Resolution No. 2118RESOLUTION NO 2118 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AMENDMENT TO CONDITIONAL USE PERMIT NO 77-26 AND TENTATIVE TRACT MAP NO 10,740 - WITH CONDITIONS THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES AND ORDERS AS FOLLOWS. 1 That an Application was filed for an amendment to a previously approved conditional use permit in accordance with the provisions of Section 17 2 of the Zoning Ordinance of the City of Cypress and a single lot tentative tract map for the future subdivision of air space office condominiums to be established on the southeastly corner of Orange Avenue and Grindlay Street, at 5252 Orange Avenue 2 That the City Council after proper notice thereof, duly held a public hearing on said Application as provided by law 3 That the City Council hereby finds that a The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located in is that It is intended as an area primarily for the development of professional and administrative offices with setback landscaping and architectural requirements designed to make such uses relatively compatible with residential uses b The proposed subdivision map is compatible with the objectives policies, general land uses, and programs specified in the General Plan of the City of Cypress in that. (1) A 34,762 square foot condominium office building located on a 2 06 acre parcel of land complies with the objectives of the Land Use Element of the General Plan c The proposed location of the conditional use and tentative tract map and the conditions under which it would be operated will not be detrimental to the public health safety or welfare or be materially injurious to properties or improvements in the vicinity in that (1) Design constraints, including building and parking lot setbacks with landscaped provisions, will be designed to insure that the project will not prove detrimental to adjacent properties (2) The adjacent arterial street has more than adequate capacity to accommodate the projected volumes of pedestrian and vehicular traffic (3) The proposed project will be complementary in design and scale to existing office developments in the neighborhood and adjacent public buildings and uses d The design and improvement of the proposed subdivision as designated on the tentative tract map and supplemented by the con- ditions attached hereto as Exhibit A' and incorporated herein by reference are compatible with the objectives, policies, general land uses, and programs specified in the General Plan of the City of Cypress The Council further determines that none of the findings set forth in Government Code Section 66474 can be made e The discharge of waste from the proposed subdivision into the existing community sewer system shall not result in a violation of the existing requirements prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code 129 130 ) , r 4 The City Council DOES HEREBY GRANT said Amendment to Conditional Use Permit No 77-26 and approves Tentative Tract Map No 10,740, both subject to the conditions attached hereto as Exhibit "A" PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 25th day of June 1979 ATTEST CITY CLEiiK OF 4 CITY OF CYPRESS STATE OF CALIFORNIA ) SS COUNTY OF ORANGE ) YOR OF THE CITY 0 YPRESS I, DARRELL ESSEX, City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the 25th day of June 1979, by the following roll call vote AYES 4 COUNCIL MEMBERS Evans, Hudson, MacLain and Rowan NOES. 0 COUNCIL MEMBERS. Lacayo CITY CLE OF T CITY OF CYPRESS 2 1 1 EXHIBIT "A" (CONDITIONS FOR) AMENDMENT TO CONDITIONAL USE PERMIT NO 77-26 AND TENTATIVE TRACT NO 10,740 1 All conditions of approval for Conditional Use Permit No 77-26 except those conditions specifically modified by this Amendment, are included in the approval of Amendment to Conditional Use Permit No 77 26 and Tentative Tract No 10,740 2 Plans for the proposed landscaping, irrigation and parking lot lighting systems shall be submitted for approval by City Staff Required land- scaping and irrigation system shall be installed prior to the issuance of a Certificate of Occupancy for this project. (Modifies Conditional Use Permit No 77-26, Condition Number 1 ) 3 A comprehensive signing program shall be submitted for City Staff review and approval This plan shall provide specific details for permanent tenant identification and subdivision sales information Since this project is adjacent to the Civic Center freestanding "For Sale" signs indicating resales will be prohibited on the property at all times A central directory board indicating sales information may be established by the owners' association subject to City Staff review and approval These signing regulations shall also be included within the covenants conditions and restrictions for Tract No 10,740 4 Detailed exterior elevations for the Cypress Manor Office Complex Conditional Use Permit No 77-26 shall be reviewed and approved by the Staff Architectural Review Committee prior to issuance of any building permits (Modifies Conditional Use Permit No 77-26 Condition Number 5 ) 5 To mitigate the adverse impact of increasing Building E to two stories in height, all windows along the second floor southerly exposure shall have six feet (6') of minimum clearance from the interior second floor grade 6 The covenants, conditions and restrictions for Tract No 10 740 shall be reviewed and approved by City Staff prior to recordation 7 A grading plan shall be submitted indicating elevations of subject property and all adjoining residential properties This plan shall provide specific elevations and construction information concerning the existing concrete block wall separating the adjoining residences (Modifies Conditional Use Permit No 77-26 Condition Number 8 )
