AN ORDINANCE OF THE CITY OF CYPRESS AMENDING ORDINANCE NO.
90, THE ZONING ORDINANCE
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS:
Section 1• The following Sections are added to, amended, or deleted
from Ordinance No 90 as amended.
Add to Section 110 2.
H. Rooming and boarding houses and foster homes for any number of guests,
subject to obtaining a Conditional Use Permit
Amend PART 10 by adding PART 10 A
PART 10.A COMMERCIAL OFFICE ZONE OR "CO" - ZONE
Section 110 A 1 Purpose
To provide a district for office type uses, with yard
and open space and architectural requirements similar to those in residential
districts, in order that such uses can be located in close proximity thereto
Section 110 A 2 Permitted Buildings and Uses
Only the following buildings, structures and uses, either
singly or in combination are permitted in a commercial office zone
a Medical, Dental offices and clinics
b. Business, executive and financial offices
c Professional offices
d Private parking lots and garages
e Any other office uses which the Planning Commission
finds not to be inconsistent with the uses listed,
as set out above
f Medical and Dental laboratories, but not including
manufacturing of products for general sale or
distribution.
g Schools and studios for arts, crafts, photography,
music and dance, subject to obtaining a Conditional
Use Permit
h Mortuaries, nursing homes, rest homes, nursery
schools, day care centers, clubs, lodges, fraternities,
subject to obtaining a Conditional Use Permit
i Educational, religious, recreational, cultural or
public service uses, but not including any storage,
repair yards, equipment yards or warehouses, subject
to obtaining a Conditional Use Permit

Section 110 A 3 Accessory Buildings and Uses
Accessory buildings and uses shall be permitted only
to the extent necessary and normal to the type of
uses permitted in this zone Accessory buildings
and structures are permitted in the rear and side
yards, providing no building or structure is permitted
in the side yard within sixty (60) feet of the front
lot line, nor permitted in any yard abutting the
street All accessory buildings which are not a part
of the main building shall be separated from the main
building by at least five (5) feet Signs may be
allowed as set out in the Sign Ordinance of the City
of Cypress
Section 110A 4 Lot Area and Dimensions
Lots of record on the effective date of this Ordinance,
whose area or dimensions are less than those required in
this zone, may be occupied by uses permitted
subject to all other restrictions and requirements
which the size of the lot makes it possibly to comply
with.
A Lot Area: The minimum lot area shall be Five
thousand (5000) square feet
B. Lot Dimensions. The minimum lot dimensions
shall be fifty (50) feet for interior lots,
and sixty (60) feet for corner lots Minimum
depth one hundred (100) feet
Section 110 A 5 Building or Structural Height Limitations
The maximum building or structural height of the
main building shall be two and one-half (2-1/2)
stories or 35 feet, whichever is the lesser, and
one (1) story or 20 feet, whichever is the lesser,
for accessory buildings. When a "C-0" Zone abuts
upon any residential zone, a structural height of
any building erected on it, or on such abutting or
adjacent lot, it shall be limited to one (1) story
or 20 feet, whichever is the lesser, for a distance
of fifty (50) feet from the "C -O" Zone abutting
any of the aforementioned other residential zones.
Section 110.A.6 Yard Regulations
Unless otherwise required in PART 19 of this Ordinance,
or unless Optional Design Standards have been used as
set out in Section 110 A of this Ordinance:
A Front Yard
Each lot in a "C-0" Zone shall have a front yard
extending across the full width of the subject
property of a depth of not less than that required
in the abutting zone, but need not exceed twenty
(20) feet, and in the case of a corner lot, also
a side yard along the abutting street side, meeting
the same requirements, which need not exceed ten
(10) feet A minimum of ten (10) feet closest to
the street line shall be landscaped and permanently
maintained as a condition to the use of the property.

There shall be no parking in the ten feet closest
to the street line, except access drives or walks
or required yard abutting a street.
B Side Yard
No side yard is required between office structures
When abutting a residentialzone there shall be
a side yard of not less than ten (10) feet in
width on that side of the property abutting the
residential zone
C. Rear Yard
No rear yard is required when property in a 1C-0'
Zone abuts property in a commercial or industrial
zone
When abutting a residential zone there shall be
a rear yard of not less than twenty-five (25)
feet extending across the full width of the
subject property, unless the rear of the subject
property abuts a fully developed alley Such rear
yard may be used for off-street parking or
landscaping.
D. Landscaping
Minimum required Ten (10%) percent of the yard
area shall be set aside and maintained in
landscaping
Section 110.A.7 Lot Coverage
The maximum coverage of the lot by all structures
shall not exceed ninety (90%) percent less required
parking, required landscaping areas and required
setbacks
Section 110 A 8 Optional Design and Improvement Standards
When a development has been approved by the Planning
Commission, under the Optional Design and Improvement
Standards of the Subdivision Ordinance, then such
approved building sites, coverages and yards under such
plan shall be considered as the requirements of thsi
ordinance
Section 110 A 9 Off -Street Parking
The provisions of PART 21 shall apply in determining
the amount of parking space that must be provided for
each use The parking space shall be improved as set
out in said Part.
Amend PART 17, Section 117 1, as follows:
The new title of PART 17 shall be- PLANNED DEVELOPMENT DISTRICT
(PD Zone)
Section 117 0 Description and Purpose
To provide for an integrated community development,
a complete neighborhood which will provide the
necessary amenities and conveniences to protect
and encourage a suitable environment for families,
whether single family or multiple, and to provide
commercial service centers, office and research area
that can appropriately be made a part of a community
development

