RESOLUTION NO 2206
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
CONDEMNING THE DISPLAY AND SALE OF DRUG PARAPHERNALIA
TO MINORS AND URGING ALL CITIZENS OF THE CITY TO ADDRESS
THEMSELVES TO THE PROBLEMS PRESENTED BY ILLEGAL DRUGS
WHEREAS, the increased use of illegal drugs in the City of Cypress
threatens the health, safety and well-being not only of those persons who use
such drugs themselves but also of the entire community of the City of
Cypress, and
WHEREAS, the problems presented by illegal drugs within this community
can only be successfully addressed through the concerted effort of the
entire community, and

WHEREAS, this City Council wishes to enlist the support of the entire
community of the City of Cypress in addressing the problem of illegal drugs in
our community, and, in particular, and as a starting point, the display and sale
of drug paraphernalia to young people
NOW, THEREFORE, the City Council of the City of Cypress hereby does find,
determine,resolve and order as follows:
SECTION 1 It is hereby specifically found and determined as follows.
(a) Minors entering at least one local business have been
and are being exposed to the display of devices, instruments, and
contrivances whose purposes include aiding in the smoking, ingesting,
or injecting of marijuana, hashish, PCP and other controlled sub-
stances within the meaning of the Health and Safety Code of the
State of California;
(b) Because such minors often lack the judgement and discern-
ment of adults, they may find it difficult to make the distinction
between the unrestricted display and sale of such items on the one
hand and the actual use of such items in an unlawful manner, on
the other hand, and
(c) Thus, the unrestricted display and sale of such items
tend to convey to such minors the misimpression that the community
condones and even endorses the use of such items for unlawful purposes,
and such display and sale thereby tend to increase the use of illegal
drugs by minors
SECTION 2 For the reasons set forth in Section 1 hereof, this City Council
hereby condemns the display and sale of such devices (sometimes referred to as
"drug paraphernalia") and urges all members of the community to join with it
in seeking to eliminate this practice
SECTION 3 This City Council has been advised that devices of the type
described hereinabove are being displayed for sale to minors at an establishment
known as "Peer Records" located at 10151 Valley View Street in Cypress In
connection therewith this City Council hereby calls upon the owner or owners
of such establishment to voluntarily cease such display and sales of such
devices
SECTION 4 This City Council hereby recognizes that the vast majority of
merchants within the City of Cypress have not engaged in the display and
sale of drug paraphernalia On behalf of the entire Cypress community, the
City Council extends to said merchants its sincere appreciation for their
conduct in this regard and requests their continued assistance as the community
addresses the problems of illegal drugs
SECTION 5. This City Council recognizes that the display and sale of drug
paraphernalia to minors are merely one small part of the overall problem of
illegal drug usage and that the elimination of such display and sale will not
mean the elimination of illegal drugs Nevertheless, the City Council considers
that the elimination sof the display and sale of drug paraphernalia to minors
would be a significant first step in that direction Therefore, all members
of the Cypress community hereby are requested to join with the City Council
in this first step and are further urged to address themselves, in their
own families, neighborhoods, and businesses, to the larger problem of illegal
drugs in this community
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 10th day of March 1980
