A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING CONDITIONAL USE PERMIT NO 80 10 -
WITH CONDITIONS
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS RESOLVES
DETERMINES AND ORDERS AS FOLLOWS
1 That an Application was filed for a conditional use permit in
accordance with the provisions of Section 17 2 of the Zoning Ordinance of
the City of Cypress to expand the existing System Reefer Service truck
maintenance and storage facility onto an adjoining parcel of land located
at 4600 Lincoln Avenue
2 That the City Council, after proper notice thereof, duly held a
public hearing on said Application as provided by law
3 That the City Council hereby finds that
a The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose of the
zone in which the site is located is that
This zone is intended to provide appropriately located areas
for establishments catering primarily to highway travelers
visitors to the City or such businesses or uses where direct
access to major arterial highways is essential or desirable
for their operation
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health, safety or welfare or be materially injurious
to properties or improvements in the vicinity in that
(1) The City Planning Commission has previously reviewed truck
maintenance and storage facilities and determined that they are
permissible land uses in accordance with the City's General Plan
and Commercial Heavy Zoning along Lincoln Avenue
(2) A landscape buffer will be provided between the commercial
land use and adjoining residential to mitigate any adverse impact
created by this land use upon adjoining properties
(3) Lincoln Avenue is a State maintained arterial highway which
contains adequate right -of way to accommodate any increase in
commercial truck traffic generated from this use
(4) The Cypress City Council will maintain ongoing jurisdiction
over the hours of operation of this business The Council may limit
the hours at its discretion to insure the peace, privacy and welfare
of adjoining residential properties
c The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments
4 The City Council DOES HEREBY GRANT said conditional use permit
subject to the conditions attached hereto as Exhibit "A"
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 12th day of May 1980

EXHIBIT "A"
CONDITIONAL USE PERMIT NO 80 10
1 All applicable conditions of the original Conditional Use Permit No
C-219 are hereby incorporated within the approval of Conditional Use
Permit No 80 10 Furthermore all conditions of Conditional Use
Permit No 80-10 shall also apply to the parcel of land presently
occupied by System Reefer Service, Inc
2 The applicant shall combine all three parcels to be occupied by System
Reefer Service Inc into a single parcel of land in accordance with
the City of Cypress subdivision requirements prior to utilizing the
adjoining two parcels at 4600 Lincoln Avenue
3 The maintenance of trucks, while decidedly a highway oriented activity
shall not produce detrimental effects upon surrounding properties
Specifically the City Council may review and revoke said conditional
use permit should it be determined that the use is operating in a
manner which is detrimental to the public health safety or welfare
or materially injurious to properties or improvements in the vicinity
4 The hours of operation for the truck storage yard and the maintenance
of commercial trucks shall be subject to the ongoing review and
approval by the City Council Said hours of operation may be limited
at the discretion of the City Council to insure the peace privacy and
welfare of adjoining residential properties
5 A landscape and irrigation plan shall be submitted by the applicant for
review and approval by the Cypress Planning Department and a bond posted
by the applicant to guarantee against any defects in plant materials
and workmanship for a period of one (1) year from the planting date
The landscape and irrigation plan shall specifically incorporate the
planting of 15 gallon size Cypress Leylandii trees eight feet (8')
apart along the southerly property line In addition to the screen
landscaping the applicant shall construct a minimum two foot (2') high
redwood wall extension to the specifications of City Staff along the
common block wall between the subject property and adjoining residences
6 The existing five-foot (5') wide concrete drain gutter along the
southerly property line shall be replaced by an underground storm
drainage facility, i e , storm drain piping
7 A minimum six-foot (6') high block wall measured from the highest
adjacent grade shall be constructed along that portion of the westerly
property line which is visable to Lincoln Avenue A retaining wall
per City standards shall be constructed at the property line where the
grade difference is greater than twelve inches (12") A six inch (6")
concrete curb per City standards shall be constructed at a minimum
distance of three feet (3') from the base of all block walls exposed
to vehicular traffic
8 Applicable wheelchair and handicap access facilities shall be installed
on site and off site in accordance with State of California and City of
Cypress Building Department standards

9 All new secondary and primary utility services shall be underground
The street in front of this development shall be resurfaced with one
inch (1") minimum thickness concrete cap from curb to median if for
any purpose it is necessary to open cut the street in more than one
place Any open cut shall be backfilled per City of Cypress Standard
No 110
10 The two driveways on Lincoln Avenue in front of planting areas shall be
removed and replaced with full height curb, gutter and sidewalk to match
existing The quantity, location, width and type of driveway shall be
subject to the approval of the City Engineer
11 Fees Required for Improvements
Engineering plan checking and inspection fee (per Resolution 1713)
Drainage fee for Master Drainage Plan (per Resolution 1713)
All applicable Building Department fees
12 Lincoln Avenue Requirements
A permit shall be obtained from the State Department of Transportation
prior to the start of any work on Lincoln Avenue
A cash bond shall be posted for future street lights on Lincoln Avenue
(and a 1 1/2 inch diameter PVC pipe, schedule 40 shall be installed)
A cash bond shall be posted for future street trees and tree wells
shall be installed in conformance with the street tree policy of the
Public Works Department
A maximum lot depth of 100 feet shall be allowed to drain onto
Lincoln Avenue If drainage is directed to Lincoln Avenue drainage
culverts shall be constructed underneath sidewalks to convey all
on site runoff water to the street to the satisfaction of the City
Engineer
