Nos. 101-15084 RESOLUTION NO 101 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CYPRESS RECOMMENDING APPROVAL OF ZONE CHANGE Z-77 (JOHN W AND NELL C BURR) WHEREAS, the Planning Commission of the City of Cypress held a public hearing on April 18th, 1963 regarding Zone Change Z-77, and WHEREAS, the Planning Commission has studied the subject property and considered evidence submitted at the public hearing NOW, THEREFORE BE IT RESOLVED, that the Planning Commission of the City of Cypress does hereby resolve, determine and order as follows SECTION I: The Planning C ommission finis that the subject property has a legal description on file with Zone Change Z-77 SECTION II: The Planning Commission finds that the facts in this matter are as follows: 1 At the time of the public hearing there were no written or oral protests 2 The proposed change of zone would not adversely affect the surrounding area. 3 The zoning requested by the applicant is the most suitable zoning for the land in question at this time SECTION III: The Planning Commission finds that the subject property is suitable for the requested change of zone and such change of zone would not adversely affect the zoning of the City SECTION IV: The Planning Commission recommends that the City Council of the City of Cypress approve this request for a change of zone from M-1 (Light Industrial) to R-3 (High Density Multiple Family) SECTION V: This Resolution was passed and adopted by the following roll call vote of the Planning Commission at its meeting of April 18, 1963 AYES- 7 COMMISSIONERS: Ferreira, Garcia, Kanel, Shubin, Wicker, Worley and Baroldi NOES. 0 COMMISSIONERS. M to consider an application for Conditional Use Permit No C-150 to allow the installation of a temporary 101' x 40' subdivision directional sign at the northwest corner of Valley View and Cerritos, submitted by Columbia Outdoor Advertising 7591 Acacia Ave , Garden Grove, California and WHEREAS one person appeared in favor of the request and no protests were heard and, WHEREAS the Planning Commission feels that the request conforms to the conditions of the Zoning Ordinance No 90, NOW THEREFORE BE IT RESOLVED that Conditional Use Permit No C-150 be recommended for approval by the Cypress City Council with the following conditions. vote: 1. Conditional Use Permit No. C-156 APPLICANT. Larwin Company, 8670 Wilshire Blvd., Beverly Hills, California NATURE OF REQUEST To provide for the building of a planned community with residential, commercial, school and park uses. LOCATION: The area generally bounded by Carbon Creek Channel on the south, Orange Avenue on the north, Moody Street on the east, and Bloomfield on the west DISCUSSION• The plan, as submitted by the Larwin Company, contains 1527 units. These units are broken down according to three sections. The first section being that area bounded generally on the south by Ball, on the north by Orange, on the east by Denni and on the west by Moody. In this section there will be 779 units on 91 acres. Section No. 2 is south of Ball Road and west of Denni Street and contains 49.5 acres and 498 units. Section No 3, the area east of Denni to the existing tract development contains 24 71 acres and 250 units It is assumed that each one of these sections will develop as a separate unit since they are bisected by arterial highways. The applicant has submitted the following information: 1. A plot map showing distance between buildings, the proposed open areas, and the location of the proposed parking. 2. An information sheet which indicates the density of the various areas, the percentage of land coverage, the percentage of streets and drives, percentage of recreation areas, and the amount of on-site and off-site parking and the total number of parking units 3 An outline of the proposed CC gR's indicating the restriction and protection of the project. This is not the final form of the CC 6 R's but the applicant indicates that these will be presented to the City for their review before the Certificates of Occupancy are requested. 4. Typical layouts of the elevation and floor plans The elevations indicate that the roofs will be constructed of shingles and the general appearance of the building will be a combination of stucco, wood, and brick exteriors. The minimum floor areas will be as follows: 1 bedroom - 664 sq. ft. 2 bedrooms and den - 970 sq_. ft 3 bedrooms - 1134 sq ft 4 bedrooms - 1366 sq. ft. -1- STAFF REPORT #63-54 (cont.) September 16, 1963 (This compares to the existing plans which they now have, which range from three bedrooms with 1066 sq. ft to a four bedroom with 1235 sq. ft. and a five bedroom with 1672 sq. ft.) The basic density for the entire development now is approximately 9.25 units per acre This is based on the gross acreage to the center of the