RESOLUTION NO 2326
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING TENTATIVE PARCEL MAP NO 80-1160 - WITH
CONDITIONS
WHEREAS, an application was made by Cypress Land Company, owner Brian
Harvey, to divide 23 plus acres of land into one buildable parcel,
generally located at the southeast corner of Katella Avenue and Holder
Street.
WHEREAS, the City Council considered evidence presented by the Applicant,
City Staff and other interested parties at a public meeting held with respect
thereto
NOW THEREFORE the City Council of the City of Cypress DOES HEREBY
RESOLVE as follows
1 The proposed map is compatible with the objectives, policies,
general land uses and programs specified in the General Plan of the City of
Cypress in that
(a) The proposed density of development when considering the lot
size proposed conforms with the density and land use designation on
the Land Use Element of the City's General Plan
(b) All required public and/or private roadways conform with the
minimal roadway dimensions as outlined in the City's General Plan
2 The design and improvement of the proposed subdivision as designated
on the tentative parcel map and supplemented by the conditions attached
hereto as Exhibit "A, ' and incorporated herein by reference are compatible
with the objectives policies general land uses and programs specified in
the General Plan of the City of Cypress in that
(a) To insure the peace, tranquility and maintenance of property
values for those residential properties located southerly of this
industrially zoned land, a required landscape berm buffer will be
constructed to separate the adjoining land uses
3 None of the findings set forth in Government Code Section 66474 can
be made
4 The discharge of waste from the proposed subdivision into the existing
community sewer system shall not result in a violation of the existing require-
ments prescribed by the California Regional Water Quality Control Board having
jurisdiction over the proposed subdivision pursuant to the provisions of
Division 7 of the California Water Code (Sections 13000 et seq )
NOW THEREFORE BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Tentative Parcel Map No 80-1160 subject to
the conditions attached hereto as Exhibit "A "
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cypress on the 12th day of January 1981

EXHIBIT "A"
TENTATIVE PARCEL MAP NO 80 1160
1 A minimum eight foot (8') high landscaped earth berm buffer shall be
constructed along the southerly property line of Parcel No 1 of Parcel
Map No 80-1160, in accordance with the uniform design approved by the
Cypress City Council for Parcel Map No 80-1128 A property owners
association shall be created with bylaws and covenants conditions and
restrictions recorded upon all properties owned by Cypress Land Company
east of Holder Street, to provide for the common maintenance of the
landscaped berm The City of Cypress at its discretion may maintain the
berm through formation of a City maintenance district
2 Drainage shall be solved to the satisfaction of the City Engineer A
grading plan, in ink on mylar signed by a registered engineer and using
actual grades from an Orange County surveyor's benchmark shall be
submitted for approval A topograph of the area surrounding this
development shall be made to establish existing drainage flow patterns
If the existing natural flow of any adjoining parcel is across the land
of this development a drainage easement shall be granted and drainage
facilities provided for that property to the satisfaction of the City
Engineer All on-site drainage conveyed to the street shall be by means
of an undersidewalk drain, per Orange County Standard In parking areas
AC shall have a minimum slope gradient of two percent (2%) and concrete
shall have a minimum slope gradient of two-tenths percent ( 2%)
3 A retaining wall per City standards shall be constructed at the property
line where the grade difference is greater than twelve inches (12')
4 Holder Street shall be dedicated and fully improved with curb, gutter,
sidewalk, paving, median islands, etc in accordance with the master
plan of streets and highways and the Cypress Corporate Center Master
Plan Holder Street shall have a total right-of-way width of 84 feet
and improved to join existing improvements south of the Stanton Storm
Channel This condition specifically includes crossing the Stanton
Channel The median islands and parkways on Holder Street shall be
landscaped and maintained by the common property owners' association
(or common maintenance district) Design and right-of-way dedication
for Holder Street from Katella Avenue to existing improvements south of
the Stanton Storm Channel shall be submitted for City Engineering approval
5 Street structural sections will be furnished by the City based on the
recommendation of soils report with street structural sections to be
determined by using an applicable T I (Traffic Index) of 8 0 The
minimum flowline grade in streets shall be 0 20% All existing public
improvements at the development site which are damaged cracked or
otherwise below standard shall be removed and replaced to the satis
faction of the City Engineer
6 The quantity, location, width, and the type of driveway shall be subject
to the approval of the City Engineer An effective sight distance for
vehicular traffic shall be maintained at the intersection of the driveway
entrances with Holder Street, Katella Avenue and Darin Way No landscaping
will be allowed in the area of the curb returns Adequate sight distance
also shall be maintained within the development at all driveway inter
sections to the satisfaction of the City Engineer

7 All secondary and primary utility services shall be underground The
street in front of this development shall be resurfaced with one inch
(1') minimum thickness concrete cap from curb to curb if it is necessary
to open cut the street in more than one place Any open cut shall be
backfilled per City of Cypress Standard No 110
8 Developer and all subcontractors shall provide the City with a Certificate
of Insurance evidencing a comprehensive liability insurance policy(s) with
a combined single limit of not less than $500,000 each occurrence in
connection with the work performed Certificate shall include the City
as additional insured Policy shall include the City, its Council,
officers members of boards or commissions and employees are hereby
declared to be additional Named Insureds with respect to all claims
actions damages liabilities and expenses including attorney's fees,
arising out of or in connection with the work to be performed under the
development executed by the Named Insured and City, including any act
or omission of employees agents, subcontractors, or their employees
Such certificate shall have a thirty (30) day cancellation notice to
the City of Cypress
9 Wheelchair and handicap access facilities shall be installed off-site
in accordance with State of California and City of Cypress Building
Department standards
10 Street lights shall be installed per City Standards Street name signs
and traffic signs shall be installed per City Standards Necessary fire
hydrants shall be installed in accordance with Fire Department require-
ments and City Standards
11 Street trees (15 gal ) forty feet (40') on center shall be installed along
streets in conformance to the street tree policy of the Public Works
Department The type of trees shall be as required under the Townscape
and Urban Design element of the General Plan and Cypress Corporate Center
Master Plan
12 A master plan of sewers shall be submitted for approval by the City
Engineer with plan check and inspection by the City s Engineering
Division subject to plan checking and inspection fees
13 In conjunction with the Corporate Center Master Plan, the City s Traffic
Engineering Division has determined that the following minimal intersection
improvements shall be made by the developer The developer shall submit
the following cash deposits.
a $19 000 to cover one-third
signal at the intersection
b $20,000 to cover one-third
signal at the intersection
the cost of the installation of traffic
of Katella Avenue and Holder Street
the cost of the installation of traffic
of Holder Street and Orangewood Avenue

14 Fees Required for Improvements
a Final subdivision map filing fee
b Engineering plan checking and inspection fee
c Drainage fee for Master Drainage Plan
d Sanitary sewer connection fee
e Advanced street light energy charges shall be paid for a one year
period

g Compaction tests
h Sanitary sewer assessment fee for installation of trunk line sewer
i The developer shall conform to all applicable provisions of the City
Code All requirements of the State Subdivision Map Act and the
City's Subdivision Ordinance shall be satisfied
15 All applicable conditions of approval shall be complied with prior to
Tentative Parcel Map No 80-1160 becoming effective
