RESOLUTION NO 2213
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING CONDITIONAL USE PERMIT NO 80-5 -
WITH CONDITIONS
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS RESOLVES
DETERMINES, AND ORDERS AS FOLLOWS.

1 That an Application was filed for a conditional use permit in
accordance with the provisions of Section 17 2 of the Zoning Ordinance of
the City of Cypress to permit the off-site sale of alcoholic beverages
(beer and wine) at "Mr Keg," a new business proposing to locate at
5892 Lincoln Avenue
2 That the City Council, after proper notice thereof duly held a
public hearing on said Application as provided by law
3 That the City Council hereby finds that
a The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose of the
zone in which the site is located is that
This zone is intended to provide appropriately located
areas for establishments catering primarily to highway
travelers, visitors to the City or such businesses or
uses where direct access to major arterial highways is
essential or desirable for their operation
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health safety or welfare or be materially injurious to
properties or improvements in the vicinity in that
(1)
The use is compatible with other uses established
within the same shopping center
(2) Adequate off-street parking is provided on-site
(3) The adjacent arterial highways have more than adequate
capacity to accommodate the anticipated volumes of
pedestrian and vehicular traffic to be generated by
this use
c The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments
4 The City Council DOES HEREBY GRANT said conditional use permit
subject to the conditions attached hereto as Exhibit A
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 24th day of March, 1980

EXHIBIT "A"
CONDITIONAL USE PERMIT NO 80-5
1 The property owner shall submit to the City a uniform signing
program which conforms with present sign code requirements,
thereby eliminating painted on wall signs and upgrading the
existing freestanding pole sign along Lincoln Avenue Upon
approval of such program by the Planning Director, it shall
be implemented prior to the issuance of a certificate of
occupancy
2 The subject property lacks any appreciable amount of parking lot
landscaping which makes this parcel nonconforming with present
City Codes Therefore the property owner shall submit a land-
scape and irrigation plan to the City indicating installation of
additional landscaping which meets the City minimum 20 square
feet of landscaping per parking space required within the park
ing lot area Upon approval of such plan by the Planning
Director, it shall be implemented prior to the issuance of a
certificate of occupancy
3 The entire parking lot shall be slurry seal coated to prevent
further deterioration and parking stalls shall be restriped in
accordance with the Zoning Ordinance dimension requirements
4 Staff suggests that the property owner consider architecturally
remodeling the commercial building which may in turn help retain
commercial tenants
5 All requirements of the City's Zoning Ordinance where applicable
to the proposed land use shall be satisfied by both the applicant
and property owner prior to commencement of the subject business
