Resolution No. 2224434 RESOLUTION NO 2224 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO 80-9 WITH CONDITIONS THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES DETERMINES, AND ORDERS AS FOLLOWS 1 That an Application was filed for a conditional use permit in accordance with the provisions of Section 17 2 of the Zoning Ordinance of the City of Cypress to establish a Church and Sunday School on property presently owned by the Holy Cross Lutheran Church at 4371 Cerritos Avenue 2 That the City Council, after proper notice thereof, duly held a public hearing on said Application as provided by law 3 That the City Council hereby finds that. a The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is that This zone is intended as an area for single-family urban residential development on minimum lot sizes of 6,000 square feet and maximum densities of 5 0 dwelling units per acre Only those additional uses are permitted that are complimentary to and can exist in harmony with a residential neighborhood b The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that (1) The subject property was previously owned by and utilized for church related activities The subject proposal is similar in nature to the previously approved Conditional Use Permit No 76-15 which permitted construction of the youth center building (2) The subject property has more than adequate space to provide off-street parking for present and future off street parking requirements according to the City's Zoning Ordinance Cerritos Avenue has more than adequate capacity to accommodate the increase in vehicular traffic which will be generated by this church land use (3) (4) The City Council will retain ongoing jurisdiction over the hours of operation for the future child day care facility c The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments 4 The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions attached hereto as Exhibit "A" PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 28th day of April, 1980 ATTEST CITY CLERK OF T4/4HE TY OF CYPRESS YOR OF THE CYPRESS 1 1 STATE OF CALIFORNIA ) SS COUNTY OF ORANGE ) 435 I, DARRELL ESSEX, City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the 28th day of April 1980, by the following roll call vote AYES. 5 COUNCIL MEMBERS: Coronado, Lacayo, Mullen, Rowan and Evans NOES. 0 COUNCIL MEMBERS. None ABSENT 0 COUNCIL MEMBERS: None CIT CLAgeTHEJ ���CTY OF CYPRESS - 2- 436 x_ t' r, a EXHIBIT "A" CONDITIONAL USE PERMIT NO 80-9 vommii 2 aZq- 1 All applicable conditions of Conditional Use Permit No 76-15 for construction of the subject building and improvement of the property are hereby incorporated into the approval of Conditional Use Permit No 80-9 2 A revised plot plan indicating the final property improvements which include parking, landscaping and security fencing shall be submitted to the City Council for review and approval prior to certificates of occupancy being issued for the church buildings 3 A detailed landscape and irrigation plan shall be submitted to the City Council for approval prior to the installation of the required landscaping on this property The landscape plan shall incorporate additional landscaping within the parking area and turf in those unpaved areas along the north end of the property A landscape maintenance bond shall be submitted to the City to guarantee the maintenance of the landscape area for a period of one year from the occupancy date of the church facility 4 Detailed architectural elevations shall be submitted for review and approval by the City Council prior to any building permits being issued for the future sanctuary building 5 The City Council shall maintain ongoing jurisdiction over the hours of operation for the child day care center Furthermore the church shall operate the day care center in accordance with all applicable requirements of the State of California Department of Social Services 6 All requirements of the Orange County Fire Marshal's Office shall be complied with prior to occupancy of the subject church facility 7 Drainage shall be solved to the satisfaction of the City Engineer A grading plan signed by a registered engineer and using actual grades from an Orange County Surveyor's benchmark shall be submitted for approval A topograph of the area surrounding this development shall be made to establish existing drainage flow patterns If the existing natural flow of any adjoining parcel is across the land of this development, a drainage easement shall be granted and drainage facilities provided for that property to the satisfaction of the City Engineer All on-site drainage conveyed to the street shall be by means of an undersidewalk drain, per Orange County Standard All lots shall have a slope gradient of between one percent (1%) and three percent (3%) from rear lot line to the street In parking areas AC shall have a minimum slope gradient of two percent (2%) and concrete shall have a minimum slope gradient of two-tenths percent ( 2%) 8 A six-inch (6') concrete curb per City standards shall be constructed at a minimum distance of three feet (3') from the base of all block walls exposed to vehicular traffic 3 1 1 - 2 - r � 431 9 Wheelchair and handicap access facilities shall be installed on-site and off-site in accordance with State of California and City of Cypress Building Department standards 10 All existing public improvements at the development site which are damaged cracked, or otherwise below standard, shall be removed and replaced to the satisfaction of the City Engineer 11 The quantity, location, width and the type of driveway on Cerritos Avenue shall be subject to the approval of the City Engineer An effective sight distance for vehicular traffic shall be maintained at the intersection of the driveway entrances with Cerritos Avenue No landscaping will be allowed in the area of the curb returns Adequate sight distance also shall be maintained within the development at all driveway intersections to the satisfaction of the City Engineer 12 All secondary and primary utility services shall be underground The street in front of this development shall be resurfaced with one inch (1") minimum thickness concrete cap from curb to curb if it is necessary to open cut the street in more than one place Any open cut shall be backfilled per City of Cypress Standard No 110 13 Street lights shall be installed per City Standards Existing lights shall be replaced with permanent concrete standards Fire hydrants if necessary shall be installed in accordance with Fire Department require- ments and City Standards 14 Trees (15 gallon size) forty feet (40') on center shall be installed in a five foot (5') wide tree planting easement behind the sidewalk adjacent to Cerritos Avenue to be granted to the City of Cypress The type of trees shall be as required under the Townscape and Urban Design Element of the General Plan 15 The concrete gutter adjacent to existing drive approaches shall be removed at the joints and replaced due to advanced deterioration and cracking