streets including the school site, commercial areas, and a portion of the park site. The parking ratio is at two to one with approximately one and one-half being provided on-site and one-half being provided on the street. Of the total amount, one and one-quarter will be covered, one-quarter uncovered and one-half on street, which will be uncovered. There is also space provided throughout the various units for parking for boats and trailers. In order to simplify the procedure for making recommendations on this project, the staff has chosen to make recommendations on each of the sections. All recommendations are based upon the plot plan marked "Received by City of Cypress September 12, 1963". Section 3 1. The total number of units in this area should be 250 units This would provide a gross density of 10 12 units per acre 2. Total parking stalls shall be a minimum of 458 spaces on-site. This amount combined with the 142 on street stalls will provide for 600 spaces or 2 4 spaces per unit A minimum of one and one-half covered parking spaces shall be provided on 375 stalls Final placement of all parking spaces shall be approved by the City staff 3. It is recommended that play areas for small children be designed so that the street running through the project will not have to be crossed by children It is recommended that a minimum of two such play areas be erected on the north side of the street and two such areas on the south side of the street The design and location of the play areas shall be approved by the City staff 4 The pool area shall be located as indicated on the map with a minimum pool size of forty feet wide and eighty feet long, or 3200 square feet, depending upon the design of the pool. A ten foot easement shall be provided for the existing sewer line which gees through Section 3, as long as the sewer serves the area. 1 The total number of units in this area should be 498 units. This would provide a gross density of 10.06 units per acre 2 Total parking stalls shall be a minimum of 845 spaces cn-site This amount combined with the 350 on street stalls will provide for 1195 spaces or 2 4 spaces per unit. A minimum of one and one-half covered parking spaces shall be provided on 747 stalls 3. A minimum of two play areas for small children shall be designed for each area so that no street must be crossed to reach such areas. The design and location of such areas shall be approved by the City staff 4 The pool shall be located as indicated on the map with a minimum pool size of forty feet wide and eighty feet long, or 3200 square feet, depending upon the design of the pool. Further, the pool area shall be completely enclosed with a six foot fence approved by the City staff 5. It is recommended that a club house be erected at the site of the pool. 6 The parking areas for trailers and boat parking shall be relocated so that they shall not be visible from the streets. One club house shall be provided for the section and two cabanas Location of the club house shall be centrally located. 6 A six foot block wall shall be erected around the proposed commercial area abutting the residential area. 7. A foot bridge approved by the City Engineer shall be provided across the proposed drainage channel on the south part of the project In addition to the above recommendations for each section, the following general requirements should be imposed on the total project 1 All patio entrances shall be from a walkway, gra✓.n area, garage or parking space 2 That the proposed roads shall have a total width of forty-nine feet which will provide for a four foot sidewalk adjacent to the curbs on both sides of the street. 3. That a six foot fence shall be erected along the property abutting Bloomfield, Ball, Denni or Orange Avenue and adjacent to all commercial areas; also along the north boundary of the Carbon Creek Channel. Construction of this fence will vary depending upon the location. The developer shall attempt to provide decorative fencing as well as live fencing in various areas All fencing plans shall be subject to the approval of the City staff. 