RESOLUTION NO 2060
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING TENTATIVE PARCEL MAP NO 79-1104 -
WITH CONDITIONS
WHEREAS an application was made by Brian Harvey to divide approximately
forty two acres of land into two lots for ultimate industrial development to be
located on the southerly side of Katella Avenue westerly of Knott Avenue in the
MP 20 000 Industrial Park Zone and
WHEREAS, the City Council considered evidence presented by the Applicant,
City staff and other interested parties at a public meeting held with respect
thereto
NOW THEREFORE the City Council of the City of Cypress DOES HEREBY
RESOLVE as follows
1 The proposed map is compatible with the objectives nolicies general
land uses and programs specified in the General Plan of the City of Cypress in
that
(a) The lot size proposed by this subdivision is compatible with
the land use objectives of the General Plan and the specific development
proposals of the zone classification in which the property is located
(b) The adjacent arterial streets will be dedicated, widened and
improved in accordance with the provisions of the Circulation Element
of the General Plan
2 The design and improvement of the proposed subdivision as designated
on the tentative parcel map and supplemented by the conditions attached hereto
as Exhibit "A", and incorporated herein by reference, are compatible with the
objectives nolicies general land uses and programs specified in the General Plan
of the City of Cypress in that all new street alignments drainage sanitary
and utility facilities, ultimate lot sizes and configurations will he instal'ed
as a condition of this map in accordance with the guidelines established in the
Land Use Circulation and Public Facilities Elements of the General Plan
3 None of the findings set forth in Government Code Section 66474 can
be made
'l The discharge of waste from the proposed subdivision into the existing
community sewer system shall not result in a violation of the existing require
ments prescribed by the California Regional Water Quality Control Board having
jurisdiction over the proposed subdivision pursuant to the provisions of Division
7 of the California Water Code (Sections 13000 et seq ) Denial of a subdivision
for violation of the proposed waste discharge standards or an addition to an
existing violation thereof, is a ground for denial of the tentative parcel map,
although such denial is not mandatory
NOW THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Tentative Parcel Map No 79 1104 subject to the
conditions attached hereto as Exhibit 'A
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 13th day of February, 1979

TENTATIVE PARCEL MAP NO 79-1104
1 The developer shall conform to all applicable provisions of the City Code
\11 requirements of the State Subdivision Map Act and the City's Subdivision
Ordinance shall be satisfied
2 Drainage of all parcels shall be solved to the satisfaction of the City
Engineer A grading plan shall be submitted for approval A topograph
of the area surrounding this development shall be made to establish
existing drainage flow patterns If the existing natural flow of any
adjoining parcel is across the land of this development, a drainage ease
ment shall be granted and drainage facilities provided for that property
to the satisfaction of the City Engineer A maximum lot depth of 100 feet
shall be allowed to drain onto Katella Avenue If drainage is directed to
Katella Avenue, drainage culverts shall be constructed underneath sidewalks
to convey all on site runoff water to the street to the satisfaction of
the City Engineer
3 Median openings shall be located to the satisfaction of the City Engineer
The developer shall make a cash deposit equal to the cost of landscaping
and irrigating one-half of the Katella Avenue Median adjacent to the
property or install landscaping and irrigation for an equivalent portion
of the full median
4 A landscape and irrigation plan shall be submitted for approval by the
City and a bond posted by the applicant to guarantee against any defects
in plant materials and workmanship A soils report for all planting areas,
by a qualified agricultural laboratory, shall be submitted to the Public
Works Department for approval at least thirty (30) days prior to planting
date Test results shall include concentration of nitrogen, phosphorus,
potassium pH salinity, sodium status and boron saturation extract
Wheelchair and handicap access facilities shall be installed on site and
off site in accordance with State of California and City of Cypress
Building Department standards
6 On site security lighting shall be arranged so that direct rays will not
shine on adjacent Properties or produce glare for street traffic All
roof mounted equipment such as heating and air conditioning units,
shall be adequately screened from public view, subject to the approval of
the City Staff Commercial or industrial developments which adjoin resi
dentially zoned areas shall construct noise bafflers and/or deflectors
on all mechanical equipment mounted outdoors, to the satisfaction of the
City Staff
7 Future extension of on site streets, including Yamaha Way, shall be shown
on a master plan of development, or Yamaha Way shall be constructed as
a cul-de-sac
An acceleration/deceleration lane is required at the intersection of
Yamaha Way and Katella Avenue
9 The easterly driveway shall be permitted on Katella Avenue for right turn
movements only
10 Katella Avenue and Yamaha Way shall be dedicated and fully improved with
curb, gutter, sidewalk driveway having etc in accordance with the
Master Plan of Streets and Highways, with the exception that sidewalks
will not be required on Yamaha Way Yamaha Way shall have a total
right of way width of forty-five feet (45') with an additional five foot
(5') wide walkway tree planting and public utility easement on each side
of the street Curb returns at the intersection of Yamaha Way and Katella
Avenue shall have a radius of thirty-five feet (35') The corner cutoff
shall be dedicated to the City of Cypress for roadway purposes

11 Street structural sections for Yamaha Way shall be based on the recom
mendit®on and soils report prepared by an engineering firm acceptable
to t e City Engineer with street structural sections to be determined
by using an applicable T I (Traffic Index) The minimum flowline grade
in streets shall be 0 20% 411 existing public improvements at the
development site which are damaged, cracked or otherwise below standard
shall be removed and replaced to the satisfaction of the City Engineer
12 Street structural sections for Katella Avenue shall be based on a
deflection study and materials report prepared by the Orange County
Materials Laboratory Reconstruction of existing pavement on Katella
Avenue may be required
13 All secondary and primary utility services shall be underground The
street in front of this development shall be resurfaced with one inch (1')
minimum thickness asphalt concrete from curb to curb if it is necessary
to open cut the street in more than one place Any open cut shall be
backfilled per City of Cypress Standard No 110
14 Construction of public improvements fronting the residual parcel may be
postponed until future development
15 Street lights shall be installed per City Standards Street name signs
and traffic signs shall be installed per City Standards Necessary fire
hydrants shall be installed in accordance with Fire Department require
;gents and City Standards
16 Street trees (15 gallon) forty feet (40') on center shall be installed
along streets in conformance with the street tree policy of the Public
Works Department The type of trees shall be as required under the
Townscape and Urban Design Element of the General Plan
17 A master plan of sewers shall be submitted for approval by the City
Engineer with plan check and inspection by the City's Engineering
Division, subject to plan checking and inspection fees
18 The developer shall submit a cash deposit of $15,000 00 to cover
one fourth (1/4) of the cost of installing a future traffic signal at
the intersection of Katella Avenue and Yamaha Way The deposit shall
be returned if it is determined that the traffic signal is not required
19 FEES REQUIRED FOR IMPROVEMENTS
A Final subdivision map filing fee (Per Resolution #1713)
B Engineering plan checking and inspection fee (Per Resolution #1713)
C Drainage fee for Master Drainage Plan (Per Resolution #1713)
D Sanitary sewer connection fee (Per Orange County Sanitation District
No 3, Resolution #303)
E Advanced street light energy charges shall be paid (For a one year
period)
F All applicable Building Department fees
G Sanitary sewer assessment fee (for trunk line sewer)
