Minutes 1978-05-18MINUTES OF A REGULAR MEETING OF THE CYPRESS PLANNING COMMISSION HELD May 18, 1978 The regular meeting of the Cypress Planning Commission was called to order at 6.40 p m on Thursday, May 18, 1978 in the Cypress City Council Chambers 5275 Orange Avenue, Cypress, California, Vice Chairman Ellen Friedmann presiding PRESENT: ABSENT• Commissioners Friedmann, Mullen and Partin Commissioners Adler and Van Allen Also present were Brian Hawley, Planning Director, Art Schatzeder, Public Works Director Don Lamm Assistant Planner and John Murphy, City Attorney PLEDGE OF ALLEGIANCE: Commissioner Mullen led the pledge to the flag. Hearing no objections, Commissioner Friedmann added Item #5 under Administrative Matters regarding sign review for the Los Alamitos Race Track MINUTES• It was moved by Commissioner Mullen, seconded by Commissioner Partin and unanimously carried to approve the minutes of May 4 ADMINISTRATIVE MATTERS. 1 Design Review - Yamaha Motor Corporation, Northeast Corner of Holder Avenue Extension and Katella Avenue. The Planning Director presented the plot plans and elevations and conditions of approval applicable to the Yamaha development He reported the first phase of development proposed 260,000 square feet of area and there were provisions for future development up to 125,000 square feet He stated the landscaping and off-street parking meet the requirements of the PC Zone Mr Chancy Lott, representing William Pereira Associates Corona del Mar reported the development will be phased and direction is provided for expansion of all elements of the development Mr Lott identified the areas of potential expansion for the office, warehouse and dynamometer buildings and parking. Mr Lott reported the ware- house and dynamometer buildings will be developed concurrently and the central plant will follow He reported the trucking operations at the warehouse will be screened from Holder Street by a berm and heavy tree landscaping (a double row of trees) He stated the trucking operations are confined to approximately 7 00 a m to 3 30 p m He reported there will be staggered work shifts Commissioner Mullen recommended that the northwest driveway access serving the warehouse parking lot be smoothed out to provide better maneuverability for emergency vehicles The Planning Director stated this access was designed according to specifications of the Fire Marshal He stated it was temporary and would be changed when the facilities expand Mr Lott had no objections to redesigning this driveway access He stated the parking lot west of the ware- house will have one-way ingress and egress for trucks Mr Lott briefly described the operations and reported the research building will have a computer, classrooms for dealers and representatives and engineering offices He reported the testing of motorcycle emissions, noise and vibration will be conducted in the dynamometer building Mr Lott stated the applicant agrees with the conditions of approval Planning Commission Minutes May 18 1978 It was moved by Commissioner Mullen, seconded by Commissioner Partin and unanimously carried to approve Design Review for the Yamaha Motor Corporation subject to the following conditions: 1 Development of the subject property shall be in substantial compliance with the plot plans and elevations as submitted with this request and as reviewed and approved by the Planning Commission Prior to the issuance of the building permits for the proposed office and research buildings, final eleva- tion plans shall be submitted for review and approval by the Planning Commission Similarly all future building exten- sions or additions shall require design approval of plans and elevations by the Planning Commission 2. Plans for the proposed on-site landscaping and irrigation systems shall be submitted for review and approval by the Planning Commission Occupancy of the office and research buildings shall not be granted until landscape and irrigation systems have been installed in accordance with approved plans 3 All requirements of the Orange County Fire Marshal with respect to on-site water and emergency vehicular circulation systems and the installation of necessary fire hydrants and other fire prevention measures shall be satisfied with respect to this project 4 Developer shall conform to all applicable provisions of the City Code The sanitary sewer connection fee shall be paid by the developer in accordance with Orange County Sanitation District No 3, Resolution No 303 S. Drainage shall be solved to the Engineer A grading plan shall If the existing natural flow of the land of this development, a granted and drainage facilities to the satisfaction of the City satisfaction of the City be submitted for approval any adjoining parcel is across drainage easement shall be provided for that property Engineer A retaining wall per City of Cypress standards shall be constructed at the property line where the grade difference is greater than twelve inches (12") On-site drainage shall be conveyed by an undersidewalk drain when crossing a sidewalk along a flow path to the street Minimum rate of grade in on-site gutters shall be 0 20% 6 All secondary and primary utility services shall be under- ground The street in front of this development shall be resurfaced with one inch (1") minimum thickness asphalt