CRA-98 A RESOLUTION OF THE CYPRESS REDEVELOPMENT AGENCY ADOPTING THE NEGATIVE DECLARATION PREPARED IN CONNECTION WITH THE SECOND AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE LINCOLN AVENUE REDEVELOPMENT PROJECT AREA WHEREAS, a Negative Declaration has been presented to the Cypress Redevelopment Agency ("Agency") in conjunction with the consideration by the City Council of the City of Cypress of the adoption of an ordinance approving and adopting of the Second Amendment to the Redevelopment Plan for the Lincoln Avenue Redevelopment Project ("Second Amendment"); WHEREAS, the Negative Declaration referred to in this resolution consists of that document dated July 18, 2001, entitled" Negative Declaration for the Second Amendment to the Redevelopment Plan for the Lincoln Avenue Redevelopment Project Area" ("Negative Declaration") and a written comments on that document and written responses thereto; and WHEREAS, according to provisions in the California Environmental Quality Act, Public Resources Code Section 21000 et seq., and the California Community Redevelopment Law, Health and Safety Code Section 33000, et seq., the Agency must adopt the Negative Declaration prior to the City Council acting on the proposed ordinance to adopt the Second Amendment; and WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, the Cypress Redevelopment Agency does hereby resolve as follows: l. The Agency hereby certifies that the Negative Declaration, attached hereto as Attachment A, has been prepared on the subject of the Second Amendment in accordance with the provisions of the California Environmental Quality Act, California Public Resources Code Sections 21000, et seq., and in accordance with the regulations promulgated thereunder. Further, the Agency hereby certifies that it has considered the contents of the Negative Declaration in considering the adoption of the Second Amendment. 2. The Agency hereby certifies that the Negative Declaration does not identify physical environmental impacts inherent in the project (Second Amendment). Accordingly, the Agency hereby finds, on the basis of the whole record before it, including the initial study and all comments received, that there is no substantial evidence that the subject project will have a significant effect on the environment. 3. The Agency hereby certifies that the Negative Declaration reflects the independent judgment and analysis of the Agency. 4. The Agency hereby adopts the Negative Declaration. 5. The Agency hereby directs the Agency Secretary that upon final adoption of an ordinance approving the Second Amendment, referenced herein, a Notice of Determination shall be filed with the Clerk of the Board of Supervisors of Orange County in accordance with the California Environmental Quality Act reflecting the findings made in this resolution. 6. The Agency hereby specifies that the custodian of the documents which constitute the record of proceedings, upon which the foregoing decision to adopt the Negative Declaration is based, is the Agency Secretary/City Clerk. INGRAM-GUERTIN, Secretary of the Cypress Redevelopment Agency, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the Cypress Redevelopment Agency held on the 13th day of August, 2001, by the following roll call vote: AYES: 5 NOES: 0 ABSENT: 0 AGENCY MEMBERS: Keenan, McCoy, Piercy, Sondhi, and McGill AGENCY MEMBERS: None AGENCY MEMBERS: None AGENCY ~R~TARY -- -- -2- ATTACHMENT A Negative Declaration Prepared in Connection With the Second Amendment to the Redevelopment Plan for the Lincoln Avenue Redevelopment Project Area -3- CITY OF CYPRESS 5275 Orange Avenue Cypress, California 90630 NEGATIVE DECLARATION In accordance with the requirements of Resolution No. 4363 of the City of Cypress regarding the adoption of objectives, criteria and procedures implementing the California Environmental Quality Act as amended, the Planning Manager of the City of Cypress, acting as the Responsible Official, has prepared the following Negative Declaration: Nature and Description of Project Second Amendment to the Redevelopment Plan for the Lincoln Avenue Redevelopment Project Area A request to amend the Lincoln Avenue Redevelopment Project Area Plan to: (i) extend the Redevelopment Agency's authority to use eminent domain for a period of twelve (12) years from the date the ordinance approving the amendment becomes effective: (ii) conform the permitted land uses in the Project Area to the permitted uses set forth in the City's General Plan (as it now exists or hereafter may be amended); and (iii) delete outdated and unnecessary text and attachments. 2. Findings This project will n~t have a significant effect on the environment because: This project is admini~'ative in nature only and, therefore, should not create a substantially adverse physical change within the affected area, illcludilig land, air, water, minerals, flora, fauna, ambient noise, and objects of historic or aesthetic significance. The project is consistent with fire g6als'~md policies of the Redevelopment Plan for the Lincoln Avenue Redevelopment Project Area. C.
