ORDINANCE NO 87
AN ORDINANCE OF THE CITY OF CYPRESS REGULATING AND REQUIRING THE ENCLOSURE
OF SWIMMING POOLS
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS.
SECTION 1 ENCLOSURE OF SWIMMING POOLS No person shall maintain
a swimming pool in the City unless he shall at all times maintain on the lot
or premises upon which such pool is situated an enclosure as herein pro-
vided Such enclosure shall consist of a wall fence or other substantial
structure not less than five feet in height and with no opening therein
(other than doors or gates) larger than three inches in a perpendicular
plane with at least five feet between any horizontal members The en-
closure shall completely surround the pool or the lot or premises upon
which the pool is located All gates or doors opening through such en-
closure shall be equipped with a self-closing and self -latching device
designed to keep, and capable of keeping such gate or door securely closed
at all times when not in actual use; provided, however, that the door of
any dwelling house forming any part of the enclosure need not be so equipped
SECTION 2: SAME. The gates and doors of any such enclosure need not
be kept locked or latched or closed during such time as the owner, operator
or any adult person is in active charge of the swimming pool.
SECTION 3: SAME: Swimming pools in existence on the 20th day of
March 1961 shall be exempted from the requirements hereof until September
1, 1961 Thereafter, it shall be unlawful for any person to maintain any
swimming pool which is not enclosed as required by this ordinance
SECTION 4• EFFECTIVE DATE OF ADOPTION: Pursuant to the provisions
of sub -section b of Section 36937 of the Government Code of the State of
California this Ordinance is for the immediate preservation of the public
health and safety and shall take effect immediately
The facts constituting the urgency are as follows.
1 At the present time there are no regulations within the City
to require the protection of children attracted by swimming pools
The construction of swimming pools within the City is greatly in-
creasing by reason of the approach of warm weather If the ordinance
does not take effect immediately, a large number of swimming pools
will be constructed prior to the effective date of the ordinance,
which unfenced pools will constitute a serious danger to the children
within the City
PASSED AND ADOPTED this 20th day of March, 1961 by the following
called vote.