concrete from curb -to -curb if it is necessary to open cut the street in more than one place Any open cut shall be backfilled per City of Cypress Standard No 110 7. Installation and maintenance of landscaping and irrigation systems between the back of sidewalks and right-of-way lines shall be the responsibility of the property owner 8 The number, location, width and type of driveways shall be subject to the approval of the City Engineer An effective sight distance for vehicular traffic shall be maintained at the intersection of the driveway entrances with Holder Street, Katella Avenue and Yamaha Way No landscaping will be allowed in the area of the curb returns Adequate sight distance also shall be maintained within the development at all driveway intersections to the satisfaction of the City Engineer On- site circulation systems, turning and maneuvering areas and radii of curb returns shall be in accordance with the requirements of the Zoning Ordinance and the City Traffic Engineer -2- Planning Commission Minutes May 18, 1978 9 The development of the subject property shall conform to the appropriate requirements of all building electrical, plumbing and fire codes as interpreted by the Building Superintendent 10 Wheelchair and handicap access facilities shall be installed on-site and off-site in accordance with State of California and City of Cypress Building Department standards 11 On-site security lighting shall be arranged so that direct rays will not shine on adjacent properties or produce glare for street traffic All roof -mounted equipment, such as heating and air conditioning units, shall be adequately screened from public view, subject to the approval of the City staff Commercial or industrial developments which adjoin residentially zoned areas shall construct noise bafflers and/or deflectors on all mechanical equipment mounted outdoors, to the satisfaction of the City staff 12 The fire access driveway around the warehouse building shall be designed with appropriate radii at all corners 2. Design Review - Commercial Shopping Center, North Side of Cerritos Avenue West of Valley View Street. The Planning Director presented slides of the subject property and the Assistant Planner presented the plot plans and elevations and a staff report dated May 15 describing the application to con- struct a 9200 square foot commercial shopping center on 86 acres Space for 16 individual tenants will be provided in an L-shaped design The staff reported that adequate parking spaces will be provided The Planning Director stated there are many driveway entrances in the area and the Traffic Engineer recommended the elimination of several of them Mr Maurice Van De Moere, 3672 Toland, Los Alamitos representing the applicant, agreed with the conditions of approval It was moved by Commissioner Partin, seconded by Commissioner Mullen and unanimously carried to approve Design Review for the Commercial Center subject to the following conditions 1 A comprehensive signing program shall be submitted for review and approval by the Planning Commission prior to any sign installation 2 Due to vehicular conflict, parking spaces #42 and #43 shall be eliminated 3 The eight -foot -high, roof -top aluminum poles with colored pennants shall be eliminated 4 Developer shall conform to all applicable provisions of the City Code All requirements of the State Subdivision Map Act and the City's Subdivision Ordinance shall be satisfied Plan checking and inspection fees shall be paid in accordance with City of Cypress Resolution No 1713 The sanitary sewer connection fee shall be paid by the developer in accordance with Orange County Sanitation District No 3, Resolution No 303 5 Drainage shall be solved to the satisfaction of the City Engineer A grading plan shall be submitted for approval All on-site drainage shall be conveyed to the street by means of an undersidewalk drain per City of Cypress standards A retaining wall per City of Cypress standards shall be con- structed at the property line where the grade difference is greater than twelve inches (12") -3- Planning Commission Minutes May 18 1978 6 All secondary and primary utility services shall be underground Necessary fire hydrants shall be installed in accordance with Fire Department requirements and City standards The street in front of this development shall be resurfaced with one - inch (1 ) minimum thickness asphalt concrete from curb -to -curb if it is necessary to open cut the street in more than one place Any open cut shall be backfilled per City of Cypress Standard No 110 7 The minimum flowline grade in concrete gutters shall be 0 20% All existing public improvements at the development site which are damaged, cracked or otherwise below standard shall be removed and replaced to the satisfaction of the City Engineer 8 A landscape and irrigation plan shall be reviewed and approved by the Planning Commission prior to any installation Soil in planting areas including trees, shall be tested by a qualified agricultural laboratory to determine the organic and chemical amendments for optimum growth for the plants specified The test results shall include concentration of nitrogen, phosphorus potassium, pH, salinity, sodium status and boron saturation extract Results of these tests with recommendations of the agricultural laboratory