Resolution No. 2448RESOLUTION NO 2448 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING TENTATIVE TRACT NO 10740 - WITH CONDITIONS WHEREAS, an Application was made by Golden West Capital Group, Inc to subdivide a single 2 06 acre parcel of land for the purpose of creating air space office condominiums generally located at 5252 Orange Avenue and WHEREAS, the City Council considered evidence presented by the Applicant, City staff and other interested parties at a public meeting held with respect thereto NOW THEREFORE, The City Council of the City of Cypress, DOES HEREBY RESOLVE as follows. 1 The proposed map is compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that a Land use approval was granted in accordance with a conditional use permit which permitted construction of the subject condominium office building Fee ownership or leasehold ownership of commercial office buildings conform with the basic intent of the Land Use Element of the City's General Plan 2 The design and improvement of the proposed subdivision as designated on the tentative tract map and supplemented by the conditions attached hereto as Exhibits 'A and "B," and incorporated herein by reference are compatible with the objectives policies, general land uses and programs specified in the General Plan of the City of Cypress in that a All required public improvements have been installed in accordance with the City's General Plan 3 None of the findings set forth in Government Code Section 66474 can be made 4 The discharge of waste from the proposed subdivision into the existing community sewer system shall not result in a violation of the exist- ing requirements prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code (Sections 13000 et seq ) NOW, THEREFORE BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Tentative Tract Map No 10740, subject to the conditions attached hereto as Exhibits "A" and "B " PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cypress on the 13th day of October 191 ATTEST CITY CLERK OF� ITY CYPRESS STATE OF CALIFORNIA ) COUNTY OF ORANGE ) SS MAYOR OF THE CITY OF CYPRESS I, DARRELL ESSEX City Clerk of the City of Cypress DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting held by the said PRI City Council on the 13th day of October 1981, by the following roll call vote. None ABSENT. 1 COUNCIL MEMBERS Rowan CITY CLERK FE ITY OF CYPRESS 41g(AC 4L+&- , 14( 365 CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT NO 81 27 EXHIBIT A" 1 The building height shall be limited to a maximum of thirty feet (30') from the pad grade level 2 All requirements of the Orange County Fire Marshal s Office shall be satisfied A fire hydrant will be required along Grindlay Street adjacent to the southerly property line 3 A final site plan and exact building elevations shall be submitted for Community Development Department approval prior to issuance of any build- ing permits 4 A minimum six foot (6') high masonry trash bin enclosure with solid gates shall be provided at a location approved by City staff Said trash enclosure must be located a minimum of twenty feet (20') from any common property line with adjoining single family residences 5 A comprehensive signing program shall be submitted for City staff review and approval This plan shall provide specific details for permanent tenant identification and subdivision sales information Since this project is adjacent to the Civic Center freestanding "For Sale" signs indicating resales will be prohibited on the property at all times A central directory board indicating sales information may be established by the owners' association subject to City staff review and approval These signing regulations shall also be included within the covenants conditions and restrictions for Tract No 10740 6 A landscape and irrigation plan for onsite and offsite (parkway) land scaping shall be reviewed and approved by the Community Development Department prior to the planting of any landscaping Said landscaping and irrigation system including City parkways adjoining the development shall be maintained by the office building property owner(s) 7 A landscape maintenance bond shall be posted to guarantee against defects in plant materials and workmanship for a period of one year A soils report for all planting areas by a qualified agricultural laboratory shall be submitted to the Public Works Department for approval at least thirty (30) days prior to planting date Test results shall include concentration of nitrogen phosphorus, potassium, pH, salinity sodium status, and boron saturation extract 8 The developer shall conform to all applicable provisions of the City Code All requirements of the State Subdivision Map Act and the City s Subdivision Ordinance shall be satisfied 9 Drainage shall be solved to the satisfaction of the City Engineer A grading plan in ink on mylar, signed by a registered engineer and using actual grades from an Orange County surveyor s benchmark, shall be sub- mitted for approval All onsite drainage conveyed to the street shall be by means of an undersidewalk drain In parking areas AC shall have a minimum slope gradient of two percent (2%), and concrete shall have a minimum slope gradient of two tenths percent ( 2%) 2 - 10 A minimum six foot (6') high block wall, measured from the highest adjacent grade shall be constructed and/or maintained along the east and south property line(s) adjacent to residential property Grading plan shall show elevations on both sides of existing block walls on property line and existing top of wall elevations A retaining wall per City standards shall be constructed at the property line where the grade difference is greater than twelve inches (12") A six-inch (6") concrete curb per City standards shall be constructed at a minimum distance of five feet (5') from the base of all block walls exposed to vehicular traffic. 