RESOLUTION NO 2119
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS GRANTING A VARIANCE FROM THE TERMS OF THE
ZONING ORDINANCE OF THE CITY OF CYPRESS TO ALLOW
A FREESTANDING SIGN OF GREATER HEIGHT AND AREA
THAN THAT ALLOWED BY ORDINANCE
VARIANCE NO 79-1
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES AND ORDERS AS FOLLOWS
1 That an Application was filed for a Variance from the terms of the
Zoning Ordinance of the City of Cypress to allow placement of a freestanding
directory sign with an overall height of 32 feet which exceeds the Zone's
maximum allowable height by 7 feet and a total sign area of approximately
290 square feet which exceeds the Zone's allowable area by 165 square feet
This sign is intended to identify the Cinnamon Square Shopping Center located
at the northwesterly corner of Ball Road and Juanita Street in the City of
Cypress
2 That the City Council, after proper notice thereof duly held a
public hearing on said application as provided by law
3 That the City Council hereby finds that.
(a) Because of special circumstances applicable to the property,
the strict application of the Zoning Ordinance deprives such property
of privileges enjoyed by other property in the vicinity and under
identical zoning classification in that there are extraordinary circum-
stances applicable to the properties in the same zone since this
particular parcel of land has extensive lot depth in comparison to its
street frontage Therefore, the Shopping Center structures were con-
structed at a greater distance from Ball Road than those of similar
properties in the same zone
(b) The Variance as granted and as conditioned does not consti
tute a grant of special privileges inconsistent with the limitations
upon other properties in the vicinity and zone in which such property
is situated in that the subject parcel of land has the greatest lot
area of all those parcels along the northerly side of Ball Road east
of Valley View Street in the CG -10 000 Commercial General Zone
Therefore this sign application is providing each future tenant the
equivalent amount of sign area that presently exists for businesses
in the same zone
(c) The granting of the Variance will not be detrimental to the
public health, safety or welfare or materially injurious to properties
or improvements in the vicinity in that the design and location of the
subject sign is so situated that it will not detract from adjoining
parcels nor block the vision of existing signs for neighboring
properties
(d) The granting of the Variance will not detract from the
attractiveness or orderliness of the City's appearance or the
surrounding neighborhood since all aspects of its construction will
be in conformance with the City's Uniform Building and Electric Codes
(e) The granting of the Variance will not create a hazard to the
public safety since the sign has been designed with a minimum of
8 feet of ground clearance, thereby allowing full vision of pedestrians
on the public sidewalk from vehicles exiting this parcel of land
4 The City Council does hereby GRANT said Variance subject to the
following condition•
1 Four tenant copy panels shall be removed
from the proposed sign reducing its overall
area by 36 square feet
