Resolution No. 39071.S RESOLUTION NO 3907 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING RELOCATION PERMIT NO 91-1 - WITH CONDITIONS THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS. 1 That an application was filed for a relocation permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to relocate a single-family house across private property from 4561 Katella Avenue to 5100 Cerritos Avenue in the PS Public and Semi -Public Zone. 2 That the City Council after proper notice thereof duly held a public hearing on said application as provided by law. 3 That the City Council hereby finds that. a The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is Intended to permit adequate identification of areas reserved and developed for public uses other than street rights-of-way to provide for expansion of their operations or change in use and to identify and preserve areas of historic and community significance for the enjoyment of future generations b The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that. (1) The building is in conformity with the architectural style and the quality of existing buildings within the area in which it is proposed to be moved. (2) The proposed building shall not be less in value when moved and remodeled than the fair market value of the highest one-third of the buildings within the immediate area The immediate area shall be determined by the planning commission (interpreted to be planning agency) but in no instance shall be less than five hundred feet (500 ) from the exterior boundary of the proposed site on which a building is to be moved (3) The proposed relocation will in no way be detrimental to surrounding property or to the living environment of the area (4) The proposed location will comply with lot area required yard setbacks and all other provisions of the Zoning Ordinance of the City including fire zones c The proposed relocation permit will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments NOW THEREFORE BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Relocation Permit No 91 1 subject to the conditions attached hereto as Exhibit 'A. None CITY CLERK 1E CITY OF CYPRESS 2 1.19 15 EXHIBIT 'A' RELOCATION PERMIT NO. 91-1 CONDITIONS OF APPROVAL 1 The approval of Relocation Permit No. 91-1 is subject to approval of Parcel Map No. 90-245 2 The applicant shall comply with all applicable conditions of Tentative Parcel Map No. 90-245 3. The applicant shall comply with all applicable mitigation measures contained in the Cypress Business and Professional Center Final Subsequent Environmental Impact Report. 4 The developer shall pay the City of Los Alamitos a Traffic Mitigation Contribution fee of one (1) dollar for each square foot of new building construction in accordance with Paragraph 7 b of the Cypress Business and Professional Center Traffic Mitigation Agreement. 5 The applicant shall bring the relocated building up to the standards of the Uniform Building Code for a new building and shall be painted prior to occupancy The building shall be refurnished and maintained at that standard. 6 The applicant shall comply with all applicable provisions of the City Code and Uniform Building Code for move -on buildings 7 The applicant shall comply with all provisions of the Orange County Fire Marshal 8. The applicant shall meet all of the development standards of the City of Cypress Zoning Ordinance 9 The applicant shall obtain a conditional use permit for the proposed use of the relocated house prior to release of utilities Said use shall be consistent with the provisions of the Cypress Business and Professional Center Specific Plan and the City of Cypress Zoning Ordinance 10 In accordance with Condition 11 of Tentative Parcel Map No 90-245 Relocation Permit No 91-1 shall be subject to approval of an amendment to the Cypress Business and Profes- sional Center Development Agreement No. 90-1 Said amend- ment shall include a provision that in the event of a change of use or sale of the race track property a reconfiguration of Parcel 2, acceptable to the City shall be required. Said amendment shall be approved within ninety (90) days of approval of a conditional use permit for the proposed use of the relocated house Exhibit A Relocation Permit No. 91-1 Conditions of Approval Pagel b 11 The permit shall be for the purpose of relocating the Vessels house only 12 No concrete shall be poured without the issuance of a foundation permit. 13 A certificate of grades and compaction for the pads rough grading certificate etc shall be submitted to the Building Department as part of the issuance of a future precise grading permit for this site 14 Applicant/developer shall comply with applicable provisions of the 1988 Uniform Building, Plumbing and Mechanical Codes, 1987 National Electrical Code, California Administrative Code Title 24 and the Cypress City Code 15 An automatic fire sprinkler system, approved by the Fire Marshal shall be installed. 16 Applicant/developer shall comply with all disclosure requirements of the Orange County Fire Department for hazardous materials use and/or storage and the South Coast Air Quality Management District for exhaustion of air contaminants 17 Type 5 cement shall be used for all foundations and slabs on grade 18. All slabs on grade (including M-1 occupancies) shall receive a minimum of a 10 mil moisture barrier 19 A soil investigation report shall be submitted with the plans for plan check Report shall include soil bearing capacity seismic study grading, paving, sulfate test and other pertinent information under good engineering practice 20. Within forty-eight (48) hours of the approval of the project, the applicant/developer shall deliver to the Planning Department a check payable to the County Clerk in the amount of One -Thousand -Two -Hundred -Seventy -Five Dollars ($1 275 00) which includes the One -Thousand -Two -Hundred - Fifty Dollars ($1 250 00) fee required by Fish and Game Code Section 711 4(d)(2) plus the Twenty -Five Dollar ($25 00) County administrative fee to enable the City to file the Notice of Determination required under Public Resources Code Section 21152 and 14 Cal Code of Regulations 15075 If within such forty-eight (48) hour period the applicant/developer has not delivered to the Planning Department the check required above, the approval for the project granted herein shall be void.
