Resolution No. 3906.1. RESOLUTION NO. 3906 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS DENYING VARIANCE NO. 90-23 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES AND ORDERS AS FOLLOWS. 1 That an application was filed for a variance in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to allow only six (6) onsite parking spaces, instead of the minimum required twenty (20) spaces for the property located at 8522 Walker Street. 2. That the City Council after proper notice thereof duly held a public hearing on said application as provided by law. 3 That the City Council hereby denies said variance because it is unable to make the following findings required by Section 17.2-7 of Appendix I "Zoning of the Code of the City of Cypress because* a. The proposed location of the conditional use and the conditions under which it would be operated or maintained will be detrimental to the public health safety or welfare or be materially injurious to properties or improvements in the vicinity in that. (1) The proposed parking variance from a minimum required twenty (20) parking spaces to six (6) parking spaces would represent a 70% decrease in the minimum required parking for a church use This amount of reduction in the required onsite parking could result in the parking or loading of vehicles on public streets impacting nearby residential neighborhoods and the free flow of traffic (2) Adequate parking for the church use could not be provided through a joint use parking agreement with adjacent property owners since the Zoning Ordinance does not permit such agreements within residential zones. (3) Without adequate onsite parking area unsafe conditions may result from those attending church services who park onsite by blocking other parked cars or the driveway Also the proposed parking plan does not provide for adequate turn around area which could cause drivers to back out onto Walker Street. 4 Based on the foregoing finding of fact the City Council finds and determines the public interests convenience and necessity determine that this application be denied NOW, THEREFORE BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby deny Variance No. 90-23 PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the lith day of March ]99 ATTEST 10%/1`P HE CITX CITY CLERK THE CIT OF CYPRESS STATE OF CALIFORNIA ) COUNTY OF ORANGE ) SS MAYOR OF THE CITY OF CYPRESS I DARRELL ESSEX, City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the 11th day of March 1991 by the following roll call vote AYES. 5 COUNCIL MEMBERS Age, Kerry, Nicholson, Partin and Bowman NOES. 0 COUNCIL MEMBERS.
