RESOLUTION NO 2226
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING MODIFICATION TO CONDITIONAL USE
PERMIT NO 78-12 - WITH CONDITIONS
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS RESOLVES
DETERMINES, AND ORDERS AS FOLLOWS.
1 That an Application was filed for a conditional use permit in
accordance with the provisions of Section 17 2 of the Zoning Ordinance of
the City of Cypress to allow construction of four condominium units in lieu
of four previously approved apartment units at 5601 and 5611 Nelson Street,
in the RS -6,000 DI Residential Single Family Density Incentive Zone
2 That the City Council after proper notice thereof, duly held a
public hearing on said Application as provided by law
3 That the City Council hereby finds that.
a The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose of the
zone in which the site is located is that
This zone is intended as an area for single-family urban
residential development on minimum lot sizes of 6,000 square
feet and maximum densities of 5 0 dwelling units per acre
Only those additional uses are permitted that are complimentary
to, and can exist in harmony with a residential neighborhood
To provide regulation for the development of those areas in
the City which, due to their unique nature, require special
consideration to. 1) assure maintenance of the low density
residential character of the area and 2) accommodate larger
parcels of land that are either existing or newly combined
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health safety or welfare or be materially injurious to
properties or improvements in the vicinity in that
(1) The construction of condominium owner occupancy type
residential units is compatible with existing zoning and surrounding
land use and meets the objectives of the City's General Plan for
the subject property
(2) All requirements of the City's Subdivision Ordinance
Zoning Ordinance and Uniform Building Codes will be complied with
for the construction of the condominiums which, therefore, did not
require issuance of any zone variances by the City Council
(3) The Cypress Planning Commission conducted previous public
hearings regarding Conditional Use Permit No 78 12 to allow public
input into this project
c The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments
4 The City Council DOES HEREBY GRANT said conditional use permit
subject to the conditions attached hereto as Exhibit 'A'
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 12th day of May 1980

MODIFICATION TO CONDITIONAL USE PERMIT NO 78-12
AND TENTATIVE TRACT MAP NO 10903
1 All applicable fees associated with residential subdivision
which include parks and recreation dedication engineering
plan checking and final subdivision map filing fees, shall
be paid by the applicant prior to recordation of the tract
map
2 The covenants conditions and restrictions (C C f R 's) for
this project shall be reviewed and approved by City Staff
and the City Attorney prior to their recordation All
applicable conditions of approval for Conditional Use Permit
No 78-12 and Modification to Conditional Use Permit No
78 12 are hereby incorporated within the approval of
Tentative Tract Map No 10903