shall be fur- nished to the Public Works Department for approval at least 30 days prior to planting date A bond shall be posted by the applicant to guarantee maintenance of the irrigation system so that it operates in a manner for which it was designed, and to guarantee maintenance of all plant materials in a healthy growing condition, free of weeds and litter, for a period of not less than twelve (12) months, to the specifications of the City staff A certificate of occupancy shall not be issued for this development until all land- scaping and irrigation is completed in accordance with plans and specifications as approved by the Planning Commission Street trees (15 gallon) forty feet (40') on center shall be installed along streets in conformance with the Street Tree Policy of the Public Works Department The type of trees shall be as required under the Townscape and Urban Design Element of the General Plan 9 The main entrance driveway shall be thirty-five feet (35') in width An effective sight distance for vehicular traffic shall be maintained at the intersection of the driveway en- trances with Cerritos Avenue No landscaping will be allowed in the area of the curb returns Adequate sight distance shall also be maintained within the development at all drive- way intersections to the satisfaction of the City Engineer 10 The developer shall provide adequate "No Parking" controls within the development to the satisfaction of the City Engineer Adequate "No Parking - Fire Lane' signs shall be installed along the alley per California Vehicle Code #22658 to the satisfaction of the City Engineer, Building Department Super- intendent and County Fire Marshal. 11 A minimum six foot (6') high block wall, measured from the highest adjacent grade, shall be maintained along the north and west property lines A continuous physical barrier (i e 6" high concrete curb) shall be constructed at a minimum distance of three feet (3') from the base of all block walls exposed to vehicular traffic to the satisfaction of the City Engineer Planting may be installed in the area between the block wall and the curb. 12 Wheelchair and handicap access facilities shall be installed on-site and off-site in accordance with State of California and City of Cypress Building Department standards 13 On-site security lighting shall be arranged so that direct rays will not shine on adjacent properties or produce glare -4- Planning Commission Minutes May 18 1978 for street traffic All roof -mounted equipment, such as heating and air conditioning units, shall be adequately screened from public view subject to the approval of the Planning Department Commercial developments which adjoin residentially zoned areas shall construct noise bafflers and/ or deflectors on all mechanical equipment mounted outdoors to the satisfaction of the City staff 14 The landscaped area within the rear alley at the northwest corner of the property, shall have a radius curve to dis- courage illegal parking Commissioner Mullen asked if access between the shopping center and existing center to the east could be provided via the rear alley The Planning Director stated this was investigated by the applicant and consequently the owner of the existing shopping center erected the chain link fence so as not to encourage business in the new center He stated the fence is under three feet in height and is legal The Planning Director reported that the grades of the two properties will be the same and integrated access could be provided in the future if the other party agrees or if there is a change of ownership of the property to the east 3 Design and Signing Review - Winchell's Donut House South- east Corner of Lincoln Avenue and Valley View Street. The Assistant Planner presented a report dated May 12 describing the design and signing program for Winchell's Donut House and the Planning Director presented slides of the property which is also the site of the new Fast Feast Restaurant Staff also presented the plot plans and elevations for the 1500 square foot building The staff recommended that additional wood trim be added to the building to correspond with the treatment of the Fast Feast Rest- aurant. With regard to signing, the staff reported the proposed pole sign will identify Winchell's and the future Licorice Pizza record store Staff recommended that the pole sign maximum height be limited to 22 feet as proposed but that the "Open 24 Hours' sign portion be eliminated due to possible confusion with the future Licorice Pizza sign and because of its low ground clearance of five feet They suggested that the hours sign could be attached to the building Staff reported that the signs attached to the building will be plexi -glass and not painted -on The Planning Director reported that the sign proposed for the south side of the building would not be in conformance with the Zoning Ordinance which allows signing on two sides of a building and he recommended the deletion of this sign. Mr Richard Moore, representing Anthony Industries, Southgate, and Mr John Emanuelli, representing Winchell's Donut House, 16424 Valley View La Mirada, stated they agreed with staff's recommen- dations to eliminate the sign on the south side of the building, to provide additional wood trim on the building, and to eliminate the "Open 24 Hours" sign can They indicated this sign may be placed on the building It was moved by Commissioner Mullen, seconded by Commissioner Partin and unanimously carried to approve Design and Signing Review for Winchell's Donut House subject to the following conditions. 