C-128 RENEWAL - 1 (HARRIET E. LEANDERS). WHEREAS, the Planning Commission of the City of Cypress held a public hearing on October 4, 1962, regarding Conditional Use Permit Case No C-128 Renewal - 1, and WHEREAS, the Planning Commission has studied the subject property and considered evidence submitted at the nublic hearing. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Cypress does hereby resolve, determine and order as follows. Section 1: The Planning Commission finds that the subject property is located as follows. On Bloomfield, North of Ball Road. The subject property has a legal description on file with the Conditional Use Permit Case No C-128, Renewal - 1 Section 2: The Planning Commission finds that the facts in this matter are as follows: (1) At the time of the public hearing there were no protests to the requested Conditional Use Permit (2) That the site for the nroposed use is adequate in size and shape to accommodate said use and all yards, s -paces, walls and fences, parking, loading, landscaping and other features required by the Zoning Ordinance of the City of Cypress to adjust to said use with land and uses in the neighborhood That the site for nronosed use is bounded by street or streets and highways adequate in width and pavement type to carry the quantity and kind of traffic generated by the nroposed use (3) (4) That the nronosed use will have no adverse effect on abutting nronerty or the permitted use thereof (5) That the conditions stated in the decision are deemed necessary to protect the nublic health, safety and general welfare Section 3: The Planning Commission recommends that the City Councila prove this request for a Conditional Use Permit No C-128, subject to the following, conditions. (1) That the renewal be for a neriod of one year, expiring October 10, 1963. (2) Street dedication be made on Bloomfield as directed by the City Engineer. Section 103 5 of Ordinance No. 90 of the City of Cypress is hereby amended to read as follows. "Section 103 5: CLASSIFICATION OF ANNEXED LANDS AND UNCLASSIFIED PROPERTY• Any property which, for any reason, is not designated on the Zoning Map as being classified in any of the zones established hereby, shall be deemed to be and is hereby classified R-1 Any land hereafter annexed to the City of Cypress shall be zoned and classified in the classification in this Ordinance comparable to the classification in the Orange County Zoning Ordinance at the time of such annexation, unless as a part of the annexing ordinance a specific classification is established If there is no city classification comparable to the county classification, the county classification will prevail and the portions of the Orange County Zoning Ordinance No 351 and as hereafter amended necessary to support such classification is hereby adopted and incorporated by reference Whenever the City of Cypress deems that the zoning of annexed lands as R-1 is not adequate nor desirable, the Planning Commission may recommend and City Council may adopt the zone classification which shall apply to the annexed lands in the manner prescribed for amending this Ordinance " Section 2: The Planning Commission hereby approves this amendment to Ordinance. 90, the Zoning Ordinance of the City of Cypress Section 3 This Resolution was carried by the following roll call vote of t e Planning Commission at its meeting of October 4, 1962.
