Resolution No. 21671 C 1 '-re,7 —/ RESOLUTION NO 2167 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING TENTATIVE PARCEL MAP NO 79-1157 WITH CONDITIONS WHEREAS an application was made by the Cypress Land Company to divide t 117 4 acres of land into four parcels generally located on the south side of Katella Avenue between Valley View Street and Knott Street excluding the 40 acre parcel at the southwest corner of Katella Avenue and Knott Avenue WHEREAS, the City Council considered evidence presented by the Applicant, City Staff and other interested parties at a public meeting held with respect thereto NOW, THEREFORE, the City Council of the City of Cypress DOES HEREBY RESOLVE as follows. 1 The proposed map is compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that. (a) The lot sizes proposed by this subdivision are compatible with the land use objectives of the General Plan and the specific development proposals of the zone classification in which the property is located, (b) The adjacent arterial streets will be dedicated, widened and improved in accordance with the provisions of the Circulation Element of the General Plan 2 The design and improvement of the proposed subdivision as designated on the tentative parcel map and supplemented by the conditions attached hereto as Exhibit A and incorporated herein by reference are compatible with the objectives, policies general land uses and programs specified in the General Plan of the City of Cypress in that all new street alignments, drainage, sanitary and utility facilities, ultimate lot sizes and configurations will be installed as a condition of this map in accordance with the guidelines established in the Land Use Circulation and Public Facilities Elements of the General Plan 3 None of the findings set forth in Government Code Section 66474 can be made 4 The discharge of waste from the proposed subdivision into the exist ing community sewer system shall not result in a violation of the existing requirements prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code (Sections 13000 et seq ) Denial of a subdivision for violation of the proposed waste discharge standards or an addition to an existing violation thereof, is a ground for denial of the tentative parcel map although such denial is not mandatory NOW, THEREFORE BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Tentative Parcel Map No 79-1157 subject to the conditions attached hereto as Exhibit "A" PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 26th day of November 1979 ATTEST CITY CL Il "1f04Y/OF CYPRESS 042.24, MAYOR OF THE CITY OF CYPRESS to STATE OF CALIFORNIA ) ss COUNTY OF ORANGE ) I, DARRELL ESSEX, City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the 26th day of November, 1979 by the following roll call vote AYES 5 COUNCIL MEMBERS: Evans, Hudson, Lacayo, MacLain and Rowan NOES. 0 COUNCIL MEMBERS None ABSENT 0 COUNCIL MEMBERS: None CI CLERK �)F-TH OF CYPRESS 2 1 iii1=11111111N INN c;-C 7 tyl* EXHIBIT "A" TENTATIVE PARCEL MAP NO 79-1157 1 The applicant, Cypress Land Company, shall retain the necessary plan- ning consultants to create a master plan for parcels 1 2 3 and 4 of Tentative Parcel Map No 79 1157, which will specifically detail the following information A A specific land use plan with percentages of commercial office and industrial B Specify zoning criteria which establishes architectural compati- bility throughout this property and the requirement for covenants, conditions, and restrictions for private property maintenance, signing, and landscaping C A specific plan o.E future street alignments supported by a traffic generation study which will address all necessary improvements at intersections to be created along Valley View Street and Katella Avenue This traffic study shall address the transportation needs along Katella Avenue and Valley View Street and specify location of bus stops and bus shelters D A specific landscape plan providing for uniform street tree themes along Katella Avenue, Valley View Street and Holder Street and also establishing criteria for on site private landscaping for all future businesses to locate in this area This landscape plan shall also include a landscape design and irrigation plan for the exist- ing median islands on Katella Avenue and Valley View Street A bond shall be posted with the City by the applicant to guarantee against any defects in plant materials and workmanship for a period of one year from installation of said landscaping within the median islands The applicant shall submit the specific master plan to the City in con junction with an Environmental Impact Report for review and approval by the Cypress City Council The City shall not issue any grading per- mits or building permits for any building to be located on parcels 1 2 3 or 4 of Tentative