Resolution No. 668100 ] RESOLUTION NO. 6681 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY NOVEMBER 6, 2018, FOR THE SUBMISSION OF A PROPOSED ORDINANCE TO THE VOTERS WHEREAS, pursuant to Resolution No. 6675 the City Council of the City of Cypress called and gave notice of the holding of a General Municipal Election, to be held on November 6, 2018, for the purpose of electing Municipal Officers, and WHEREAS, by this Resolution, the City Council hereby calls for and gives notice of the holding of a General Municipal Election, to be held on November 6, 2018, for the purpose of submitting a proposed ordinance (Ordinance No. 1173) to the voters of the City of Cypress for their consideration (the 'General Municipal Election"), and WHEREAS, the Cypress School District ("District") maintenance facility is currently located on the approximately 3.86 acre portion of land located at 5081 Orange Avenue, in the City of Cypress, California (the 'District Maintenance Site'); and WHEREAS, the District Maintenance Site is currently zoned 'PS -1A or 'Public/Semi Public, a zoning designation adopted in 1987 pursuant to a voter initiative entitled the 'Cypress Greenbelt Preservation and Open Spaces Initiative, commonly referred to as 'Measure D' and WHEREAS, Measure D prohibits the rezoning of any real property designated as 'Public/Semi-Public without voter approval, as follows: '[n]o amendment of the PS (Public and Semi -Public) Zone of the Zoning Map and/or the Zoning Code of the City of Cypress which will allow or permit any land use other than those permitted in the PS Zone at the time of enactment of this ordinance of July 31 1987 shall be valid or effective for any purpose whatsoever unless and until such amendment shall have been approved by a majority of those voters of the city voting thereon at any regular or special municipal election' and WHEREAS, Measure D further requires that the City Council of the City of Cypress 'refer any amendment approved by it [meaning the City Council] to [the] voters pursuant to the provisions of Section 4017 of the Election[s] Code of the State of California' and NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1 The foregoing recitals are true, correct, and adopted by the City Council as if set forth in full. SECTION 2. If approved by voters, the proposed ordinance, as stated below adopts a re -zoning of the District Maintenance Site from PS -1A Public/Semi-Public to PC Planning Community (PC -14). The environmental analysis found that the measure, with applicable mitigation measures, will not result in a significant impact on the environment. In accordance with the California Environmental Quality Act (CEQA) Guidelines, a Mitigated Negative Declaration has been prepared and adopted for the proposed ordinance It has been determined that with mitigation, no significant impact to the environment would occur from the proposed ordinance. SECTION 3 Pursuant to the requirements of the City Charter of the City of Cypress, the City Council of the City of Cypress hereby calls for a General Municipal Election to be held in the City of Cypress, California, on Tuesday November 6, 2018, for the purpose of submitting the following proposed ordinance to the voters of the City of Cypress, to wit 002 Shall the measure, approving Ordinance No. 1173 Yes which approves a zone change for the Cypress School District Maintenance Site, consisting of approximately 3.86 acres located at 5081 Orange Avenue, from 'PS -1A Public/Semi-Public' to 'PC Planning Community (PC -14), thereby allowing for the construction of residential units, be adopted'' No SECTION 4 The text of the proposed ordinance to be submitted to the voters is attached as Exhibit A to this Resolution SECTION 5. The vote requirement for the measure to pass is a majority (50%+1) of the votes cast. SECTION 6. The ballots to be used at the General Municipal Election shall be in form and content as required by law. SECTION 7 The City Clerk, acting as the city elections official, is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the General Municipal Election. SECTION 8. Pursuant to California Election Code § 10242, the polls for the General Municipal Election shall open at seven o'clock a m. on the day of the election, and shall remain open continuously from that time until eight o'clock p.m. of the same day when the polls shall be closed, except as otherwise provided in California Election Code § 14401 SECTION 9 In all particulars not recited in this Resolution, the General Municipal Election shall be held and conducted in accordance with the provisions of law regulating municipal and statewide elections. SECTION 10. Notice of the time and place of holding the General Municipal Election is hereby given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in the time, form and manner required by law. SECTION 11 The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
