CRA - 96RESOLUTION NO. CRA-96 A RESOLUTION OF THE CYPRESS REDEVELOPMENT AGENCY CONSENTING TO AND CALLING FOR A JOINT PUBLIC HEARING ON THE SECOND AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE LiNCOLN AVENUE REDEVELOPMENT PROJECT AREA AND RELATED NEGATIVE DECLARATION WHEREAS, pursuant to the provisions of the California Community Redevelopment Law, Health and Safety Code Section 33000, et seq., ("CRL"), the staff and consultants of the Cypress Redevelopment Agency ("Redevelopment Agency") have proposed the Second Amendment to the Redevelopment Plan for the Lincoln Avenue Redevelopment Project Area ("Second Amendment"); and WHEREAS, the Redevelopment Agency staff and consultants have determined that the use of eminent domain is necessary to implement future redevelopment plan projects and programs and have identified a need to extend the eminent domain authority within the Lincoln Avenue Redevelopment Project Area for a twelve-year period, as allowed by the CRL; and WHEREAS, the text in the Redevelopment Plan for the Lincoln Avenue Redevelopment Project describing permitted land uses is outdated and must be amended to conform to the City's General Plan; and WHEREAS, the Redevelopment Agency has prepared a Draft Amended and Restated Redevelopment Plan in connection with the Second Amendment, pursuant to the requirements of the CRL, which extends the eminent domain provision for a twelve-year period and provides that the land uses within the Lincoln Avenue Redevelopment Project Area shall conform to the land uses permitted by the City's General Plan, as it exists today or is hereafter amended; and WHEREAS, the Redevelopment Agency has undertaken the required steps for the consideration of the adoption of the Second Amendment. NOW, THEREFORE, the Cypress Redevelopment Agency does hereby resolve as follows: 1. The Cypress Redevelopment Agency consents to and calls for a joint public hearing of the Redevelopment Agency and the City Council to be held in the City Council Chambers, located at Cypress City Hall, 5275 Orange Avenue, Cypress, California, to consider and act upon the proposed Second Amendment, related Negative Declaration, and all documents and evidence pertaining thereto. The time and date of such joint public hearing shall be August 13, 2001, at 7:00 p.m. or as soon thereafter as the matter may be heard. 2. The Cypress Redevelopment Agency requests that the City Council of the City of Cypress consent to and call for a joint public heating of the Redevelopment Agency and the City Council to consider and act upon the proposed Second Amendment to the Redevelopment Plan for Lincoln Avenue Redevelopment Project and related Negative Declaration. 3. The Agency Secretary, in cooperation with the Executive Director, shall prepare, publish and mail such notices and documents and do all other acts as may be necessary to carry out the purposes of this Resolution.
