RESOLUTION NO 2144
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING CONDITIONAL USE PERMIT NO 79-14 -
WITH CONDITIONS
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS
1 That an Application was filed for a conditional use permit in
accordance with the provisions of Section 17 2 of the Zoning Ordinance of
the City of Cypress to establish a Paving Contractor's Equipment Storage
Yard at 5312 Cypress Street in the CH -10,000 LC Commercial Heavy/Lincoln
Avenue Combining Zone
2 That the City Council, after proper notice thereof duly held a
public hearing on said Application as provided by law
3 That the City Council hereby finds that.
a The proposed location of the conditional use is in accord with
the objectives of the Zoning Ordinance and the purpose of the zone in
which the site is located is that
This zone is intended to provide appropriately located
areas for establishments catering primarily to highway
travelers, visitors to the City or such businesses or
uses where direct access to major arterial highways is
essential or desirable for their operation
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health, safety or welfare or be materially injurious to
properties or improvements in the vicinity in that.
(1) The adjacent arterial street has more than adequate
capacity to accommodate the projected volumes of
pedestrian and vehicular traffic to be generated by
this use
(2) The design of the project and the conditions of
development attached thereto will insure that the
project will be compatible with other light
industrial and commercial uses on adjacent properties
and will not interfere with the privacy of residents
in the apartment project located westerly on Cypress
Street
(3)
The use is in conformance with the long range
objectives of the City as identified in the Land
Use Element of the General Plan and the overall goals
of the City in protecting the public's investment in
the City's Corporation Maintenance Yard
c The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments
4 The City Council DOES HEREBY GRANT said conditional use permit,
subject to the conditions attached hereto as Exhibit "A"
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 22nd day of October 1979

CONDITIONAL USE PERMIT NO 79-14
1 The property's existing metal building shall be upgraded to meet all
building codes and the exterior painted to meet City Staff approval
2 The property access gate shall be constructed of a solid screening
material to prohibit view of the storage yard interior
3 Any outdoor storage of paving material shall be stored in a manner
approved by the City's Building Department and Fire Marshal's Office
In no event shall material be piled higher than six feet (6') in height
4 The asphalt yard area shall be striped for employee parking and vehicle
storage in an orderly manner subject to Planning Department approval
5 All mechanical repair and maintenance shall take place within the
enclosed building Outdoor repair, overhaul storage of junked vehicles
or parts are specifically prohibited
6 Above ground storage tanks of any fashion are prohibited Should the
applicant wish to install underground gasoline tanks and pumping
facilities, approval must be obtained from the Fire Marshal's Office
and the City Building Department
7 All conditions of approval for this conditional use permit shall be
complied with prior to any storage of contracting equipment or utili
zation of the subject property for business purposes
8 Drainage shall be solved to the satisfaction of the City Engineer A
grading plan shall be submitted for approval A topograph of the area
surrounding this development shall be made to establish existing
drainage flow patterns If the existing natural flow of any adjoining
parcel is across the land of this development, a drainage easement
shall be granted and drainage facilities provided for that property to
the satisfaction of the City Engineer All on-site drainage conveyed
to the street shall be by means of an undersidewalk drain per City
standard All lots shall have a slope gradient of between one
per cent (1%) and three per cent (3%) from rear lot line to the street
9 A minimum six foot (6') high block wall, measured from the highest
adjacent grade, shall be constructed along the west and north property
lines A retaining wall per City standards shall be constructed at
the property line where the grade difference is greater than twelve
inches (12")
10 A landscape and irrigation plan incorporating an automatic system
shall be submitted for approval by the City and a bond posted by the
applicant to guarantee against any defects in plant materials and
workmanship A soils report for all planting areas, by a qualified
agricultural laboratory, shall be submitted to the Public Works Depart-
ment for approval at least thirty (30) days prior to planting date
Test results shall include concentration of nitrogen phosphorus
potassium pH salinity sodium status and boron saturation extract
A minimum of three 15 gallon size street trees with shrubbery and ground
cover shall be planted in the landscape area subject to Planning Depart-
ment review and approval

11 On-site security lighting shall be arranged so that direct rays will
not shine on adjacent properties or produce glare for street traffic
12 A six foot (6') wide concrete sidewalk shall be constructed behind the
curb and gutter in front of this development, per Orange County Standard
No 205 The driveway shall be per City of Cypress Standard No 207
(35' wide) Adequate sight distance also shall be maintained within the
development at all driveway intersections to the satisfaction of the
City Engineer
13. All existing public improvements at the development site which are
damaged cracked, or otherwise below standard, shall be removed and
replaced to the satisfaction of the City Engineer
14 All secondary and primary utility services shall be underground The
street in front of this development shall be resurfaced with one inch
(1") minimum thickness asphalt concrete from curb to curb if it is
necessary to open cut the street in more than one place Any open
cut shall be backfilled per City of Cypress Standard No 110
15 Fire hydrants, if necessary, shall be installed in accordance with
Fire Department requirements and City Standards All requirements of
the Orange County Fire Marshal's Office shall be complied with prior
to commencement of the business
16 Fees Required for Improvements
(a) Engineering plan checking and inspection fee (Per Resolution 1713)
(b) Drainage fee for Master Drainage Plan (Per Resolution 1713)
(c) All applicable Building Department fees
17 Should the applicant violate any of the aforementioned conditions of
approval for Conditional Use Permit No 79-14, the City Council may
review and revoke said conditional use permit if it finds that the
property is operated or maintained to the detriment of the public
health safety, or welfare, or materially injurious to properties or
improvements in the vicinity
