Resolution No. 2259012 RESOLUTION NO. 2259 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 80-17 - WITH CONDITIONS THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETER- MINES AND ORDERS AS FOLLOWS. 1 That an application was filed for a conditional use permit in accor- dance with the provisions of Section 12 8 of the Zoning Ordinance of the City of Cypress to temporarily establish a church on portions of the former Van Hunnick Dairy located at 9121 Valley View Street 2. That the City Council, after proper notice thereof, duly held a public hearng on said application as provided by law 3 That the City Council hereby finds that: a The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is To provide appropriately located areas for office uses, retail stores service establishments, and wholesale businesses, offering commodities and services required by residents of the City and its surrounding market area b The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that 1. The church intends to occupy the existing building located on the subject property as a temporary use for a period of no more than two (2) years 2 Due to the relatively small congregation of the church (maximum 42 parishioners) the projected volumes of pedestrian traffic generated by this use will have little or no effect on the traffic carrying capacity of the adjacent arterial street 3 The property is situated on a Commercial zone where the surrounding commercial uses are largely oriented to highway -type traffic and the use of the property being undertaken primarily on Sundays will not interfere with the normal business activities of the adjacent commercial uses c The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments 4. Lacayo CITY C E • TH ITY OF CYPRESS 2 014 EXHIBIT "A" CONDITIONAL USE PERMIT NO. 80-17 1 Conditional Use Permit No. 80-17 shall expire two years from the date of City Council approval, which coincides with the Church's lease agreement 2 The parking lot areas shall be rough graded and compacted as needed for property drainage All dirt areas in the parking lot shall be surfaced with a minimum two-inch (2") thick layer of gravel and oiled or other- wise treated to control dust and weed growth 3. Exit signs shall be posted on the meeting hall interior over each door and a maximum occupancy sign shall be posted in the meeting hall which reflects the maximum occupancy load as established by the Orange County Fire Marshal's Office 4 The dairy milking barn shall be secured from unauthorized access for building and safety purposes 5 All necessary permits required for the subject property's conversion to its intended use shall be obtained from the City Building Department prior to modification The applicant shall conform to all applicable provisions of the City's Municipal Code 6 No parallel parking shall be permitted along the driveway access to the rear parking lot A minimum twenty-five foot (25') wide drive must be maintained for fire protection purposes 7 All required landscaping shall be maintained in a neat and orderly condition at all times 8 All future signing to identify "The Church in Cypress" shall be submitted for City Planning Department review and approval in accordance with Zoning Ordinance Regulations 9 The accessory structure shall not be used for overnight living accom- modations 10 The certificate of occupancy will not be issued in accordance with this use permit until all applicable conditions are met l OMR
