RESOLUTION NO 2505
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING AN AMENDMENT TO CONDITIONAL USE
PERMIT NO 81 16 WITH CONDITIONS
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES
DETERMINES, AND ORDERS AS FOLLOWS
1 That an Application was filed for an Amendment to Condition No 2
of Conditional Use Permit No 81 16 in accordance with the provisions of
Section 17 2 of the Zoning Ordinance of the City of Cypress to allow the
issuance of building permits for the expansion of the ABC Animal Hospital
at 9121 Walker Street Cypress, prior to the recording of a parcel map to
consolidate the three existing lots into one parcel
2 That the City Council, after proper notice thereof duly held a
public hearing on said Application as provided by law
3 That the City Council hereby finds that.
a The proposed location of the conditional use is in accord with
the objectives of the Zoning Ordinance and the purpose of the zone in
which the site is located is that.
This zone is intended as an area for the location of retail
and wholesale commercial activities
b The proposed amendment to the conditional use permit should not
be detrimental to the public health, safety or welfare or materially
injurious to properties or improvements in the vicinity since all
appropriate requirements of both the City's Zoning Ordinance and
Subdivision Ordinance will be satisfied in accordance with State law
c Condition of Approval No 2 for Conditional Use Permit No
81-16 is hereby amended to read as follows.
A parcel map shall be reviewed by the City and recorded with
the County of Orange consolidating the three separate parcels
into a single parcel of land Prior to the issuance of
building permits for any remodeling or addition to the ABC
Animal Hospital, the owner shall submit either security cash
deposit or bond for the cost of recording the parcel map
The security deposit or bond shall be released upon recordation
of the parcel map
4 The City Council DOES HEREBY GRANT the amendment to said conditional
use permit subject to the following requirements
• Prior to issuance of any permits, the City shall receive the first
County check of Final Parcel Map No 82-1103
• The developer shall submit a $2,500 00 cash deposit to cover the
cost of recording the parcel map if the parcel map is not
recorded prior to issuance of a building permit
• In the event the parcel map is not recorded within ninety (90)
days after issuance of a building permit, the City has the
authority to use said cash deposit to defray the cost of
completing and recording the map The cash deposit or remainder
shall be released upon recordation of map
POSTED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 12th day of April 1982
