AN ORDINANCE OF THE CITY OF CYPRESS ADOPTING CURFEW REGULATIONS
AND REPEALING ORDINANCE NOS 48 AND 81 OF THE CITY OF CYPRESS'
IMPOSING'CURFEW ON PERSONS UNDER EIGHTEEN YEARS OF AGE
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORGAIN AS FOLLOWS
Section 1 Minor Defined.
For the purpose of this Article, any person under the age of
18 years shall be deemed a minor
Section 2 Service and Married Persons Excepted
Provisions of this Article shall not apply to any minor in the
military service of the United States, or any minor legally married
Section 3 Curfew hours
It shall be unlawful for any minor to loiter, wander, or play
in or upon the public streets, alleys, parks, playgrounds or other public
places or places of amusement or entertainment, vacant lots or other
unsupervised places or trespass on private property between the hours of
10 P. M. and 6 A. M. on the following day; provided, however, that the
provisions of this section shall not apply to a minor accompanied by his
or her parent, guardian, or other adult person having the care and custody
of said minor or to a minor upon an emergency errand at the direction of
such parent, guardian, or adult persons, or to a minor engaged in an employ-
ment which makes it necessary for such minor to be on the streets during
the above hours
Each violation of the provisions of this section shall constitute
a separate offense
Section 4 Enforcement.
Every law enforcement officer is hereby authorized and empowered
to demand from any person who he has reasonable cause to believe is in
violation of this Article that such person give his or her name, address,
proof of age, the name of parent, guardian, or adult having care or custody
of such person if a minor as herein defined, and other information reason-
ably necessary to determine whether such violation exists.
Any such minor found to be in violation of the provisions of this
Article may be taken into custody by such officer and thereafter may be
released to the parent, guardian or other adult person having the care and
custody of such minor or may be dealth with in accordance with the Juvenile
Court Law of the State The refusal or failure of any such parent, guardian
or adult person to furnish the information hereinabove required or to take
such minor home when so demanded by any such law enforcement officer is
hereby declared to be a misdemeanor
Section 5. Violations
Any minor violating any of the provisions of Section 3 hereof is
subject to being remanded to the Juvenile Court Any parent, guardian or
other adult person having the care and custody of a minor coming within
the provisions of this Article who violates any of the provisions hereof
shall be glilty of a misdemeanor and shall be punished by a fine not
exceeding $500 or by imprisonment in the City or County Jail for a term not
exceeding six (6) months, or by both such fine and imprisonment.

Section 6 Repealing Previous Ordinances
Ordinances of the City of Cypress imposing curfew on persons
under eighteen (18) years of age, adopted on the 8th day of December,
1958 and on the 16th day of January, 1961, are hereby repealed
The repeal of said ordinances shall not have any effect on existing
litigation and shall not operate as an abatement of any action or
proceeding then pending under or by virtue of said Ordinances No 48 and
81 of the City of Cypress.

a regular meeting of the City Council held on the 23rd day of December,

of the City of Cypress on the 13th day of January, 1964
