Resolution No. 4025RESOLUTION NO. 4025 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AMENDMENT TO CONDITIONAL USE PERMIT NO. 89-27 WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS. 1. That an application was filed to amend a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress for the addition of a 3,400 square foot basement and a temporary cargo storage container to the approved construction of the Korean Community Church located at 5900 Ball Road. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law 3. That the City Council hereby finds that: a. The proposed location of the amended conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Intended as an area for the location of retail and wholesale commercial activities. b. The proposed location of the amended conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The proposed location of the conditional use complies with the objectives of this ordinance and the purpose of the Commercial General Zone in that this project will comply with the development standards of the CG Commercial General Zone. (2) The proposed amendment to the previously approved conditional use will comply with each of the applicable provisions of this ordinance, in that the proposed addition does not adversely affect the surrounding area. c. The proposed amended conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. NOW THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Amendment to Conditional Use Permit No. 89-27 subject to the conditions attached hereto as Exhibit A. None ,,( ij-S4/: CX/ CITY 6LERK 0 THE CI'T'Y OF CYPRESS EXHIBIT 'A" AMENDMENT TO CONDITIONAL USE PERMIT NO. 89-27 CONDITIONS OF APPROVAL 1. Upon occupancy of the new church, the basement shall be used for the storage of incidental items of the church only. 2. The use of the basement for any purpose other than storage will violate this amended Conditional Use Permit No. 89-27 3. No outdoor storage or accessory storage structures of any type shall be permitted, except as permitted as part of this conditional use permit. 4. The temporary cargo storage container shall be located as illustrated on the approved site plan and shall be removed no later than thirty (30) days upon approval of occupancy of the new church A bond shall be submitted to the City of Cypress Planning Department reflecting the current cost to remove this cargo container. Upon visual verification of the removal of the cargo container by the Planning Department, said bond shall be recommended for release to the Planning Director. Failure to remove said container shall forfeit the bond. The bond shall be submitted prior to the release of Building Construction Permits. 5. The finished grade shall not deviate more than one foot (1') from the existing natural grade and not in anyway adversely affect the adjacent properties. If, upon commencement of the project, it is discovered that a change in the grade of more than one foot (1') is necessary, the applicant must return to Council for the approval of the proposed grade change with an amendment to the Conditional Use Permit No. 89-27 This will be required regardless of whether the height of the building is altered. 6. Applicant shall comply with the regulations of the 1990 Uniform Building Code. 7 This project shall meet all requirements of the County of Orange Fire Department regulating the occupancy of this facility.
