RESOLUTTON NO 2265
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
SETTING FORTH THE LOCAL CONDITIONS AND THE PUBLIC SAFETY
FACTORS UPON WHICH A DETERMINATION HAS BEEN MADE BY THE
CITY COUNCIL THAT CERTAIN MODIFICATIONS TO THE 1979 EDITION
OF THE UNIFORM BUILDING CODES. UNIFORM BUILDING CODE,
UNIFORM MECHANICAL CODE, UNIFORM HOUSING CODE, UNIFORM CODE
FOR THE ABATEMENT OF DANGEROUS BUILDINGS AND UNIFORM
BUILDING CODE STANDARDS ARE REASONABLY REQUIRED BY LOCAL
CONDITIONS AND PUBLIC SAFETY FACTORS WITHIN THE CITY OF
CYPRESS
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY RESOLVE AS FOLLOWS.
WHEREAS Health and Safety Code Section 17958 requires the City of Cypress
to adopt the 1979 edition of the Uniform Building Codes, and
WHEREAS, Health and Safety Code Section 17958.5 provides for the City Council
to make changes or modifications in the 1979 edition of the Uniform Building
Codes as may be reasonably necessary because of local conditions; and
WHEREAS, the City Council also has authority to modify said Codes based
upon public safety considerations, and
WHEREAS the Building Official of the City of Cypress has determined and
recommended that, based upon factors of public safety and local conditions with-
in the City of Cypress, the modifications to the 1979 edition of the Uniform
Building Codes contained in Ordinance No 665 are reasonably required to be
adopted by the City of Cypress; and
WHEREAS, Health and Safety Code Section 17958 7 requires the City Council
to make express findings of the necessity for modifications in the 1979 edition
of the Uniform Building Codes•
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cypress
that the amendments and modifications to the 1979 edition of the Uniform Building
Codes contained in Ordinance No 665 are hereby found to be reasonably necessary
due to considerations of public safety and local conditions as follows
I. UNIFORM BUILDING CODE
Section 205 - Violations and Penalties
This is an Administrative section and has been amended to assess
a fine and length of time for imprisonment to conform to other
Uniform Codes This raises the fine from three hundred dollars
($300.00) to five hundred dollars ($500 00) and length of time from
ninety (90) days to six (6) months This amendment was originally
adopted by Ordinance No 377 dated 6/10/68
Section 301-A - Permits Required
Is amended to include the addition of roof on new residences, and re-
roofing permits to the list of items requiring a permit
Section 305-E - Inspection Required
An appendix to Chapter 32 regarding re -roofing has been added to the
1979 edition of the Uniform Building Code. The City of Cypress is
hereby requesting a final inspection of the re -roof after it has been
completed

Section 306-A - Structural Steel
This section is amended to add the "Structural Steel Framework"
to the list of items requiring a Registered Licensed Inspector
during construction
Section 1704 - Roofs
This section shall be amended to clarify the use of Fire Retardant
Roof for all types of construction
The City of Cypress has (classified) all types of construction,
except R-3, to be constructed in Fire Zone II as defined in 1976
edition of the Uniform Building Code
After making a study of the conditions of the properties classified
as R-3, it has been determined that all "new residences" hereafter
erected or constructed shall have a roof covering that is fire re-
tardant, as specified in Section 3203(e). See Section 104(f) for
repairs, alterations or additions
Section 1711-D - Shower Areas
This section does not mention the width or that "non-absorbent
materials are to be used around a shower or tub enclosure. Said
materials shall be carried at least four inches (4") beyond the
outer edge of the tub to protect the door jamb and material edge from
undue moisture"
Chapter 53 - Energy Conservation
Building insulation and energy conservation was added by the City
Council in March 1974 to conform to the energy crises. In October
1976, an entire Chapter on Energy Conservation was added to the U B C
and will conform to the guidelines set forth by the California Energy
Conservation standards Their (the States) regulations are set forth
in Section T-20 - 1400 through T-20 - 1542 of Title 24 of the Calif-
ornia Administrative Code
II UNIFORM MECHANICAL CODE
Section 511 - Prohibited Location
A new section has been added to regulate the location of the install-
ation of Mechanical Equipment Equipment regulated by this Code
shall not be located in any required front or side yard as established
by the Building Code or Zoning Ordinances
III UNIFORM HOUSING CODE
Section H -201-A & B - Authority
Has been amended to add the Orange County Health Officer as one of
the officials to help administer and enforce all the provisions of
this Code
BE IT FURTHER RESOLVED that a copy of this Resolution, together with
Ordinance No, 665 adopting the 1979 edition of the Uniform Building Codes as
amended, be filed with the State Department of Housing and Community Development
by the City Clerk of the City of Cypress

PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 14th day of July 1980.