4. All houses shall have a minimum distance as specified on the plot plan but in no case shall they be closer than five feet. None ATTEST• SECRETARY Resolution No. 143 128 RESOLUTION NO 144 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CYPRESS RECOMMENDING ADOPTION OF AN ORDINANCE AMENDING ORDINANCE NO. 77, THE SUBDIVISION ORDINANCE OF THE CITY OF CYPRESS WHEREAS the Cypress City Planning Commission held a public hearing on November 21, 1963 at 7 30 P M to consider proposed amendments to Ordinance No. 77, the Subdivision Ordinance of the City of Cypress, and, WHEREAS no one appeared in favor of the proposed amendments and no protests were heard, and, WHEREAS the Planning Commission feels that the amendments are necessary for the general well being of the City in order to upgrade development and to improve procedure, NOW THEREFORE BE IT RESOLVED that the Planning Commission recommend adoption of an Ordinance amending the Subdivision Ordinance No. 77 as follows. Amend Article 2 - Section 2-16: Delete completely. Article 3, Section 3-02, Streets and Highways• Subsection b-3• Amend to read as follows: (3) Secondary Highways: Eighty-four (84) feet of right of way improved with a four (4) lane highway Limited vehicular access from abutting properties. Subsection b-6. Delete Completely. Subsection b-7• Amend to read as follows: "Cul-de-sacs shall not be more than five hundred feet (550') in length and loop streets not more than one thousand feet (1000') in length, except with special Council approval. The minimum width shall be not less than fifty-six feet (56') wide The radius at the terminus of the cul-de-sac shall be not less than fifty feet (50'). Stub streets or rights-of-way may be required to the edge of the subdivision. Pavement width shall be the same as a local street " Article 3, Section 3-03: Amend to read as follows "Section 3-03: GENERAL REQUIREMENTS All sidewalks, concrete curbs, and gutters, parkway trees, ornamental street lights, pavements, sanitary sewer lines, water mains, fire hydrants, culverts, drainage structures and any other required improvements shall be installed at the cost of the subdivider, and shall conform to grades and Tecifications established by the City Engineer of the City of Cypress Private streets may be approved by the Planning Commission at widths less than specified above for local or cul-de-sac streets, when subdivision is approved under Optional Design and Improvement Standards, provided that where any paved area of 24' or less is provided, parking bays shall be provided with not less than the capacity of curb parking space; all private streets shall meet the improvement standardsadopted by the City of Cypress, except for said pavement and right-of-way width " Resolution No. 144 Article 4, Section 5-17: Amend to read as follows• "Section 5-17: IMPROVEMENT PLANS AND PROFILES. The plans and profiles of all improvements required by the provisions of this Section, as well as of other improvements proposed to be installed by the subdivider in, over or under any street, alley, way, easement or parcel of land where improvements are required orproposed shall be drawn on 24" x 36" tracing cloth in india ink and be filed with the City Engineer for his checking and approval. An estimate of the quantities for bid items shall be tabulated on Sheet 1 of the improvement plans. If all details, plans and profiles of improvements are not checked and approved by the City Engineer at the time of filing of the final map, the faithful performance bond as required in Section 5-18 hereof shall include a guarantee that the remaining plans and profile will be prepared in accordance with the requirements of the City Engineer. In all cases where topography controls the design, all details, plans and profiles of improvements required by the City Engineer must be substantially approved at the time of filing of final map." Article 5, Section 5-18. Subsection d-2 & 3• Delete completely Subsection e. Amend as follows: "(e) The linen drawings of the proposed improvements shall under all conditions he furnished to the City Engineer and be approved by the City Engineer prior to the commencing of any construction or improvements Such plans and profiles shall show full details of the nronosed improvements which shall be according to the standards of the City of Cypress." Subsection F• Delete Completely Subsection C Delete the words "and lien holders paid". Article 5, Section 5-20. Subsection e Amend to read as follows: "(e) It shall be the responsibility of the Developer to furnish to theCounty Recorder's Office, at the time of recordation, a single reproduction of each Title and `•lap sheet on polyester base film made directly from the ink originals. Said duplicate will be stamped by the County Recorder and transmitted to the City of Cypress. It shall also be the responsibility of the Developer to furnish two paper prints to the City Engineer." Article 6, Section 6-01. Amend to read as follows. "Section 6-01• IMPROVEMENTS REQUIRED The same improvements and drainage fees required by this Ordinance shall be required in the case of a "Record of Survey" except in those instances where certain improvements are found to be unnecessary by the City Council for the public welfare, safety, and health " Article 6, Section 6-02 Change word "subdivider' to "developer" Resolution No 144 Article 6, Section 6-03: Subsection a-5. Amend to read as follows. "(5) That no lot contained in such proposed lot split subdivision