RESOLUTION NO 2217
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING TENTATIVE TRACT MAP NO 11082 -
WITH CONDITIONS
WHEREAS, an application was made by Sunday 4 Company to subdivide
1 46 acres of land into one lot for the purpose of developing a commercial
office condominium project to be located at 6101 Ball Road Cypress
WHEREAS the City Council considered evidence presented by the Applicant
City staff and other interested parties at a public meeting held with respect
thereto
NOW THEREFORE, the City Council of the City of Cypress DOES HEREBY
RESOLVE as follows
1 The proposed map is compatible with the objectives, policies general
land uses and programs specified in the General Plan of the City of Cypress in
that
(a) The proposed air space office condominium project conforms
with the commercial general land use designation for the subject
property as designated in the Land Use Element of the City's General
Plan
2 The design and improvement of the proposed subdivision as designated
on the tentative tract map and supplemented by the conditions attached hereto
as Exhibit A" and incorporated herein by reference, are compatible with the
objectives, policies, general land uses and programs specified in the General
Plan of the City of Cypress in that
(a) The subject property will be developed in a manner so
that vehicular traffic egress and ingress will conform to those
designated median openings in the Circulation Element of the
City's General Plan Furthermore all necessary street
improvements including curb gutter sidewalk, and street
pavement will be installed to the ultimate right of way width
3 None of the findings set forth in Government Code Section 66474 can
be made
4 The discharge of waste from the proposed subdivision into the
existing community sewer system shall not result in a violation of the
existing requirements prescribed by the California Regional Water Quality
Control Board having jurisdiction over the proposed subdivision pursuant
to the provisions of Division 7 of the California Water Code (Sections
13000 et seq )
NOW THEREFORE BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Tentative Tract Map No 11082 subject to the
following conditions
1 All conditions of approval imposed by the Design Review Committee
upon approval of the office building (DRC No 80-3) as outlined
in Exhibit "A" attached are hereby included within the approval
of Tentative Tract Map No 11082
2 All requirements of the State of California Subdivision Map Act
shall be complied with prior to the ultimate sale of any
condominium office space
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cypress on the 24th day of March 1980

EXHIBIT A'
CONDITIONS OF APPROVAL FOR DRC NO 80-3
1 The two separate parcels of land, on which Sunday & Company is proposing
to build, must be consolidated under one ownership prior to issuance of
City building permits
2 A landscape and irrigation plan shall be submitted to the Planning
Department for review and approval indicating the variety and number
of plants utilized in the landscape plan and provisions for automatic
irrigation system A bond shall be posted to guarantee against any
defects in plant materials and workmanship for a period of one year
from acceptance of the landscape installation
3 A uniform signing program indicating any building or freestanding
signing shall be submitted to the Planning Department for review and
approval prior to installation of such signing
4 The final building elevations which will indicate construction
materials and colors shall be approved by the Planning Department
prior to the Building Department issuing any building permits on this
property Specifically, windows shall be either eliminated or placed
a minimum of six feet (6') high from the interior floor level of both
the second and third building floors along the north elevation
5 Drainage shallbe solved to the satisfaction of the City Engineer A
grading plan signed by a registered engineer and using actual grades
from an Orange County benchmark shall be submitted for approval A
topograph of the area surrounding this development shall be made to
establish existing drainage flow patterns If the existing natural flow
of any adjoining parcel is across the land of this development, a drain
age easement shall be granted and drainage facilities provided for that
property to the satisfaction of the City Engineer All on site drainage
conveyed to the street shall be by means of an undersidewalk drain, per
City standard In parking areas, AC shall have a minimum slope gradient
of two percent (2%), and concrete shall have a minimum slope gradient of
two-tenths percent ( 2%)
6 A minimum six-foot (6') high block wall measured from the highest
adjacent grade, shall be constructed along the north property line
A retaining wall per City standards shall be constructed at the prop
erty line where the grade difference is greater than twelve inches
(12') A six-inch (6") concrete curb per City standards shall be
constructed at a minimum distance of three feet (3') from the base of
all block walls exposed to vehicular traffic
7 Developer and all subcontractors shall provide the City with a Certif-
icate of Insurance evidencing a comprehensive liability insurance
policy(s) with a combined single limit of not less than $500 000 each
occurrence in connection with the work performed Certificate shall
include the City as additional insured Policy shall include the City
its Council, officers members of boards or commissions and employees
are hereby declared to be additional Named Insureds with respect to
all claims actions damages liabilities and expenses, including
attorney's fees, arising out of or in connection with the work to be
performed under the development executed by the Named Insured and
City, including any act or omission of employees, agents, subcontractors,
or their employees Such certificate shall have a thirty (30) day
cancellation notice to the City of Cypress

8 A written agreement with the property owner to the east for the
combined use of the drive on the east property line of this develop
ment shall be on file at the City
9 Wheelchair and handicap access facilities shall be installed on site
and off-site in accordance with State of California and City of
Cypress Building Department standards

10 On-site security lighting shall be arranged so that direct rays will
not shine on adjacent properties or produce glare for street traffic
All roof mounted equipment, such as heating and air conditioning units,
shall be adequately screened from public view subject to the approval
of the City staff The developer shall construct noise bafflers and/or
deflectors on all mechanical equipment mounted outdoors, to the satis
faction of the City staff
11 Ball Road shall be fully improved with curb gutter sidewalk, drive
way paving, etc , in accordance with the Master Plan of Streets and
Highways The sidewalk, curb, and gutter shall be constructed to
match existing improvements on both sides of this development
12 The quantity, location, width, and the type of driveway shall be
subject to the approval of the City Engineer An effective sight
distance for vehicular traffic shall be maintained at the intersection
of the driveway entrances with Ball Road No landscaping will be
allowed in the area of the curb returns Adequate sight distance
also shall be maintained within the development at all driveway
intersections to the satisfaction of the City Engineer
13 All secondary and primary utility services shall be underground
The street in front of this development shall be resurfaced with one
inch (1') minimum thickness asphalt concrete from curb to curb if it
is necessary to open cut the street in more than one place Any open
cut shall be backfilled per City of Cypress Standard No 110
14 Street lights and traffic signs shall be installed per City standards
Necessary fire hydrants shall be installed in accordance with Fire
Department requirements and City standards
15 Street trees (15 gal ) forty feet (40') on center shall be installed
along streets in conformance to the street tree policy of the Public
Works Department The type of trees shall be as required under the
Townscape and Urban Design Element of the General Plan
16 Sewer laterals connecting existing houses at this property shall be
plugged at the property line
17 In conformance with the City of Cypress Master Plan of Trails, no
parking shall be allowed on Ball Road in front of this development
18 Left turn access may be eliminated by future construction of a raised
median in Ball Road at the option of the City
19 The developer shall conform to all applicable provisions of the City
Code

20 The following fees shall be paid
a Engineering plan checking and inspection fee (per Resolution 1713)
b Drainage fee for Master Drainage Plan (per Resolution 1713)
c Sanitary sewer connection fee (per Orange County Sanitation
District No 3 Resolution 303)
d Advanced street light energy charges shall be paid (for a one
year period)
e All applicable Building Department fees
21 Since the applicant has indicated his intentions to proceed with
subdividing this building into air space condominium offices a
tract map must be reviewed and approved by the Cypress City Council
and recorded prior to the sale of any office space Covenants,
Conditions and Restrictions will be required by the City of Cypress
which outline the property owners association's responsibility to
maintain the property in good condition These C C $ R's shall
be reviewed and approved by Cypress City Staff and City Attorney
prior to recordation
