Resolution No. 246044.0 RESOLUTION NO 2460 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING PARCEL MAP NO 81-1141 - WITH CONDITIONS X93 WHEREAS, an Application was made by Cypress Land Company owner Brian Harvey, to subdivide a single parcel of industrial property into three parcels of land generally located along the southerly side of Katella Avenue between Valley View Street and Holder Street WHEREAS, the City Council considered evidence presented by the Applicant, City Staff and other interested parties at a public meeting held with respect thereto NOW, THEREFORE the City Council of the City of Cypress, DOES HEREBY RESOLVE as follows 1 The proposed map is compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that (a) The proposed density of development when considering the lot size proposed conforms with the density and land use designation on the Land Use Element of the City's General Plan (b) All required public and/or private roadways conform with the minimal roadway dimensions as outlined in the City's General Plan 2 The design and improvement of the proposed subdivision as designated on the tentative parcel map and supplemented by the conditions attached hereto as Exhibit "A," and incorporated herein by reference, are compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that. (a) To insure the peace, tranquility and maintenance of property values for those residential properties located southerly of this industrially zoned land, a required landscape berm buffer will be constructed to separate the adjoining land uses, 3 None of the findings set forth in Government Code Section 66474 can be made 4. The discharge of waste from the proposed subdivision into the exist- ing community sewer system shall not result in a violation of the existing requirements prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code (Sections 13000 et seq ) NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Parcel Map No 61=1141, subject to the conditions attached hereto as Exhibit "A." PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cypress on the 23rd day of November 1061 ATTEST: /ce'w‘e4 CITY CLE OF ..._ E CITY OF CYPRESS MAYOR OF THE CITY OF CYPRESS STATE OF CALIFORNIA ) COUNTY OF ORANGE ) SS DARRELL ESSEX, City Clerk of the City of Cyp€000, DO HEREBY mit FY thgt the foregoing Regoittion woo duly adopted gt a €aging€ meeting of t gid City Council held on the 23rd dgy of November 19611 by the following roil o ii vote: AYES: 5 COUNCIL MEMBERS: Coronado, Lacgyo, Partin, Rowan, and Mullen NOES: 0 COUNCIL MEMBERS: None ABSENT: 0 COUNCIL MEMBERS: None /2 CITY __ERR •F TR- CITY OF CYPRESS REVISED EXHIBIT 'A" PARCEL MAP NO 81-1141 1 The applicant Cypress Land Company, shall amend the public street plan within Specific Plan No 81-1, specifically detailing revised future street alignments supported by a traffic generation study addressing all necessary roadway improvements at intersections created along Valley View Street and Katella Avenue 2 A condition of approval for Specific Plan No 81-1 required that a development agreement be executed between the City of Cypress and Cypress Land Company specifying that only commercial land uses could be developed upon the westerly 30 acres The development agreement would only be in effect for a limited period of time and contingent upon the property owner's efforts in attempting to market this specified 30 acres for commercial land uses Therefore, the City shall not issue any grading or building permits for future building construction on Parcels 1, 2 or 3 of Parcel Map No 81-1141 until the applicant, Cypress Land Company, has executed the development agreement and complied with the necessary conditions of approval for Specific Plan No 81-1 3 In conjunction with the Specific Plan, the City's Traffic Engineer- ing Division has determined that the following minimal intersection improvements shall be made by the developer The developer shall submit the following deposits• A A letter of credit in the amount of $40,000 to be maintained on file with the City for a period of five (5) years from the acceptance date of Parcel Map No 81-1141 covering one-half the cost of the future traffic signal at Katella Avenue and Hope Street Said letter of credit shall be renewed until such time the developer posts a cash deposit for one-half the cost of the traffic signal B. A $70,000 cash deposit prior to commencement of any development on Parcel No 3 of Parcel Map No 81-1141 to cover the cost of a future traffic signal on Valley View Street between Katella Avenue and the Stanton Storm Channel Development shall consti- tute issuance of a grading permit or building permit 4, The developer shall make a cash deposit equal to the cost of land= scaping and a landscape irrigation system for one=half of the medians en Katella Avenue and all of the medians