Resolution No. 2244RESOLUTION NO 2244 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO 80-12 - WITH CONDITIONS THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES DETERMINES, AND ORDERS AS FOLLOWS. 1 That a dual Application was filed for a conditional use permit in accordance with the provisions of Section 17 2 of the Zoning Ordinance of the City of Cypress to establish an intensive therapy center for brain injured children and a church facility including incidental family services and youth activities, at 9739 Denni Street (former site of the Landell Elementary School) in the PS -1A Public and Semi -Public Zone 2 That the City Council, after proper notice thereof duly held a public hearing on said Application as provided by law 3 That the City Council hereby finds that: a The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is. To permit adequate identification of areas reserved and developed for public uses other than street rights -of way to provide for expansion of their operations or change in use and to identify and preserve areas of historic and community significance for the enjoyment of future generations b The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that. (1) The City Council deems the proposed uses to be public related activities which conform with the property's present zoning and long range objectives of the City's General Plan (2) To conform with the zoning and land use designations on the General Plan, the applicant is required to retain the public utilization of the sports play field during those hours in which the therapy center is not in operation Specifically, the public may utilize the sports fields during those hours other than 8 a m to 4 p m Monday through Friday, or during night hours in which the facility is closed for security purposes (3) The terms of the School Board lease and this conditional use permit are limited to three (3) years, at which time an additional hearing will be conducted to determine whether this activity may continue beyond the three (3) year time limit Public input may be received again at the end of the three (3) year lease term c The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments 4 The City Council DOES HEREBY GRANT said conditional use permit subject to the conditions attached hereto as Exhibit 'A PASSED AND ADOPTED by the City Council of the City of Cypress at a s- regular meeting held on the 27th day of May, 1980 ATTEST. COUNCIL MEMBERS: Lacayo, Mullen, Rowan and Evans None None Coronado CITY C K 0 1' - 2 - OF CYPRESS >•1x c{ t 473 EXHIBIT "A" CONDITIONAL USE PERMIT NO 80-12 1 The intensive therapy center is restricted to outpatient therapy only, which specifically prohibits 24-hour on-site residential patient care 2 The intensive therapy center shall utilize the mobile office trailers on a temporary basis only These trailers shall be removed at the time of occupancy of the classroom building or at the end of nine (9) months from the date of City Council approval of said use permit or whichever occurs first City Staff shall maintain jurisdiction over the ultimate location of the mobile trailers so that they will not be located in a manner detrimental to adjoining property owners All requirements of the Orange County Fire Marshal's Office shall be complied with for building occupancy by both the intensive therapy center and the church use prior to occupancy of any buildings by this applicant Noncompliance with the Orange County Fire Marshal's requirements may constitute grounds for revocation of said conditional use permit 3 The applicant shall provide one striped off-street paved parking space for each three seats within the church assembly rooms, in accordance with the Cypress Zoning Ordinance parking regulations 4 The turf sports field shall remain available for public utilization and not restricted, except during those hours from 8 a m to 4 p m , Monday through Friday, when the therapy program is in session 5 All landscaping and in particular the open play field areas shall be maintained in a neat appearing condition and free of litter, subject to City Staff approval 6. Should any future subleases be proposed on the subject property than those allowed by this use permit City Council review and approval must be obtained prior to their commencement 7 All future building and freestanding signing to identify the Bethany Manor Foundation or Bethany Christian Fellowship shall be subject to City Planning Department review and approval in accordance with the Zoning Ordinance Regulations 8 The applicant shall abide by the Cypress Municipal Code at all times Exterior fund raising events shall only take place in accordance with temporary use and special activity permit regulations All necessary permits and approvals shall be obtained prior to any such activity occurring 9 Concurrent with the lease between the Cypress School District and the applicant this conditional use permit shall remain in effect for a period of three (3) years from the date of City Council approval and may be extended beyond three (3) years by the City Council prior to the original expiration date 10 The applicant must satisfy all conditions of approval before being granted a certificate of occupancy for the church or intensive therapy center
