Ordinance No. 102}80 ORDINANCE NO 102 AN ORDINANCE OF THE CITY OF CYPRESS REGULATING THE ISSUANCE OF PERMITS FOR FOOD HANDLING BUSINESSES AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF THE CITY COUNCIL OF THi; CITY OF CYPRESS DOES ORDAIN AS FOLLOWS. SECTION 1 PERMITS• It shall be unlawful for any person, firm or corporation owning, controlling or leasing, acting as agent for, conducting, operating or managing any restaurant, cafe, lunch counter, cafeteria, soda fountain, ice cream parlor soft drink stand fruit and vegetable stand grocery, meat market, bakery, popcorn, peanut or other food vending stands or stations, food processing or manufacturing plants bottling plants, or other places or vehicles in the City of Cypress where food is prepared for sale sold, distributed, or displayed for sale to conduct or operate, or cause or permit to be conducted or operated in said City of Cypress such restaurant, cafe, lunch counter, cafeteria, soda fountain, ice cream parlor, soft drink stand, fruit and vegetable stand, grocery, meat market, bakery, popcorn peanut or other food vending stands or stations or vehicles where food is pre- pared for sale sold, distributed, or displayed for sale, or for any person to sell, or offer for sale, or cause or permit to be sold or offered for sale, any food or drink therein or therefrom without first complying with all state and/or local laws, ordinances and regulations and without first applying for and receiving from the Health Department of the City of Cypress a permit therefor A permit for which application is made under the provisions of this ordinance may be granted at any time during the year, but all permits granted hereunder shall expire concurrently with the city business license issued for the corresponding period The permit shall be posted in a conspicuous place on the property SECTION 2. EXCEPTIONS Provided, that this ordinance shall not apply to cigar stands or other places or vehicles of business where no food of any kind or nature is offered for sale or sold other than candy or soft drinks received in sealed packages or boxes or bottles where the seal or seals on said package or boxes are not broken prior to sale thereof, or vehicles engaged in the delivery of food products to retail establishments for resale SECTION 3 INSPECTION• It shall be lawful for any agent member or employee of the Health Department of the City of Cypress to enter and go upon any premises herein mentioned at any time for the purpose of inspecting the same and any member of the Health Department may require any per- son owning a permit under this ordinance to produce the same for inspection If such inspection be refused the permit shall be forthwith revoked SECTION 4 PERMIT INSPECTION: A permit which has been issued under the provisions of this ordinance may be temporarily suspended by the Health Officer upon violation by the holder of any State or Local laws ordinance or regulations pertaining to the purity of a food product or the sanitation of food handling establishments, or revoked if the violation is not corrected after an appropriate notice of such violations has been served by the Health Officer Ordinance No 102 SECTION 5. PENALTIES: Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding Five Hundred ($500) or by imprisonment in the County Jail of the County of Orange for a period not exceeding thirty (30) days, or by both such fine and imprisonment PASSED AND ADOPTED this 31st day of July, 1961 by the following roll call vote.
