Resolution No. 3990RESOLUTION NO. 3990 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AMENDMENT TO CONDITIONAL USE PERMIT NO. 82 18 WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS. 1. That an application was filed to amend a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to expand the hours of operation at an existing recreational vehicle storage facility. The subject property is located at 4656 Lincoln Avenue in the CH/LC Commercial Heavy/Lincoln Avenue Combining Zone. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the amended conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Intended to provide appropriately located areas for establishments catering primarily to highway travelers, visitors to the City or such businesses or uses where direct access to major arterial highways is essential or desirable for their operation. Additionally, the Lincoln Avenue Combining Zone is intended to promote a revitalization of the commercial areas on Lincoln Avenue, and thereby enhance the economic base of the City to improve the image of the City by providing an aesthetically pleasing environment along Lincoln Avenue; and to expand opportunities for the development of identified deep Tots by providing a means for the establishment of a variety of urban uses in conjunction with commercial projects. b. The proposed location of the amended conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The expanded hours of operation are consistent with the Cypress Zoning Ordinance in that the hours pertaining to recreational vehicle storage use are permitted subject to a conditional use permit in the CH/LC Commercial Heavy/Lincoln Avenue Combining Zone. (2) The Amendment to Conditional Use Permit No. 82-18 shall expire within six (6) months from the date of approval, unless prior to the date of expiration a public hearing is held before the City Council extending this amendment. (3) The extended hours shall revert to the originally approved hours of operation when Daylight Savings Time is no longer in effect. c. The proposed amended conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. NOW THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Amendment to Conditional Use Permit No. 82-18 subject to the conditions attached hereto as Exhibit A. None ii !`LR Cf PE CITY CLE K OF CITY OF CYPRESS 2 EXHIBIT 'A' AMENDMENT TO CONDITIONAL USE PERMIT NO. 82-18 CONDITIONS OF APPROVAL The property owner shall comply with all applicable conditions of Conditional Use Permit No. 82-18, with exception to Condition No. 9 which is amended to read as follows: '9 The City Council shall maintain ongoing jurisdiction over the hours of public access to the storage yard. The Council may, at its discretion limit the hours of public access to those deemed necessary to eliminate any potential impacts upon adjoining homes. The hours of public access to the storage yard, which represent the business hours of operation, shall be limited from 8:00 a.m. to 7:00 p.m. daily during daylight savings time only, unless amended by the City Council. These extended hours shall revert to the originally approved hours of operation (9:00 a.m. to 5:00 p.m.) when daylight savings time is no longer in effect. Stored vehicles may only be operated, removed, or returned to the storage yard during these business hours of operation. A designated valet parking area adjacent to the Lincoln Avenue entrance may be used for the pickup and delivery of vehicles after business hours of operation. However, valet shuttle to the storage yard shall only occur during business hours. The owner/operator of the recreational vehicle storage yard shall post signs at the entrance which read "Think Quiet' and require all radios to be turned down or off when entering the facility. The manager or security guard on duty shall require all patrons to vacate the storage yard promptly at 7:00 p.m. 3. The Amendment to Conditional Use Permit No. 82 18 shall expire within six (6) months from the date of approval, unless prior to the date of expiration a public hearing is held before the City Council extending this amendment.
