RESOLUTION N0. 3898
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS REVOKING
USE PERMIT CERTIFICATE N0. 3373 AND USE PERMIT CERTIFICATE NO 3048
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS.
1 That the City of Cypress reconsidered existing Use Permit Certificate
No 3373 for a noncommercial kennel and Use Permit Certificate No 3048 for a
commercial kennel at Kipperdale Kennels, located at 8331 Denni Street and 8321
Denni Street, respectively Both properties are located in the RS-6,000/FA
Residential Single-Family/Farm Animal Overlay Zone
2 That the City Council after proper notice thereof duly held a public
hearing on said existing Use Permit Certificates as provided by law
3 That the City Council hereby finds that.
a. The City Council has declared the property at Kipperdale Kennels a
public nuisance as evidenced by Resolution No 3897 In so holding, the City
Council found the following
(1) Improper storage of trash on the property as well as the
presence of fecal material
(2) Storage of junk and debris onsite including inoperative
vehicles appliances and furniture
(3) Inadequate sewerage system and stagnant water
(4) Lack of adequate care for the animals kept onsite
(5) Lack of the required licenses to operate a kennel
(6) The presence of fleas flies and rodents and
(7) The keeping of ferrets which is illegal in the State of
California
The City Council hereby adopts these findings
b The operation of Kipperdale Kennels has been in violation of the
conditions of approval established for the subject Use Permit Certificates in
that the kennels have exceeded the maximum number of fifty (50) dogs,
representing a combined maximum of twenty-five (25) dogs for the noncommercial
kennel and the commercial kennel
c The operation of Kipperdale Kennels has been in violation of the
conditions of approval of the existing Use Permit Certificates in that the
kennels were established for show dogs only while the kennels have been used
to keep and board non -show dogs including rescued abandoned and stray dogs
4 Based on the foregoing findings of fact the City Council finds and
determines the public interests convenience and necessity determine that Use
Permit Certificate No 3373 and Use Permit Certificate No 3048 be revoked
NOW THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby revoke Use Permit Certificate No 3373 and Use Permit
Certificate No 3048
