ORDINANCE NO. 208
AN EMERGENCY ORDINANCE OF THE CITY OF CYPRESS AMENDING THE
SUBDIVISION ORDINANCE, ORDINANCE NO 77, TO PROVIDE FOR FEES
AND REGULATION OF IMPROVEMENTS UPON PRIVATE STREETS AND PARKWAY
AREAS EXISTING UNDER OPTIONAL DESIGN STANDARDS
The City Council of the City of Cypress does ordain as follows:
SECTION I: There have been, are being and will be developed in the
City of Cypress large numbers of developments which utilize private streets
and parkway areas under optional design standards as provided for in special
planning options rather than public streets, highways, public ways and easements
SECTION II• The improvements upon such private streets and parkway
areas, which correspond to those improvements existing upon public streets,
highways, public ways and easements pursuant to Subsection (c) of Section 5-18
of Article V of Ordinance No. 77 as amended, commonly known as the Subdivision
Ordinance, are not now subject to the requirement of inspection and payment of
fees therefor required for such improvements on public streets, highways, public
ways and easements under such Subdivision Ordinance
SECTION III: The City Council finds and determines that the
inspection and payment of fees therefor for such improvements under such private
streets and parkways is equally as necessary for the public peace, health,
safety and welfare as such inspection and payment of fees therefor for those
improvements existing upon public streets, highways, public ways and easements
pursuant to said subsection of the Subdivision Ordinance
SECTION IV: The City Council further finds and determines that an
urgency exists which requires the adoption of this ordinance as an emergency
measure necessary for the immediate preservation of this public peace, health,
safety and welfare, in that construction of large quantities of such improvements
upon private streets and parkway areas is imminent and will not otherwise be
subject to such inspection and payment of fees therefor
SECTION V: Subsection (d) of Section 5-18 of Article V of Ordinance
No 77, commonly known as the Subdivision Ordinance is hereby amended to read
as follows.
(d) All construction of such improvements under Article V,
Section 5-18, Subsection (b) hereof and also similar improvements
upon private streets and parkway areas pursuant to optional design
standards provided for in special planning options hereunder,
other than such improvements upon private streets and parkway areas
for which a building permit has been issued by the City Building
Department, shall be subject to inspection by the City Engineer
and the subdivider shall arrange for such inspection prior to the
start of construction of the improvements Before commencing any
such improvements, the subdivider shall pay to the City Finance
Department, fees in the amount of three and one-half (3-1/2) percent
of the cost of such improvements.
SECTION VI: This ordinance is declared to be an emergency measure
necessary for the immediate preservation of the public peace, health, safety
and welfare, and shall become effective immediately upon its passage
