RESOLUTION NO 2260
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING CONDITIONAL USE PERMIT NO 80-18 - WITH CONDITIONS
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETER-
MINES AND ORDERS AS FOLLOWS
1 That an application was filed for a conditional use permit in
accordance with the provisions of Section 17 2 of the Zoning
Ordinance of the City of Cypress to bring the existing noncon-
forming Go -Lo Service Station at 9511 Valley View Street into
conformance with the CG Commercial General Zone and allow
expansion of the land use through establishment of an automotive
repair and service business within the main building
2 The City Council after proper notice thereof, duly held a
Public Hearing on said application as provided by law
3 That the City Council hereby finds that:
a The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose
of the zone in which the site is located is that:
The zone is intended as an area for the location of
retail and wholesale commercial activities
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be
detrimental to the public health safety or welfare or be
materially injurious to properties or improvements in the
vicinity in that.
1 Approval of this permit will provide for the limited
expansion of an existing commercial use which expansion
will be compatible with the level of activity that has
occ.;rred on the subject property
2 The existing building on the subject property will be
renovated, thereby, alleviating a future eyesore along
the Valley View Street frontage
3 The adjacent street and highway have more than adequate
capacity to accommodate an increase in vehicular traffic
that may be generated as a result of this project
c The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for
approved variances or adjustments
4 The City Council DOES HEREBY GRANT said Conditional Use Permit
subject to the conditions attached hereto as Exhibit "A"

regular meeting held on the 14th day of July 1980

CONDITIONAL USE PERMIT NO 80-18
1 Automotive repair shall only occur within the main building. The
applicant shall not store inoperative wrecked vehicles or vehicle
parts on the outside of the building at any time Outside storage
is specifically prohibited in the CG Commercial General Zone without
the installation of six-foot (6') high walls to block the view of
stored items
2. The applicant shall stripe perpendicular customer parking spaces, as
designated by City staff, for day -time business usage only Vehicles
may not be left overnight on the property unless placed inside the
service building out of public view.
3 This conditional use permit shall not become effective until all exist-
ing zoning violations are removed, which include removal of painted on
wall signs and freestanding wood signs.
4 A landscaped maintenance bond in an amount determined by City staff
shall be submitted to the City to guarantee the ongoing maintenance
of the landscaped areas for a period of one year. Should the applicant
not maintain the landscape planters in a clean, weed and litter free
condition, this conditional use permit is subject to revocation by the
City Council
5 The applicant shall submit a comprehensive sign plan including details
of all existing signing which shall remain and any new signs proposed
to identify the automotive repair business
6 Applicable building and electrical permits shall be obtained for the
previously installed cashier's booth on the pump island
7 All requirements of the Orange County Fire Marshal's Office
complied with which include the following•
a. Identify the pump master switch with a sign that states
Pump Shut-off."

b Provide a minimum of two fire extinguishers no smaller than 4A4OBC
c. Provide "No Smoking" signs at the direction of the Fire Marshal's
Office
d Both businesses shall comply with the National Fire Code, 1976 Edition
Article 15
8 As indicated by the applicant the automotive repair and service business
shall be limited only to minor repairs Minor repairs do not include
restoration of wrecked inoperative vehicles and major power train
overhauls which necessitate storage of inoperative vehicles outside of
the main building.
9 The Cypress City Council hereby retains the right to review, modify
or revoke said conditional use permit, should it find that either the
Go -Lo Service Station or automotive repair business is operated or
maintained in a manner which is detrimental to the public health,
safety or welfare, or materially injurious to properties or improve-
ments in the vicinity.
10 The applicant shall conform to all applicable provisions of the City
Code.
11 The quantity, location, width, and type of driveway shall be subject
to the approval of the City Engineer

12 Two (2) street trees (15 gal.) shall be installed 41oRg V411@} Vi@w
Street in existing tree wells in conformance to street tree policy of
City staff The type of trees shall be as required under the Townscape
and Urban Design Element of the General Plan.
13. The two (2) damaged pull box covers, located in the sidewalk area
adjacent to and within the curb return area of Orange Avenue and
Valley View Street, shall be removed and replaced.
14. This conditional Use Permit shall remain in effect for a period of
one (1) year from the date of City Council approval and may be extended
beyond one (1) year by the City Council prior to the original expiration
date. The City Council further reserves the right to review, modify
or revoke said conditional use permit should the Council determine
that the businesses are being operated or maintained in a manner
detrimental to the public health, safety or welfare or materially
injurious to properties or improvements in the vicinity
15 The certificate of occupancy will not be issued in accordance with
this use permit until all applicable conditions are met.
