Resolution No. 2088L 1 L ace - RESOLUTION NO 2088 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING TENTATIVE SUBDIVISION MAP NO 79-1112 - WITH CONDITIONS 59 WHEREAS an application was made by Giron L Grubbs to divide 1 12 acres of land into two lots located at 5311 Lincoln Avenue, Cypress, and WHEREAS, the City Council considered evidence presented by the Applicant, City staff and other interested parties at a public meeting held with respect thereto NOW, THEREFORE, the City Council of the City of Cypress, DOES HEREBY RESOLVE as follows. 1 The proposed map is compatible with the objectives, policies general land uses and programs specified in the General Plan of the City of Cypress in that (a) The map will provide for the establishment of primarily commercial uses with attendant light industrial operations in conformance with the overall goals of the land use element of the General Plan (b) The adjacent arterial street will be fully improved in accordance with the specifications of the circulation element and townscape element of the City's General Plan 2 The design and improvement of the proposed subdivision as designated on the tentative tract map and supplemented by the conditions attached hereto as Exhibit "A", and incorporated herein by reference are compatible with the objectives policies general land uses and programs specified in the General Plan of the City of Cypress in that: (a) The proposed lot size and configurations conform to the specific requirements of the zone classification in which the property is located and will facilitate development in accordance with the land use element of the General Plan (b) All utility extensions will be provided in accordance with various elements of the City's General Plan 3 None of the findings set forth in Government Code Section 66474 can be made 4 The discharge of waste from the proposed subdivision into the existing community sewer system shall not result in a violation of the existing require- ments prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code (Sections 13000 et seq ) Denial of a subdivision for violation of the proposed waste discharge standards or an addition to an existing violation thereof, is a ground for denial of the tentative subdivision map although such denial is not mandatory NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Tentative Subdivision Map No 79-1112 subject to the conditions attached hereto as Exhibit A PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cypress on the 26th day of March 1979 MAYOR OF THE CITY OF CYPRESS ATTEST. None tt CITY CLERK OF THE �X�OF CYPRESS 2 "D8g --�- EXHIBIT "A" TENTATIVE PARCEL MAP NO 79-1112 1 Approval of this application is restricted to the division of one parcel into two parcels of land Any future change in land use will require City Council approval in accordance with Conditional Use Permit procedures 2 The existing water well located on proposed Parcel No 1 shall be abandoned per Orange County Health Department specifications 3 Drainage shall be solved to the satisfaction of the City Engineer A grading plan shall be submitted for approval A topograph of the area surrounding this development shall be made to establish existing drainage flow patterns If the existing natural flow of any adjoining parcel is across the land of this development, a drainage easement shall be granted and drainage facilities provided for that property to the satisfaction of the City Engineer All on-site drainage conveyed to the street shall be by means of an undersidewalk drain, per City standard A11 lots shall have a slope gradient of between one per cent (1%) and three per cent (3%) from rear lot line to the street 4 A maximum lot depth of 100 feet shall be allowed to drain onto Lincoln Avenue If drainage is directed to Lincoln Avenue, drainage culverts shall be constructed underneath sidewalks to convey all on-site runoff water to the street to the satisfaction of the City Engineer 5 The developer shall pay to the City of Cypress one-half the cost of installing the sewer main and lateral in front of this development on Cypress Street The developer shall also pay to the City one-half the cost of the street improvements which were done on Cypress Street in front of the development 6 The developer shall conform to all applicable provisions of the City Code All requirements of the State Subdivision Map Act and the City's Subdivision Ordinance shall be satisfied 1 el
