Resolution No. 2274035 RESOLUTION NO 2274 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS SETTING FORTH THE LOCAL CONDITIONS AND THE PUBLIC SAFETY FACTORS UPON WHICH A DETERMINATION HAS BEEN MADE BY THE CITY COUNCIL THAT CERTAIN MODIFICATIONS TO THE 1979 EDITION OF THE UNIFORM PLUMBING CODE, THE UNIFORM SWIMMING POOL CODE AND UNIFORM SOLAR ENERGY CODE ARE REASONABLY REQUIRED BY LOCAL CONDITIONS AND PUBLIC SAFETY FACTORS WITHIN THE CITY OF CYPRESS THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY RESOLVE AS FOLLOWS. WHEREAS, Health and Safety Code Section 17958 requires the City of Cypress to adopt the 1979 edition of the Uniform Plumbing Code, Swimming Pool Code, and Uniform Solar Energy Code• and WHEREAS, Health and Safety Code Section 17958 5 provides for the City Council to make changes or modifications in the 1979 edition of the Uniform Plumbing Code Uniform Swimming Pool Code and Uniform Solar Energy Code as may be reasonably necessary because of local conditions, and WHEREAS the City Council also has authority to modify said code based upon public safety considerations. and WHEREAS, the Building Official of the City of Cypress has determined and recommended that based upon factors of public safety and local conditions within the City of Cypress, the modifications to the 1979 edition of the Uniform Plumbing Code, Uniform Swimming Pool Code and Uniform Solar Energy Code contained in Ordinance No 666 are reasonably required to be adopted by the City of Cypress and WHEREAS, Health and Safety Code Section 17958 7 requires the City Council to make express findings of the necessity for modifications in the 1979 edition of the Uniform Plumbing Code, Uniform Swimming Pool Code and Uniform Solar Energy Code, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cypress that the amendments and modifications to the 1979 edition of the Uniform Plumbing Code, Uniform Swimming Pool Code and Uniform Solar Energy Code contained in Ordinance No 666 are hereby found to be reasonably necessary due to considerations of public safety and the local conditions as follows: UNIFORM PLUMBING CODE Section 20.1 - Administrative Authority Is hereby amended to clarify the term, "Administrative Authority" as the Building Official or his authorized representative Section 20 3 - Violation and Penalties Is hereby amended to add the amount of fine, not to exceed five hundred dollars ($500 00) and time of imprisonment not to exceed six (6) months to conform to the Uniform Building Codes These figures were left out of the 1979 edition Section 20 7 - Reinspection Fees Subsection (a) has been added to the administrative section 20 7 to grant the authority to charge a reinspection fee of ten ($10 00) for each reinspection, over one (1), because of negligence, or because of the failure to the permit holder or his representative to comply with previous correction instructions 040 Section 20 7 - Refund of Fees Sub -paragraph (b) has been added to enable the permittee to obtain a refund of 80% of the permit fees in excess of. five ($5 00), if no portion of the work or construction has been commenced Chapter 2, Section 203 - Use of Copper Tubing Sub -paragraph (f) has been added to prohibit the use of fittings to join various types of piping used under concrete slabs Leaking problems usually begin with connections and is is impractical to have these connections under the slab Chapter 3, Section 316 - Hangers and Supports An additional item has been added to sub -section (c) to protect the tubing or pipe from damage and allow free movement for expansion contraction, due to water surge in the pipes Chapter 9, Section 903 - Overflows and Traps Sub -paragraph (a) has been added to "Rodent Proof under bath tubs and showers when set on a ground floor cement scab Usually a 12 square section is left open for the trap connection This has caused a problem in the past Chapter 10, Section 1009 (i) - Size of Potable Water Piping Has been amended to add a minimum requirement for hose bibbs in both front and rear yards By using 3/4' minimum it will enable the use of adaquate sprinkler system in both front and rear yards SWIMMING POOL CODE - Administrative Section Section 1 7 - Violation and Penalties Add the amount of fine not to exceed five hundred dollars ($500 00) and time of imprisonment not to exceed six (6) months to agree with Uniform Plumbing Code Section 1 10 - Application for Permits Add paragraphs D and E to include a pre -site inspection, and inclusion of the latest State of California s energy regulation Section 1 11 - Cost of Permits Is amended to confrom with the latest resolution of the Uniform Plumbing Code Section 19 10 - Swimming Pool Enclosures The Cypress City Council has adopted an Ordinance id553 dated July 14 1975 whereas certain conditions are set forth regarding the specifications of enclosures around a swim pool Fences must be a minimum of five (5) feet in height and gates must have self-closing and self -latching devices -2- 3 7 1 L 1 )47(f' 3 041 Section 19.13 - Maintenance, Operation and Enforcement Ordinance No 553 also sets forth regulations as to maintenance The sides and bottom of pools decks and other surfaces shall be kept free of slime and algae to prevent slipperiness and danger of accidents, also to eliminate a health hazard Failure to abate the hazard shall be a misdemeanor' UNIFORM SOLAR ENERGY CQDE - Administrative Section Section 1 7 - Violation and Penalties Add the amount of fine and length of time of imprisonment to conform with the Uniform Plumbing Code Section 20 6 - Cost of Permits This section amended to conform to the latest resolution of the City Council relating to the establishment of a revised fee schedule including a reinspection fee Section 20 6 B - Refund of Permit Fees This section to be amended by adding a sub -paragraph which entitled a permittee to a refund of 80% of the permit fee upon presentation of a written request when no work has commenced BE IT FURTHER RESOLVED that a copy of this Resolution together with Ordinance No 666 adopting the Uniform Plumbing Code, the Uniform Swimming Pool Code and the Uniform Solar Energy Code, 1979 edition as amended, be filed with the State Department of Housing and Community Development by the City Clerk of the City of Cypress PASSED AND ADOPTED by the City Council of the City of Cypress, at a regular meeting held on the llth day of August 1980 MAA4fe./ YOR OF THE C OF CYPRESS ATTEST CITY ER OF THE CITY OF CYPRESS STATE OF CALIFORNIA) SS COUNTY OF ORANGE ) I DARRELL ESSEX, City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the llth day of August 1980 by the following roll call vote.