en Valley View Street adjacent to the property However, the cash deposit for construction within the medians fronting Pareei No, 3 along Valley View Strout and Katella Avenue may be deferred until such time Parcel No 3 is developed, but prior to issuance of any grading or building permits on Parcel No 3 Parcel Map No 81-1141 1 1 5 Katella Avenue shall be dedicated and fully improved with curb gutter, sidewalk and paving in accordance with the Master Plan of Streets and Highways A ten foot (10') right turn lane shall be installed on Katella Avenue from Valley View to two hundred and thirty-seven feet (237') east of future Hope Street 6 A left turn pocket from the southbound Valley View Street onto the future Corporate Center Drive shall be constructed at the developer's expense prior to issuance of any grading permits or building permits on Parcel No 3, Parcel Map No 81-1141 Katella Avenue structural sections shall be based on the recommendation and soils report pre- pared for the City by Orange County Materials Lab The minimum flowline grade in streets shall be 0 20o All existing public improvements at the development site which are damaged cracked, or otherwise below standard, shall be removed and replaced to the satisfaction of the City Engineer 7 All secondary and primary utility services shall be underground The street in front of this development shall be resurfaced with one inch (1") minimum thickness asphalt concrete from curb to curb if it is necessary to open cut the street in more than one place Any open cut shall be backfilled per City of Cypress Standard No 110 8 On Valley View Street eight (8) each 22,000 HPS street lights and on Katella Avenue fourteen (14) each 22 000 HPS street lights shall be installed per City Standards Necessary fire hydrants shall be installed in accordance with Fire Department requirements and City Standards 9 The relocation of the sewer line serving the Panasonic site shall be submitted for approval by the City Engineer with plan check and inspection by the City's Engineering Division, subject to plan check ing and inspection fees Sewer laterals connecting the existing buildings on this property shall be plugged at the property line Septic tanks shall be disconnected per Orange County Sanitation District standards 10 Fees required for improvements A Final subdivision map filing fee B Engineering plan checking and inspection fee C Drainage fee for Master Drainage Plan D Sanitary sewer assessment fee E Advanced street light energy charges shall be paid (for a one-year period) 396 3 11 The developer shall conform to all applicable provisions of the City Code All requirements of the State Subdivision Map Act and the City's Subdivision Ordinance shall be satisfied 12 Developer shall provide the City with a Certificate of Insurance evidencing a comprehensive liability insurance policy(s) with a combined single limit of not less than $500 000 each occurrence in connection with the work performed Certificate shall include the City as additional insured Policy shall include the City, its Council, officers, members of boards or commissions and employees are hereby declared to be additional Named Insureds with respect to all claims actions, damages liabilities and expenses, including attorney's fees, arising out of or in connection with the work to be performed under the development executed by the Named Insured and City, including any act or omission of employees, agents subcontractors, or their employees Such certificate shall have a thirty (30) day cancellation notice to the City of Cypress 13 A minimum eight -foot (8') high landscaped earth berm buffering shall be constructed to the specifications of City Staff along the southerly property line of Parcels 1, 2 and 3 of Parcel Map No 81-1141 A property owners' association shall be created with bylaws and covenants, conditions and restrictions recorded upon Parcels 1, 2 and 3 to provide for the common maintenance of the landscape berm buffer Irrevocable easements shall be granted to the property owners' association allowing the trespass of landscape maintenance crews to maintain the buffer 14 A landscape and irrigation plan for the earth berm buffer shall be submitted for approval by the Community Development Department and a bond posted by the applicant to guarantee against any defects in plant materials and workmanship in the future landscaping of the berm. A soils report for all planting areas by a qualified agricultural laboratory, shall be submitted to the Public Works Department for approval at least thirty (30) days prior to planting date Test results shall include concentration of nitrogen, phosphorus, potassium, pH, salinity, sodium status, and boron saturation extract 15 All applicable conditions of approval shall be complied with prior to Parcel Map No 81-1141 becoming effective
