Resolution No. 2293RESOLUTION NO 2293 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO 80-22 - WITH CONDITIONS THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES DETERMINES, AND ORDERS AS FOLLOWS 1 That an Application was filed for a conditional use permit in accordance with the provisions of Section 17 2 of the Zoning Ordinance of the City of Cypress to establish a convenience market engaging in the off-site sale of beer and wine at 6153-6155 Ball Road, Cypress in the CG -10 000 Commercial General Zone Included in this application is a request to maintain and operate a maximum of four video amusement games (amusement arcade) as an accessory use to the proposed market 2 That the City Council, after proper notice thereof duly held a public hearing on said Application as provided by law 3 That the City Council hereby finds that a The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is This zone is intended as an area for the location of retail and wholesale commercial activities b The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that (1) The adjacent arterial street has more than adequate capacity to accommodate the projected volumes of pedestrian and vehicular traffic to be generated by this use (2) The location of the use and the conditions attached hereto will insure that the use will be compatible with other commercial uses within the shopping center and will not interfere with the privacy of residents in the single family areas located to the north and south of the subject property (3) The use is in conformance with the long range objectives of the City as identified in the Land Use Element of the General Plan c The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments 4 The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions attached hereto as Exhibit "A " PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 22nd day of September, 1980 ATTEST CITY CLERK45'PY OF CYPRESS MAYOR OF THE CITY OF COUNCIL r► t. Coronado CI CLE OF e TY OF CYPRESS - 2 - 1 3 — off- fF 08.1 EXHIBIT "A" CONDITIONAL USE PERMIT NO 80-22 1 The applicant shall satisfy all necessary requirements of the State Department of Alcoholic Beverage Control 2 The Cypress City Council shall maintain ongoing jurisdiction over the business hours of operation as well as the type and number of video amusement games which shall be allowed, with the right to review or limit the hours of operation and the number of video amusement games should this use become detrimental to surrounding businesses or properties 3 The applicant shall meet all requirements of the Orange County Fire Marshal s Office, the Orange County Health Department and the Cypress Building Department All necessary building and electrical permits shall be obtained prior to interior remodeling All signing shall be reviewed and approved by the Community Develop- ment Department prior to installation or issuance of sign permits A maximum of four (4) video amusement games are permitted to be main- tained or operated on the premise at any time All applicable conditions of approval shall be complied with prior to Conditional Use Permit No 80-22 becoming effective 4 5 6 7 1 The City Council may modify or revoke should it determine that the business in a manner detrimental to the public materially injurious to properties or Conditional Use Permit No 80-22 is being operated or maintained health safety or welfare or improvements in the vicinity
