Resolution No. 2342RESOLUTION NO 2342 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS ESTABLISHING SUGGESTED GUIDELINES FOR MOBILE HOME PARK RENT REVIEW COMMITTEES WHEREAS, the values of mobile home parks within the City of Cypress and the County of Orange have been increasing rapidly over the past several years; and WHEREAS, these increasing values, in combination with in- creases in the cost of operating mobile home parks and making capital improvements therein, have resulted in increases in the costs of mobile home parks, and WHEREAS, there is a strong market demand for occupancy in mobile home parks, and WHEREAS, rents for spaces within mobile home parks are in- creasing• and WHEREAS, the City Council recognizes the right of mobile home park residents to be charged rents which are based on a consideration of all pertinent economic factors and also recog- nizes the right of mobile home park owners to charge rents which reflect a consideration of all such pertinent economic factors• and WHEREAS, the City Council recognizes that differences of opinion between mobile home park residents and mobile home park tenants concerning the reasonableness of rents can best be re- solved by the parties themselves, and the City Council wishes to establish guidelines for the resolution of such differences; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Cypress, that both residents and owners of mobile home parks are hereby urged to study and to implement the guidelines set forth herein for the establishment of committees within mobile home parks for the purpose of attempting to resolve differences between residents and owners concerning the reason- ableness of rents BE IT FURTHER RESOLVED, that the following suggested guide- lines are hereby offered for the establishment of rent review committees within mobile home parks: 1. If residents and owners in a particular mobile home park have heretofore established methods of peacefully resolving rent problems, then such methods should con- tinue to be used 2 If such problem resolving methods do not yet exist in a particular mobile home park, the residents and owners should consider establishing a committee com- posed of five members for such purpose D31-1,)- 3. 31-1,)- 3. Two of the five members of the committee should be residents of the particular mobile home park who are appointed by the other residents of the park and the other two members should be appointed by the owner of the particular mobile home park The fifth member should be appointed by the unanimous vote of the other four. members The first two appointments (one member by the residents and one member by the park owner) shall be appointed for a period of two (2) years. The second appointment by each group (one member by the residents and one member by the owner) shall be ap- pointed for a period of three (3) years Each subse- quent appointment shall be for a two (2) year period Among the four members selected, there should be per- sons with background and experience which will permit them to analyze and evaluate the mobile home park's rental rates The fifth member may have some finan- cial or accounting background. The suggested term of appointment for said fifth member may be two (2) years A chairman of the committee should be elected by the majority vote of the members of the committee. 4. It is suggested that upon the request of tenants of twenty-five percent (25%) of the spaces within the mobile home park or upon the request of the mobile home park owners, the chairman of the committee con- vene the committee within fifteen days to hear and attempt to resolve the rent problem which the com- mittee has been requested to consider It is further suggested that the committee convene forthwith solely for the purpose of considering the effect of recent rental increases on persons and families of low and moderate income and where the committee determines that such increases have created an intolerable economic hardship, the property owner should propose mitigation measures 5 All hearings of the committee should be open to resi- dents and owners of the mobile home park 6 All parties should be afforded the opportunity to have an attorney or other person of their choice present evidence on their behalf 7 A maximum period of time should be specified for the decision to be rendered by the committee after the close of the committee's meeting, provided that this maximum time period should not exceed thirty days un- less, by majority vote of the committee additional time is established for reaching the decision 8 Nothing contained herein should be construed as dis- couraging the owners and residents of mobilehome parks from agreeing to utilize other methods of resolving rent disputes; to the contrary, the City Council ex- pressly encourages the parties to formulate any such method as may be mutually agreeable to them. 2 PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 9th day of February 1981 MAYOR OF THE CITY OF CYPRESS AI hST: de CITY 0 CITY OF CYPRESS STATE OF CALIFORNIA ) COUNTY OF ORANGE ) SS I, DARRELL ESSEX, City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular mooting of the said City Council held on the 9th day of February 1981; by the following roll call vote.