1 Wall sign lettering shall not be painted on the building facing Letters shall be made of permanent low -maintenance material such as plexiglas or metal. 2 The tubular steel columns of the freestanding signing shall be covered with wood on all sides to match the decor of the property's existing development -5- Planning Commission Minutes May 18, 1978 3 The "Open 24 Hours" sign can shall be eliminated from the freestanding sign. 4 The future Licorice Pizza sign can is subject to review and approval by the Planning Commission and shall be limited to a maximum of 48 square feet in area 5 The subject building shall utilize additional wood trim to match the decor of the property's existing development, subject to City staff approval. 6 The applicants shall comply with all applicable City Codes and obtain all necessary permits prior to construction 7 No sign shall be attached or displayed on the south side of the proposed building 4 Design Review - Florist Shop, 6076 Lincoln Avenue The Planning Director presented slides of the subject property and reported the applicant owns the adjacent parcel of land and both lots are 66 feet in width He reported uses to the west of the proposed florist shop are the Broasted Chicken establishment, the Red Rooster bar and a single-family dwelling He stated parking areas for these uses extend to the rear of the property The Assistant Planner presented the plot plans and elevations and a report dated May 15 describing the proposal to construct a 1200 square foot building on 41 acres of land He reported the area to the south of the building will be paved for parking Commissioner Mullen recommended that some provision, such as a common easement, be included to maintain the common driveway for the two parcels to facilitate the future sale of either of the parcels The Planning Director stated the staff will investigate alternatives to ensure that an easement or reciprocal driveway provision is included with development of the property Mr Milton Lockett, 11851 Gilbert, Garden Grove, representing the applicant reported that with regard to Condition #7, the property owner has agreed to an agreement certifying the joint usage of the driveway He stated the property owner has no immediate plans to sell the property and the tenant will lease the building Mr. Lockett inquired about Condition #6 regarding the soil tests and the staff explained its purpose and that it is a standard condi- tion for all developments Mr Lockett agreed with the conditions of approval It was moved by Commissioner Partin, seconded by Commissioner Mullen and unanimously carried to approve Design Review for the Florist Shop at 6076 Lincoln Avenue subject to the following con- ditions• 1 The landscape area along Lincoln Avenue shall be increased to a minimum of ten feet in depth Additional landscaping shall be provided within the parking area A landscaping and irrigation plan shall be reviewed and approved by the Planning Commission prior to installation of any landscaping 2 The existing non -conforming pole sign on the subject prop- erty shall be removed All future signing for the florist shop is subject to Planning Commission review and approval 3 The building parapet shall be raised on the east, south and west elevations to the level of the parapet on the north elevation to adequately screen all roof -mounted equipment from public view, subject to City staff approval -6- Planning Commission Minutes May 18, 1978 4 Developer shall conform to all applicable provisions of the City Code A permit shall be obtained from the State Depart- ment of Transportation prior to the start of any work on Lincoln Avenue Drainage fees shall be paid in accordance with the Master Plan of Drainage The sanitary sewer con- nection fee shall be paid by the developer in accordance with Orange County Sanitation District No 3, Resolution No 303 Advance street light energy charges shall be paid A cash bond shall be posted for future street lights on Lincoln Avenue and a 1 1/2" diameter PVC pipe, schedule 40 shall be installed A cash bond shall be posted for future street trees and treewells shall be installed in conformance with the street tree policy of the Public Works Department 5 Drainage shall be solved to the satisfaction of the City Engineer A grading plan shall be submitted for approval A topograph of the area surrounding this development shall be made to establish existing drainage flow patterns If the existing natural flow of any adjoining parcel is across the land of this development a drainage easement shall be granted and drainage facilities provided for that property to the satisfaction of the City Engineer. A maximum lot depth of 100 feet shall be allowed to drain onto Lincoln Avenue If drainage is directed to Lincoln Avenue, drainage culverts shall be constructed underneath sidewalks to convey all on-site runoff water to the street to the satisfaction of the City Engineer. A retaining wall per City of Cypress standards shall be constructed at the property line where the grade difference is greater than twelve inches (12") The