RESOLUTION NO 2430
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS APPROVING CONDITIONAL USE PERMIT NO 81-25 -
WITH CONDITIONS
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS
1 That an Application was filed for a conditional use permit in
accordance with the provisions of Section 17 2 of the Zoning Ordinance of
the City of Cypress to allow the storage of recreational vehicles and the
installation of an eight foot (8') high chain link fence for security
purposes at 6122 Lincoln Avenue
2 That the City Council after proper notice thereof duly held a
public hearing on said Application as provided by law
3 That the City Council hereby finds that
a The proposed location of the conditional use is in accord
with the objectives of the Zoning Ordinance and the purpose of the
zone in which the site is located is
To provide appropriately located areas for establishments
catering primarily to highway travelers, visitors to the
City or such businesses or uses where direct access to
major arterial highways is essential or desirable for their
operat ion
b The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health safety or welfare or be materially injurious to
properties or improvements in the vicinity in that
(1) The City Planning Commission on October 16, 1973 approved
a previous conditional use permit to allow recreational
vehicle storage at 6122 Lincoln Avenue This application
is identical to that previously approved by the City
(2) The property will be asphalted landscaped and fenced in
accordance with the City's zoning regulations improving
the appearance of the property while providing a
community service by allowing public recreational vehicle
storage
c The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments
4 The City Council DOES HEREBY GRANT said conditional use permit,
subject to the conditions attached hereto as Exhibit 'A '
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 24th day of August, 1981

CONDITIONAL USE PERMIT NO 81 25
1 The developer shall conform to all applicable provisions of the City
Code All requirements of the State Subdivision Map Act and the City's
Subdivision Ordinance shall be satisfied A parcel map shall be
undertaken to consolidate the two existing lots into one lot
2 Drainage shall be solved to the satisfaction of the City Engineer A
grading plan in ink on mylar shall be signed by a registered engineer
and use actual grades from an Orange County Surveyor's Benchmark A
topograph of the area surrounding this development shall be made to
establish existinh drainage flow problems If the existing natural
flow of any adjoining parcel is across the land of this development
a dr•iinage casement shall be granted and drainage facilities provided
for that property to the satisfaction of the City Engineer All on site
drainage shall sheet flow across the south property line In parking
areas A( shall have a minimum slope gradient of two percent (2%) and
concrete shall have a minimum slope gradient of two-tenths percent (0 2-)
3 A retaining wall per City Standards shall be constructed at the property
line where the grade difference is greater than twelve inches (12") The
existent damaged block wall at the southeast corner of this development
shall be repaired
4 A landscape and irrigation plan shall be submitted for approval by the
Conununity Development Department and a bond posted by the applicant
to guarantee against any defects in plant materials and workmanship
A soils report for all planting areas, by a qualified agricultural
laboratory shall be submitted to the Public Works Department for
approval at least thirty (30) days prior to the planting date Test
results shall include concentration of nitrogen phosphorus potassium,
pH salinity sodium status and boron saturation extract
5 Wheelchair and handicap access facilities shall be installed on site and
off site in accordance with State of California and City of Cypress
Building Department standards
6 On site security lighting shall be arranged so that direct rays will not
shine on adjacent properties or produce glare for street traffic
7 All existing trees on the property shall be maintained to the maximum
extent possible No trees shall be removed without the prior approval
from the Community Development Director
8 Lincoln Avenue shall be fully improved with curb, gutter, six foot (6')
wide sidewalk, driveway paving etc in accordance with the Master
Plan of Streets and Highways A street improvement plan shall be
submitted for approval Drive approaches on Lincoln Avenue shall have
a radius of twelve feet (12 )

9 Parking lot structural sections shall be based on the recommendation and Liu,
soils report prepared by an engineering firm acceptable to the City
Engineer, with street structural sections to be determined by using an
applicable T I (Traffic Index) The minimum flowline grade in streets
shall be 0 20% All existing public improvements at the development site
which are damaged, cracked, or otherwise below standard, shall be removed
and replaced to the satisfaction of the City Engineer
10 The quantity location width and the type of driveway shall be subject
to the approval of the City Engineer An effective sight distance for
vehicular traffic shall be maintained at the intersection of the driveway
entrances with Lincoln Avenue No landscaping will be allowed in the irea
of the curb returns Adequate sight distance also shall be maintained
within the development at all driveway intersections to the satisfaction
^f the City Engineer
11 All secondary and primary utility services shall be underground The
street in front of this development shall be resurfaced with one inch
(1 ) minimum thickness asphalt concrete cap from curb to curb if it is
necessary to open cut the street in more than one place Any open cut
shall be backfilled per City of Cypress Standard No 110
12 Two (2) street lights shall be installed per City Standards
13 Developer and all subcontractors shall provide the City with a Certificate
of Insurance evidencing a comprehensive liability insurance policy(s) with
a combined single limit of not less than $500,000 each occurrence in
connection with the work performed Certificate shall include the City as
additional insured Policy shall include the City its Council officers
members of boards or commissions and employees arc hereby declared to be
additional Named Insureds with respect to all claims, actions, damages,
liabilities and expenses, including attorney's fees, arising out of or in
connection with the work to be performed under the development executed
by the Named Insured and City including any act or omission of employees,
agents subcontractors, or their employees Such certificate shall have a
thirty (30) day cancellation notice to the City of Cypress
14 Fees required for improvements are
(a) Final subdivision map filing fcc
(b) Engineering plan checking and inspection fee
(c) Drainage fee for Master Drainage Plan
(d) Advanced street light energy fee
(e) Grading permit fee
(f) All applicable Building Department fees
15 The premises may not be used as a truck yard contractor storage yard,
or any other business not specifically authorized by this conditional use
permit
16. Storage by the applicant of any non-operable or unlicensed vehicle is
prohibited

17 All future signing shall be reviewed and approved by City staff prior to
installation
18 Activities such as servicing of vehicles including repair of parts and
components installation of sanitary facilities, filling of propane and
other gaseous tanks are not permitted under this permit Desire to
engage in these activities will require a subsequent application
19 A certificate of occupancy shall not be issued for this use until all
conditions applicable to this permit are satisfied
