RESOLUTION NO 2404
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING CONDITIONAL USE PERMIT NO 81-16 -
WITH CONDITIONS
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS RESOLVES,
DETERMINES AND ORDERS AS FOLLOWS.
1 That an Application was filed for a conditional use permit in
accordance with the provisions of Section 17 2 of the Zoning Ordinance of
the City of Cypress to remodel and expand the ABC Animal Hospital at
9121 Walker Street Cypress
2 That the City Council after proper notice thereof, duly held a
public hearing on said Application as provided by law
3 That the City Council hereby finds that
a The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose of the
zone in which the site is located is that
This zone is intended as an area for the location of
retail and wholesale commercial activities
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health, safety or welfare or be materially injurious to
properties or improvements in the vicinity in that

Both the existing animal hospital and proposed addition
will be evaluated by an acoustical engineer and
insulated to reduce the level of animal noise intruding
into the surrounding neighborhood
(2) Expansion of the hospital and the doctor's residence
will eliminate two existing legal non -conforming
single family residences on neighboring lots to the
animal hospital
The City Council established that a maximum of 26 cages
and 11 dog runs may be maintained overall within the
animal hospital
c The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments

4 The City Council DOES HEREBY GRANT said conditional use permit
subject to the conditions attached hereto as Exhibit "A "
PASSED AND ADOPTED by the City Council of the City of Cypress at an adjourned
regular meeting held on the 29th day of June 1981

CONDITIONAL USE PERMIT NO 81-16 (RESUBMITTAL)

1 An acoustical engineer shall be retained to eval.tat.e the existing animal
hospital building and the proposed expansion to recommend methods of
soundproofing the building to eliminate noise .intrusion upon adjacent
properties A written report from the acoustical engineer shall be sub-
mitted to City staff, and corrections to the building plans .in accordance
with the engineer's recommendations shall occur rrrior to issuance of any
building permits
2 A parcel map shall be reviewed by the City and rucordeu with the County
of Orange consolidating the three separate parc.Is into a single parcel
of land prior to issuance of building permits fur an' remodeling or
addition to the ABC Animal Hospital
3 Prior to issuance of building permits, the two non conforming single
family dwellings shall be removed from the subject property However
should the doctor wish to reside in one of the units during the construction
period the other dwelling unit shall be removed and a cash bond posted to
insure removal of the remaining non -conforming dwelling prior to occupancy
of the building addition to the ABC Animal hospital
4 The final plot plan submitted for building permits shall provide for a
minimum size 9 x 20 foot parking spaceswith a 25 foot turning radius along
the Walker Street parking area This final plan shall also indicate that
the residential garage opening onto the alleyway shall maintain a minimum
setback of 10 feet from the property line
5 Plans for all structural and freestanding identification signing shall he
submitted for review and approval by the Community Development Department
prior to installation of any signing
6 Prior to issuance of building permits, the final building elevations,which
shall include specifications of materials, colors and textures shall be
reviewed and approved by the Community Development Department Drawings
shall be submitted for all building elevations in addition to those pre-
viously shown for the Walker Street frontage
7 The developer shall conform to all applicable provisions of the City Code
All requirements of the State Subdivision Map Act and the City's Subdivision
Ordinance shall be satisfied
8 Drainage shall be solved to the satisfaction of the City Engineer A
grading plan in ink on mylar, signed by a registered engineer and using
actual grades from an Orange County surveyor's benchmark, shall he submitted
for approval All on site drainage conveyed to the street shall be by means
of an undersidewalk drain per Orange County Standard In parking areas,
AC shall have a minimum slope gradient of two percent (2%) and concrete
shall have a minimum slope gradient of two-tenths percent ( 2%)
9 Wheelchair and handicap access facilities shall be .installed on-site and
off-site in accordance with State of California and City of Cypress Building
Department standards

10 On site security lighting shall be arranged so that direct rays will not
shine on adjacent properties or produce glare for street traffic All
roof mounted equipment such as heating and air conditioning units shall
be adequately screened from public view subject to the approval of the
City Staff Commercial or industrial developments which adjoin residentially
zoned areas shall construct noise bafflers and/or deflectors on all mechanical
equipment mounted outdoors to the satisfaction of the (ity staff
All existing public improvements at the development site which are damaged,
cracked or otherwise below standard shall be removed and replaced to the
satisfaction of the City Engineer
12 The quantity, location width and the type of driveway shall be subject to
the approval of the City Engineer An effective sight distance for
vehicular traffic shall be maintained at the intersection of the driveway
entrances with Walker Street and Camp Street No landscaping will be
allowed in the area of the curb returns Adequate sight distance also shall
be maintained within the development at all driveway intersections to the
satisfaction of the City Engineer The north drive on Walker Street shall
be removed and replaced with full height curb gutter and sidewalk
13 All secondary and primary utility services shall be underground The street
in front of this development shall be resurfaced with one inch (1') minimum
thickness concrete cap from curb to curb if it is necessary to open cut
the street in more than one place Any open cut shall be backfilled per
City of Cypress Standard No 110

14 One street light shall be installed per City Standards
15 Sewer laterals connecting existing houses at this property shall be plugged
at the property line, if not used in the new development
16 The developer shall comply with all requirements of the Orange County Fire
Department
17 Developer and all subcontractors shall provide the City with a Certificate
of Insurance evidencing a comprehensive liability insurance policy(s) with
a combined single limit of not less than $500,000 each occurrence in
connection with the work performed Certificate shall include the City as
additional insured Policy shall include the City its Council, officers
members of boards or commissions and employees are hereby declared to be
additional Named Insureds with respect to all claims, actions damages
liabilities and expenses, including attorney s fees arising out of or in
connection with the work to be performed under the development executed by
the Named Insured and City including any act or omission of employees,
agents, subcontractors or their employees Such certificate shall have a
thirty (30) day cancellation notice to the City of Cypress
18 Fees required for improvements
Engineering plan checking and inspection fee
Drainage fee for Master Drainage Plan
Advanced street light energy charges shall be paid (for a one year period)
Grading permit fee
All applicable Building Department fees
19 All applicable conditions of approval shall be complied with prior to
Conditional Use Permit No 81-16becoming effective

20 A maximum of 26 animal cages and 11 dog runs shall be maintained on the
property at any time Additionally, no more than 37 animals shall be
maintained in these cages and/or dog runs at any time