minimum flowline grade in on-site gutters shall be 0.20%. An effective sight distance for vehicular traffic shall be maintained at the intersection of the driveway entrances with Lincoln Avenue No landscaping will be allowed in the area of the curb returns Adequate sight distance also shall be maintained within the development at all driveway intersections to the satisfaction of the City Engineer If a driveway is to be shared with an adjacent parcel, an agreement certifying the joint usage will be required To the maximum extent possible, said agreement shall be in the form of an easement designed to insure continuation of the joint usage of the driveway and parking areas -7- Planning Commission Minutes May 18, 1978 8 Wheelchair and handicap access facilities shall be installed on-site and off-site in accordance with State of California and City of Cypress Building Department standards 9 On-site security lighting shall be arranged so that direct rays will not shine on adjacent properties or produce glare for street traffic 5 Sign Review - Los Alamitos Race Course The Planning Director presented the plans for a reader message board which is proposed to be added under the existing sign on Katella at the Los Alamitos Race Track He reported the reader board will be about five feet in height, 15 feet in length for a total area of 75 square feet and it will give the time of day and post time for racing He reported the existing sign will be painted and the neon tubing on the galloping horse portion of the sign will be discontinued He stated this is the only sign identifying the race track and staff has no objections to the proposed addition Mr Scott Pannick, representing American Sign Company, Santa Ana, stated the new sign will show the time of day and time of racing meets. He stated he will suggest to the race track that the neon on the horse be deleted and he stated this is not part of the new sign proposal It was moved by Commissioner Mullen, seconded by Commissioner Partin and unanimously carried to approve the sign plans for the reader board sign for Los Alamitos Race Track ORAL COMMUNICATIONS. Commissioner Friedmann asked if anyone wished to speak in regard to any matter not on the agenda. No one wished to speak RECESS: Commissioner Friedmann called a recess at 7.54 p m The meeting was called back to order at 8.05 p m with Commissioners Adler and Van Allen absent Hearing no objections, Commissioner Friedmann took Public Hearing #2 out of order for the benefit of persons in the audience PUBLIC HEARING RE: CONDITIONAL USE PERMIT NO 78-11 - WILFRED AND CHARLEEN WIERSMA• Commissioner Friedmann announced that this was the time and place for the public hearing to consider an application to allow the sale of animal feed in the RS -15,000 Residential Single -Family Zone at 4252 Crescent Avenue She opened the hearing and asked for the staff report The Planning Director reported that during the recess the applicant advised him that they requested a continuance of the hearing until the entire Commission is present Mrs Charleen Wiersma, 4252 Crescent, Cypress, stated she would like the hearing continued to the next meeting until the full Commission is present She stated several neighbors were unable to attend tonight's hearing and could be present at the next meeting Commissioner Friedmann asked if anyone objected to continuing the hearing Mr Everet Weerheim, 8541 Acacia Drive Cypress stated he was in favor of continuing the hearing He stated it was his under- standing that the hay business was in violation of the Zoning Ordinance and that it was to have ceased in March It was moved by Commissioner Mullen, seconded by Commissioner Partin and unanimously carried to continue the public hearing regarding Conditional Use Permit #78-11 to June 1 -8- Planning Commission Minutes May 18 1978 CONTINUATION OF PUBLIC HEARING RE. AMENDMENT TO THE ZONING ORD- INANCE NO. 78-3 Commissioner Friedmann opened the public hearing and asked for the staff report The Planning Director stated the Commission completed its review of proposed amendments to the Zoning Ordinance at its May 4 meeting and he transmitted a report dated May 12 containing the retyped sections of the Zoning Ordinance as amended by the Commission He stated the amended Ordinance will be transmitted to the City Council for their review and if approved, the final ordinance will be typed, printed and distributed He stated if the Council recommends any modifications then the Ordinance must be reviewed again by the Commission He reminded the Commission that amendments to the Zoning Ordinance may be initiated at any time The Commission held brief discussion regarding the Zoning Ordinance provisions on the prohibition of vehicle and materials storage in front and side yards massage parlors, and advertising signs placed on top of vehicles No changes were recommended to the amendments as approved previously by the Commission Commissioner Friedmann asked if anyone wished to speak in favor or in opposition to the proposed amendments. No one wished to speak in support or in opposition. It was moved by Commissioner Mullen and seconded by Commissioner Partin to recommend to the City Council approval of Zoning Ordinance Amendment #78-3 The motion unanimously carried by the following roll call vote: AYES 3 COMMISSIONERS.