11 The developer of this project shall provide adequate speed control within the development to the satisfaction of the City Engineer 12 Wheelchair and handicap access facilities shall be installed onsite and offsite in accordance with State of California and City of Cypress Building Department standards 13 Onsite security lighting shall be arranged so that direct rays will not shine on adjacent properties or produce glare for street traffic All roof mounted equipment, such as heating and air conditioning units, shall be adequately screened from public view, subject to the approval of the City staff Commercial developments which adjoin residentially zoned areas shall construct noise bafflers and/or deflectors on all mechanical equipment mounted outdoors, to the satisfaction of the City staff 14 Orange Avenue and Grindlay Street shall be fully improved with curbs gutters, six foot (6') sidewalk on Grindlay Street driveways paving etc in accordance with the Master Plan of Streets and Highways Existing underground utilities that conflict with new public improve- ments shall be relocated to the satisfaction of the governing utilities and the City Engineer 15 A corner cutoff shall be dedicated to the City of Cypress for roadway purposes The developer shall not allow landscaping planted within the corner cutoff to exceed two feet (2') in height blocking motor vehicle visibility 16 Parking lot structural sections shall be based on the recommendation and soils report prepared by an engineering firm acceptable to the City Engineer with structural sections to be determined by using an applicable T I (Traffic Index) All existing public improvements at the development site which are damaged cracked or otherwise below standard shall be removed and replaced to the satisfaction of the City Engineer 17 Drive approaches on Orange Avenue and Grindlay Street shall be twenty-five feet (25') wide with radius entrances per City standards 18 All secondary and primary utility services shall be underground No open cuts will be allowed in Orange Avenue or Grindlay Street c44e S6r 3 19 One (1) 22,000 HPS street light on Orange Avenue and two (2) 5 800 HPS street lights on Grindlay Street shall be installed per City standards Traffic signs shall be maintained per City standards 20 Street trees (15 gallon) forty feet (40') on center shall be installed in the parkway on Orange Avenue and in back of the sidewalk on Grindlay Street in conformance to the street tree policy of the Public Works Department The type of trees shall be as required under the Townscape and Urban Design element of the General Plan 21 'No Parking" zones exist and shall be maintained on Orange Avenue and Grindlay Street 22 Fees required for improvements are as follows a Final subdivision map filing fee b Engineering plan checking and inspection fee c Drainage fee for Master Drainage Plan d Sanitary sewer connection e Advanced street light energy charges shall be paid (for a one-year period) f All applicable Building Department fees 23 The developer and all subcontractors shall provide the City with a Certificate of Insurance evidencing a comprehensive liability insurance policy(s) with a combined single limit of not less than $500,000 each occurrence in connection with the work performed Certificate shall include the City as additional insured Policy shall include the City, its Council, officers, members of boards or commissions and employees are hereby declared to be additional Named Insureds with respect to all claims, actions, damages liabilities and expenses, including attorney's fees arising out of or in connection with the work to be performed under the development executed by the Named Insured and City including any act or omission of employees, agents, subcontractors, or their employees Such certificate shall have a thirty (30) day cancellation notice to the City of Cypress 24 All applicable conditions of approval shall be complied with prior to Conditional Use Permit No 81 27 becoming effective 1 36, µ4€ - »- 8 CONDITIONS OF APPROVAL FOR TENTATIVE TRACT NO 10740 EXHIBIT "B" 1 All conditions of approval for Conditional Use Permit No 81-27 are hereby included within the approval of Tentative Tract No 10740 2 The property covenants, conditions and restrictions for Tract No 10740 shall be reviewed and approved by the City Community Development Department, Public Works Engineering and City Attorney prior to recordation of the final tract map or the C C & R's