shall conflict with any street, highway, park, playground, public building or other type cF public protect indicated on a Master Plan or Precise Plan " Subsection a-6• Amend to read as follows: "(6) That no lot in such proposed lot split subdivision may be subject to flood or inundation " Subsection b. Rooming and boarding houses and foster homes for any number of guests, subject to obtaining a Conditional Use Permit Amend PART 10 by adding PART 10.A PART 10.A COMMERCIAL OFFICE ZONE OR "C-0" ZONE Section 110 A 1 Purpose To provide a district for office type uses, with yard and open space and architectural requirements similar to those in residential districts, in order that such uses can be located in close proximity thereto. Section 110 A 2 Permitted Buildings and Uses Only the following buildings, structures and uses, either singly or in conbination are permitted in a commercial office zone a Medical, Dental offices and clinics b. Business, executive and financial offices c. Professional offices d Private parking lots and garages e Any other office uses which the Planning Commission finds not to be inconsistent with the uses listed, as set out above f. Medical and Dental laboratories, but not including manufacturing of products for general sale or distribution. g. Schools and studios for arts, crafts, photography, music and dance, subject to obtaining a Conditional Use Permit h Mortuaries, nursing homes, rest homes, nursery schools, day care centers, clubs, lodges, fraternities, subject to obtaining a Conditional Use Permit. i Educational, religious, recreational, cultural or public service uses, but not including any storage, repair yards, equipment yards or warehouses, subject to obtaining a Conditional Use Permit. Resolution No. 145 132 Section 110 A 3 Accessory Buildings and Uses Accessory buildings and uses shall be permitted only to the extend necessary and normal to the type of uses permitted in this zone. Accessory buildings and structures are permitted in the rear and side yards, providing no building or structure is permitted in the side yard within sixty (60) feet of the front lot line, nor permitted in any yard abutting the street. All accessory buildings which are not a part of the main building shall be separated from the main building by at least five (5) feet. Signs may be allowed as set out in the Sign Ordinance of the City of Cypress. Section 110.A.4 Lot Area and Dimensions Lots of record on the effective date of this Ordinance, whose area or dimensions are less than those required in this zone, may be occupied by uses permitted sublect to all other restrictions and requirements which the size of the lot makes it possible to comply with A Lot Area; The minimum lot area shall be Five thousand (5000) square feet B. Lot Dimensions: The minimum lot dimensions shall be fifty (50) feet for interior lots, and sixty (60) feet for corner lots Minimum depth one hundred (100) feet. Section 110.A.5 Building or Structural Height Limitations The maximum building or structural height of the main building shall be two and one-half (2-1/2) stories or 35 feet, whichever is the lesser, and one (1) story or 20 feet, whichever is the lesser, for accessory buildings When a 'C-0" Zone abuts upon any residential zone, a structural height of any building erected on it, or on such abutting or adjacent lot, it shall be limited to one (1) story or 20 feet, whichever is the lesser, for a distance of fifty (50) feet from the "C -O' Zone abutting any of the aforementioned other eresidential zones Section 110 Z 6 Yard Regulations Unless Resolution No 145 Unless otherwise required in PART 19 of this Ordinance, or unless Optional Design Standards have been used as set out in Section 110 A of this Ordinance: A. Front Yard Each lot in a "C-0' Zone shall have a front yard extending across the full width of the sublect property of a depth of not less than that required in the abutting zone, but need not exceed twenty (20) feet, and in the case of a corner lot, also a side yard along the abutting street side, meeting the same requirements, which need not exceed ten (10) feet A minimum of ten (10) feet closest to the street line shall be landscaped and permanently maintained as a condition to the use of the property There shall be no parking in the ten feet closest to the street line, except access drives or walks or required yard abutting a street. B Side Yard No side yard is required between office structures When abutting a residential zone there shall be a side yard of not less than ten (10) feet in width on that side of the property abutting the residential zone C. Rear Yard No rear yard is required when property in a "C-0" Zone abuts property in a commercial or industrial zone. When abutting a residential zone there shall be a rear yard