 Lincoln
Avenue
2 That the City Council after proper notice thereof duly held a
public hearing on said Application as provided by law
3 That the City Council hereby finds that*
a The proposed location of the conditional use is in accord with
the objectives of the Zoning Ordinance and the purpose of the zone in
which the site is located is that
To provide appropriately located areas for office uses retail
stores service establishments and wholesale businesses,
offering commodities and services required by residents of the
City and its surrounding market area
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health safety or welfare or be materially injurious
to properties or improvements in the vicinity in that
1 The subject property is located within an appropriate zone
classification designed to accommodate uses as proposed and the
establishment of this type of use will be compatible with other
commercial uses established on adjacent properties
2 The adjacent arterial street has more than adequate capacity to
accommodate the increased pedestrian and vehicular traffic
projected to be generated by the proposed use
3 The proposed use is compatible with the long-range land use
provisions for this area as designated on the Land Use Element
of the City's General Plan
c The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments
4 The City Council DOES HEREBY GRANT said conditional use permit
subject to the conditions attached hereto as Exhibit A
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the lith day of December 1978

EXHIBIT "A"
CONDITIONAL USE PERMIT NO 78-28
1 A minimum of two (2) fifteen -gallon size trees shall be installed in
the front landscape planter west of the main access driveway, subject
to City staff approval
2 The applicant shall submit an off-street parking plan to accommodate
visitor parking This plan shall be approved by City staff prior to
the striping of any spaces A minimum of ten (10) designated spaces
shall be provided for the subject business and three (3) designated
spaces provided for the office building which is located on this
property In any event should the ten spaces not adequately accommodate
all parking needs on-site, the applicant shall stripe and designate
additional spaces at City staff's request
3 The westerly drive approach has been identified by the City Engineering
Department as a hazardous exit from the property This driveway
approach shall be completely removed and replaced with full curb and
sidewalk to eliminate the vehicle/pedestrian conflict ;which now exists
4 The premises may not be used as a truck yard, contractor storage
yard or any other business not specifically authorized by this

5 Storage by the applicant of any non-operating vehicle or used vehicle
parts is prohibited All minor repair work shall be accomplished to
the rear of the main structure out of view from Lincoln Avenue
6 The hours of operation for this activity shall be between the hours
of 8.00 a m and 9 00 p m seven days per week Any limitations on the
hours of operation will be established to protect the privacy and
general welfare of the adjoining single-family residences to the north
of the subject property
7 No sale or dispensing of gasoline or other oil derivatives shall be
permitted on the subject property
8 Servicing of automobiles and recreational vehicles shall be limited
to the cleaning of exteriors and interiors of vehicles and preventative
maintenance No major motor, transmission, rear -end or body work
including painting shall be performed on the premises
9 The fiberglass wall extension along the northerly property line shall
be repaired and maintained in good condition subject to City staff
approval
10 On-site security lighting shall be arranged so that direct rays will
not shine on adjacent properties or produce glare for street traffic
All roof -mounted equipment, such as heating and air conditioning units,
shall be adequately screened from public view, subject to the approval
of the City staff Commercial developments which adjoin residentially
zoned areas shall construct noise bafflers and/or deflectors on all
mechanical equipment mounted outdoors, to the satisfaction of the City
staff
11 All existing improvements at the development site which are damaged,
cracked or otherwise below standard shall be removed and replaced
to the satisfaction of the City Engineer

12 All future signing, including attached and freestanding signs, shall
be reviewed and approved by City staff prior to installation
13 A certificate of occupancy shall not be issued for this use until all
conditions applicable to this use permit are satisfied
14 This Conditional Use Permit is subject to revocation should the applicant
violate any or all conditions of approval
15 All provisions of the Cypress City Code shall be satisfied particularly
with reference to the requirements for the establishment of a recreation-
al vehicle storage yard