Parcel Map No 79 1157 until such time the specific master plan has been adopted by ordinance for this property The applicant, Brian Harvey of Cypress Land Company, shall sign an agreement to this condition which will be recorded in conjunction with this parcel map This condition will be binding upon all future land owners of parcels 1, 2, 3 or 4 2 In conjunction with the specific master plan the City's Traffic Engineering Division has determined that the following minimal inter section improvements shall be made by the developer The developer shall submit the following cash deposits. A $15,000 to cover one fourth the cost of installing a future traffic signal at the intersection of Katella Avenue and Dana Way B $30,000 to cover one-half the cost of the future traffic signal at Katella Avenue and Hope Street C $60 000 to cover the total cost of a future traffic signal on Valley View Street between Katella Avenue and the Stanton Storm Channel D $19 000 to cover one-third the cost of the traffic signal at the intersection of Katella Avenue and Holder street 3 The developer shall conform to all applicable provisions of the City Code All requirements of the State Subdivision Map Act and the City's Subdivision Ordinance shall be satisfied 212 2 4 Drainage shall be solved to the satisfaction of the City Engineer A grading plan shall be submitted for approval A topograph of the area surrounding this development shall be made to establish existing drain- age flow patterns If the existing natural flow of any adjoining parcel is across the land of this development a drainage easement shall be granted and drainage facilities provided for that property to the satisfaction of the City Engineer 5 The Holder Street Storm Drain shall be constructed per plans and speci fications for City Project 7840-20 on file in the office of the City Engineer The cost of this project may be deducted from the applicable drainage fees 6 The developer shall make a cash deposit equal to the cost of a land- scape and irrigation system for one-half of the medians on Katella Avenue and Valley View Street adjacent to the property, or install landscaping and irrigation for an equivalent portion of the full median Median openings shall be located to the satisfaction of the City Engineer 7 Katella Avenue and Holder Street shall be dedicated and fully improved with curb gutter sidewalk driveway and paving in accordance with the Master Plan of Streets and Highways Holder Street shall have a total right of -way width of eighty four feet (84'), and shall be fully improved to join existing improvements south of the Stanton Storm Channel This condition specifically includes the crossing of the Stanton Storm Channel Curb returns at the intersection of Katella Avenue and Holder Street shall have a radius of thirty-five feet (35') Corner cutoffs shall be dedicated to the City of Cypress for roadway purposes 8 Street structural sections shall be based on the recommendation and soils report prepared by an engineering firm acceptable to the City Engineer with street structural sections to be determined by using an applicable T I (Traffic Index) The minimum flowline grade in streets shall be 0 20o All existing public improvements at the development site which are damaged, cracked, or otherwise below standard, shall be removed and replaced to the satisfaction of the City Engineer 9 All secondary and primary utility services shall be underground The street in front of this development shall be resurfaced with one inch (1") minimum thickness asphalt concrete from curb to curb if it is necessary to open cut the street in more than one place Any open cut shall be backfilled per City of Cypress Standard No 110 10 On Valley View Street, Katella Avenue and Holder Street street lights shall be installed per City Standards Street name signs and traffic signs shall be installed per City Standards Necessary fire hydrants shall be installed in accordance with Fire Department requirements and City Standards 11 Street trees shall be installed along streets in conformance to the street tree policy of the City and according to the adopted master plan 12 A master plan of sewers shall be submitted for approval by the City Engineer with plan check and inspection by the City's Engineering Division, subject to plan checking and inspection fees Sewer laterals connecting the existing house on this property shall be plugged at the property line 13 Fees Required for Improvements A Final subdivision map filing fee (Per Resolution No 1713) B Engineering plan checking and inspection fee (Per Resolution No 1713) C Drainage fee for Master Drainage Plan (Per Resolution No 1713) D Sanitary Sewer assessment fee (for installation of Truck Line Sewer) E Advanced street light energy charges shall be paid (for a one year period)
