ORDINANCE NO 211
AN ORDINANCE OF THE CITY OF CYPRESS PROVIDING FOR THE
DISPOSAL OF ABANDONED OR UNCLAIMED PERSONAL PROPERTY.
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS.
Section 1: All lost, abandoned or unclaimed personal property, other
than live animals, coming into the possession of the city or any officer or
department thereof shall immediately be turned over to the custody of the police
department Such personal property shall be held by the police department for
a period of at least six months unless sooner claimed and restored, except that
bicycles need only be held by the police department for a period of at least
three months unless sooner claimed and restored
Section 2: If, at any time prior to the sale or destruction of any lost,
abandoned or unclaimed personal property as provided in this chapter, any such
property is claimed by any person who establishes his right to the possession
thereof to the satisfaction of the chief of police or his authorized deputy in charge
of such property, such personal property shall be delivered to such person;
provided that such person shall first pay to the police department the reasonable
cost to the city of holding, protecting and returning such property
Section 3: If any lost, abandoned or unclaimed property shall remain unclaimed
and unrestored for at least six months, such property shall be sold at public
auction to the highest bidder at such time as the chief of police shall determine.
If the property which is lost, abandoned or unclaimed is a bicycle and such
bicycle remains unclaimed and unrestored for at least three months, such bicycle
shall be sold at :public auction to the highest bidder at such time as the chief
of police shall determine. Such auction shall he conducted by the chief of police
or by any agent appointed by him for that purpose Such property may he sold
separately or in such lots as the auctioneer may determine The purchaser at such
auction sale shall take a clear title to the property purchased free of any
equity or redemption.
Notice of such auction sale shall be given by the chief of
police at least five days and not more than twenty days before the time fixed
therefor by publication at least once in a newspaper of general ciculation
printed, published and circulated in the city
Section 4: If any lost, abandoned or unclaimed property shall he offered
f or sale at public auction as provided in this chapter and shall not be sold,
such property shall be destroyed by the chief of police
Section 5: In the event of any dispute regarding the administration or
application of this ordinance, appeal may be made to the city council and the
city council shall thereupon settle such dispute.

that the foregoing Ordinance No. 211 had its first reading by the City Council
at a regular meeting held on the 22nd day of June, 1964, and had its second reading
and was duly adopted by the City Council of the City of Cypress on the 13th day
of July, 1964.