Section 117 1 Buildings and Uses Permitted
Subject to obtaining a Use Permit which shall be
considered and acted upon in all instances by
the City Council as well as the Planning Commission,
land,buildings and structures may be used in the
PD district for the following purposes;
A Any use permitted in any R, C-1 or C-2
District.
B Administrative and professional offices
C Public and private recreation facilities
D Research and development establishments
Any application for use in this district shall be
accompanied by complete development plans, including
planting plans and architectural sketches showing
site use or planned development, the character and
use of adjoining land, the design and character,
general size, location and use of all buildings and
structures to be placed on the site; the location and
dimensions of streets, parking areas, open areas and
other uses
Amend PART 19, Building Lines and Setback Lines Along Major, Primary and
Secondary Highways, as follows:
Section 119 0 General Plan of Streets and Highways, The major,
primary, and secondary highways existing within the City are shown and desig-
nated upon a map hereto attached and made a part of this Ordinance being
designated as the Master Plan of Arterial Highways of the City of Cypress,
otherwise referred to in this Ordinance as the City Highway Map, and said
map and all the notations, references, and any other information shown thereon
are by reference hereby made a part of this Ordinance The original of
the City Highway Map, including any changes or amendments thereto shall be
kept on file with the City Clerk
Section 119 1. Building Setback Line
A. Planned highway right-of-way line. A planned highway
right-of-way line is hereby established in the following
instances:
1 Along all major highways, except Lincoln Avenue,
as shown on the Master Plan of Arterial Highways
of the City of Cypress, sixty (60) feet distance from
and parallel with the center line of such highway,
Lincoln Avenue, fifty-three (53) feet distance from and
parallel with the center line of Lincoln Avenue.
2 Along all primary streets as shown on the Master Plan of
Arterial Highways of the City of Cypress, fifty (50)
feet distance from and parallel with the center line of
such street;
3 Along all seconary streets as shown on the Master
Plan of Arterial Highways ofthe Cityof Cypress,
forty-four (44) feet distant from and parallel with
the center line of such street.
B. The center line shall be:
1 The officially surveyed line, or
2 A center line as adopted by a precise plan

C How measured
1 The building setback line shall be a line which is the
depth of the required front yard back from and parallel
with the front property line
2 The building setback line along the abutting side street
of a corner lot shall be aline which is the depth of
the required side yard back, from and parallel with the
side property line.
3 Where there is a planned highway right-of-way line
established by the Ordinance, the setback distance
shall be measured from such planned highway right-of-way
line rather than from the actual line
D Building lines or building setbacks on major, primary and
secondary highways, as such major, primary and secondary
highways are shown on the Master Plan of Arterial Highways
of the City of Cypress, also known as the Master Plan of
Streets and Highways, as adopted by the City Council of the
City of Cypress, ahll be as are found on the following
chart Such distances as indicated on the chart shall be
measured from the center lines of said streets
The building lines or setbacks established in said chart must
be met despite any provision to the contrary in this Code, except that the
variance procedure and those Sections applicable to non -conforming buildings
and uses shall be applicable.

Amend PART 21: Off Street Parking Requirements, as follows:
Section 121.1 Location of parking spaces, common facilities.
Add 4th paragraph as follows:
No parking space shall be provided, constructed or maintained
in any required front or side yard in any district except where
specially set out in such district Parking spaces shall not he
calculated as a part of the required open space in any district.
Section 121 2 Minimum Requirements
Section A, Dwelling Units:
In second paragraph delete the words "and Triplexes'
Amend PART 25 General Provisions, Conditionsi Limitations, by adding:
Section 125 20 Animals
Except where specifically set out in the district, there shall
be no more than three (3) dogs or cats over four (4) months of age
housed on any premises and no more than one (1) per unit in any
multiple 'R" district
No roosters shall be maintained in any "R" district
No aviaries, apiaries and no fowl or animals other than cats and
dogs shall be maintained in any canbination of "R" district
Section 125 21 Christmas Tree Sales
The sale of Christmans Trees and wreaths shall be permitted in any
zone and shall be exempt from the property development standards of
this Ordinance, provided such use complies with the following
conditions:
A That authorization for such use has first been granted
by the City Council.
B That such sales shall be conducted only from December 1
to December 25, inclusive.
C. That the operation be conducted in such a manner as to
not adversely affect surrounding properties
D That the premises used for such sales shall be cleaned up
and restored to a neat and orderly condition by December 31
of that year.
E A $50 00 clean-up bond shall be posted.
F. That such lots shall be inspected by the building and
fire departments to assure compliance with all building
and fire codes
G. That adequate parking shall be provided to the satisfaction
of the City staff

Section 2. All other Ordinances or provisions of Ordinances inconsistent
or in conflict with the provisions hereof are hereby amended or repealed
in order that they shall in all respects conform to the amendments of this
Ordinance.
