Resolution No. 2222429 RESOLUTION NO 2222 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING MODIFICATION NO 3 TO CONDITIONAL USE PERMIT NO C-206 - WITH CONDITIONS THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS RESOLVES DETERMINES AND ORDERS AS FOLLOWS 1 That an Application was filed for a conditional use permit in accordance with the provisions of Section 17 2 of the Zoning Ordinance of the City of Cypress to expand Superene Feed Supplement, Inc , 5421 Philo Street by allowing construction of an additional warehouse building and parking area at the terminus of Electric Street 2 That the City Council, after proper notice thereof, duly held a public hearing on said Application as provided by law 3 That the City Council hereby finds that a The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is that This zone is intended as an area for light industrial and limited service commercial uses that can meet high performance standards but that frequently do not meet site development standards appropriate to planned research and development of industrial parks b The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health safety or welfare or be materially injurious to properties or improvements in the vicinity in that (1) Electric Street, a designated local street on the Circulation Element on the General Plan will be fully improved to accommodate additional traffic for the warehouse structure and parking area at the northerly terminus of Electric Street (2) In accordance with the City's Master Plan of Drainage, the City will be responsible for providing storm drain facilities from the terminus of Electric Street under the Southern Pacific right of -way into the Jonathan Storm Channel The adjoining property owners on Electric Street will provide the necessary storm drain catch basins to eliminate any flooding along Electric Street (3) The applicant is required to repaint and refurbish the entire grain milling plant to improve the visual aesthetics of the City of Cypress (4) This conditional use permit will allow a temporary metal building to be constructed on leased property which could be terminated at the desires of the property owner, namely, the Southern Pacific Transportation Company c The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments 4 The City Council DOES HEREBY GRANT said conditional use permit subject to the conditions attached hereto as Exhibit "A ED AND ADOPTED by the City Council of the City of Cypress at a regu ar meeting held on the 28th day of April, 1980 ATTEST 417 CITYA �'�Hh Y OF CYPRESS STATE OF CALIFORNIA ) SS COUNTY OF ORANGE ) MAYOR OF THE _COF CYPRESS )aa I DARRELL ESSEX, City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the 28th day of April, 1980 by the following roll call vote AYES 3 COUNCIL MEMBERS Lacayo, Rowan and Evans NOES: 0 COUNCIL MEMBERS: None ABSENT 0 COUNCIL MEMBERS. None ABSTAINED.2 COUNCIL MEMBERS Coronado and Mullen 2 CLS4Z ERK F THE CITY OF CYPRESS 3 EXHIBIT "A" MODIFICATION NO 3 TO CONDITIONAL USE PERMIT NO C-206 1 A grading plan shall be submitted for City approval A topograph of the area surrounding this development shall be made to establish existing drainage flow patterns If the existing natural flow of any adjoining parcel is across the land of this development a drainage easement shall be granted and drainage facilities provided for that property to the satisfaction of the City Engineer 2 Superene Feed shall make payment in advance for estimated cost of required street improvements to be constructed as part of the storm drain contract Street improvements will generally consist of concrete cross gutter, curb and gutter and pavement Superene shall design entrance to new building area to fit street grades 3 Electric Street shall be fully improved in accordance with the Master Plan of Streets and Highways to the satisfaction of the City Engineer 4 The off-street parking area shall be paved and striped in accordance with City Zoning Ordinance standards 5 All existing public improvements at the development site which are damaged, cracked, or otherwise below standard, shall be removed and replaced to the satisfaction of the City Engineer 6 The quantity, location, width and the type of driveway for the ware house building shall be submitted to the approval of the City Engineer An effective sight distance for vehicular traffic shall be maintained at the intersection of the driveway entrance with Electric Street 7 All secondary and primary utility services for the new building shall be underground 43 L 8 Construction permitted by Modification No 3 to Conditional Use Permit No C 206 shall not commence until all applicable conditions of the original Conditional Use Permit No C 206 and previous modifications have been satisfied or a cash bond in an amount determined by City staff shall be submitted to guarantee completion of the previous applicable conditions within a period not to exceed nine (9) months from the date of City Council approval Specifically the applicant shall paint all unsightly rusting structures at Superene Feed Supplements Inc and maintain the property in a clean appearing condition subject to the ongoing review by City Council 9 All conditions of approval for Modification No 3 to Conditional Use Permit No C 206 are hereby included within the original conditions of approval for Conditional Use Permit No C 206 1
