RESOLUTION NO 3899
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CYPRESS FINDING AND DETERMINING
THAT THE USE AS 'FARM ANIMAL PROPERTY" OF
THAT CERTAIN REAL PROPERTY LOCATED AT
8162 GAY STREET IN THE CITY OF CYPRESS IS
A LEGAL NONCONFORMING USE FOR PURPOSES OF
THE CITY OF CYPRESS' ZONING ORDINANCE
WHEREAS, the City of Cypress annexed territory to
the City of Cypress in 1988 which included that certain real
property located at 8162 Gay Street in the City of Cypress
(the "Subject Property') and,
WHEREAS, at the time of the annexation to the City
of Cypress, the Subject Property was being utilized for the
maintenance of horses and was a legal use of property as
specified in the Codified Ordinances of the County of
Orange and,
WHEREAS, upon annexation of this territory to the
City of Cypress, the Subject Property became subject to the
laws and Ordinances of the City of Cypress, including the
Cypress Zoning Ordinance, and more particularly, Section
12 5A of Appendix I, "Zoning," of the Code of the City of
Cypress which requires a 50 foot setback from anywhere where
a residential structure could be located, and
WHEREAS, the application of Section 12 5A of this
Code to the use of the Subject Property would pose hardship
to the property owner and be inconsistent with the property
owner's use of the Subject Property as a legal nonconforming
use
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF
CYPRESS DOES HEREBY FIND, RESOLVE DETERMINE, AND ORDER AS
FOLLOWS
SECTION 1 That the use of the Subject Property
as "farm animal property" is a legal nonconforming use and
not currently subject to the provisions of Section 12 9-5A
of Appendix I 'Zoning,° of the Code of the City of Cypress
SECTION 2 That the use of the Subject Property as a
legal nonconforming use may continue subject to the
following conditions
A. That the use and maintenance of the
Subject Property does not constitute a
public or private nuisance.
B. That the Subject Property is maintained
in such a fashion that it complies with
all applicable zoning requirements when
the use of the Subject Property became a
legal nonconforming use.
C. That the property owner maintains
continuous use of the Subject Property as
"farm animal property° without inter-
ruption for more than one -hundred -twenty
(120) days

of Cypress at a regular meeting held on the 25th day
of February , 1991.
