Resolution No. 2115124 RESOLUTION NO 2115 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AMENDMENT TO CONDITIONAL USE PERMIT NO C 274 WITH CONDITIONS THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES AND ORDERS AS FOLLOWS 1 That an Application was filed for an amendment to a previously approved conditional use permit in accordance with the provisions of Section 17 2 of the Zoning Ordinance of the City of Cypress to allow the sales of used automobiles in conjunction witb existing recreational vehicle sales dba Park Trailer Sales at 5071 Lincoln Avenue 2 That the City Council after proper notice thereof, duly held a public hearing on said Application as provided by law 3 That the City Council hereby finds that a The proposed location of the amendment to conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located in is that To provide appropriately located areas for establishments catering primarily to highway travelers, visitors to the City or such businesses or uses where direct access to major arterial highways is essential or desirable for their operation b The proposed location of the amendment of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that (1) The adjacent arterial street has more than adequate capacity to accommodate the projected volumes of pedestrian and vehicular traffic which may be generated by this use (2) The design of the project and the modified conditions attached thereto are intended to insure that the project will be compatible with uses of adjacent properties and will not interfere with the privacy of residents in the single family area to the north of this property (3) The use is in conformance with the long range objectives of the City as identified in the Land Use Element of the General Plan c The proposed amendment to the conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments 4 The City Council DOES HEREBY GRANT said amendment, subject to the conditions, attached hereto as Exhibit "A" PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the llth day of June 1979 ATTEST 7!r/4(54-Le CITY CLERK OF Y 0 CYPRESS 4901400/01e. 14.4.74.06•Amis MAYOR OF THE CITY OF CYPRESS 1 1 1 STATE OF CALIFORNIA ) SS COUNTY OF ORANGE ) I, DARRELL ESSEX, City Clerk of the City of Cypress, DO HEREBY CERTIFI2 5 that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the llth day of June 1979, by the following roll call vote AYES 5 COUNCIL MEMBERS. None ij C ITYERK��UF H'T E CIT OF CYPRESS 2 - 126 EXHIBIT A AMENDMENT TO CONDITIONAL USE PERMIT NO C 274 1 A revised landscape plan shall be submitted for City Staff approval The applicant shall upgrade the landscape planter along Lincoln Avenue to include mounded ground covering and additional 15 gallon size trees in accordance with the landscape plan 2 Park Trailer Sales and the tool rental business shall be separately licensed and registered with the City's Finance Department 3 A designated used automobile sales area shall not occupy greater than 50 per cent of the entire property area 4 The applicant shall submit an off-street parking plan to accommodate visitor parking A minimum of ten (10) designated spaces shall be provided for the subject business and three (3) designated spaces provided for the rental business which is located on this property 5 The premises may not be used as a truck yard, contractor storage yard, or any other business not specifically authorized by this Conditional Use Permit 6 Storage by the applicant of any non-operating vehicle or used vehicle parts is prohibited 7 No sale or dispensing of gasoline or other oil derivatives shall be permitted on the subject property 8 Servicing of automobiles and recreational vehicles shall be limited to the cleaning of exteriors and interiors of vehicles and preventa tive maintenance No major motor transmission rear end or body work, including painting, shall be performed on the premises 9 All future signing including structural and freestanding signs, shall be reviewed and approved by City Staff prior to installation Pennants flags, banners, blinking lights or similar advertising signs or devices are specifically prohibited in accordance with the City Zoning Ordinance Section No 15 10 This amended Conditional Use Permit is subject to revocation should the applicant violate any or all conditions of approval 11 All conditions of approval for Conditional Use Permit No C-274 except those conditions specifically modified by this amendment are included in the approval of amendment to Conditional Use Permit No C-274 12 This amendment to Conditional Use Permit No C 274 shall expire twelve (12) months from its date of approval should the City Council not take further action to extend this amendment's effective date