of not less than twenty-five (25) feet extending across the full width of the subject property, unless the rear of the subject property abuts a fully developed alley Such rear yard may be used for off-street parking or landscaping. D Landscaping Minimum required• Ten (10%) per cent of the yard area shall be set aside and maintained in landscaping Section 110.A.7 Lot Coverage The maximum coverage of the lot by all structures shall not exceed ninety (90%) per cent less required parking, required landscaping areas and required setbacks Section 110 A 8 Optional Design and Improvement Standards When a development has been approved by the Planning Commission, under the Optional Design and Improvement Standards of the Subdivision Ordinance, then such approved building sites, coverage and yards under such plan shall be considered as the requirements of this ordinance Section 110.A.9 Off -Street Parking The provisions of PART 21 shall apply in determining the amount of parking space that must be provided for each use. The parking space shall be improved as set out in said Part Amend PART 17, Section 117.1, as follows. The new title of PART 17 shall be• PLANNED DEVELOPMENT DISTRICT (PD Zone) Section 117 0 Description and Purpose To provide for an integrated community development, a complete neighborhood which will provide the necessary amenities and conveniences to protect and encourage a suitable enviroment for families, whether single family or multiple, and to provide commercial service centers, office and research area that can appropriately be made a part of a community development Resolution No 145 134 Section 117.1 Buildings and Uses Permitted Subject to obtaining a Use Permit which shall be considered and acted upon in all instances by the City Council as well as the Planning Commission, land, buildings and structures may be used in the PD District for the following purposes; A Any use permitted in any R, C-1 or C-2 District. B Administrative and professional offices C. Public and private recreation facilities. D Research and development establishments Any application for use in this district shall be accompanied by complete development plans, including planting plans and architectural sketches showing site use or planned development, the character and use of adjoining land, the design and character, general size, location and use of all buildings and structures to be placed on the site, the location and dimensions of streets, parking areas, open areas and other uses Amend PART 19, Building Lines and Setback Lines Along Major, Primary and Secondary Highways, as follows Section 119.0 General Plan of Streets and Highways The major, primary and secondary highways existing within the City are shown and desig- nated upon a map hereto attached and made a part of this Ordinance being designated as the Master Plan of Arterial Highways of the City of Cypress, otherwise referred to in this Ordinance as the City Highway Map, and said map and all the notations, references, and any other information shown thereon are by reference hereby made a part of this Ordinance The original of the City Highway Map, including any changes or amendments thereto shall be kept on file with the City Clerk Section 119 1. Building, Setback Line• A Planned highway right of way line A planned highway right of way line is hereby established in the following instances 1. Along all major highways, except Lincoln Avenue, as shown on the Master Plan of Arterial Highways of the City of Cypress, sixty (60) feet distance from and parallel with the center line of such highway, Lincoln Avenue, fifty-three (53) feet distance from and parallel with the center line of Lincoln Avenue 2 Along all primary streets as shown on the Master Plan of Arterial Highways of the City of Cypress, fifty (50) feet distance from and parallel with the center line of such street, 3 Along all secondary streets as shown on the Master Plan of Arterial Highways of the City of Cypress, forty-four (44) feet distant from and parallel with the center line of such street B The center line shall be 1 The officially surveyed line, or 2 A center line as adopted by a precise plan Resolution No 145 J C How measured 1. That authorization for such use has first been granted by the City Council B That such sales shall be conducted only from December 1 to December 25 inclusive. C That the operation be conducted in such a manner as to not adversely affect surrounding properties D That the premises used for such sales shall be cleaned up and restored to a neat and orderly condition by December 31 of that year E A $50 00 clean-up bond shall be posted F That such lots shall be inspected by the building and fire departments to assure compliance with all building and fire codes G. None ATTEST SECRETARY Resolution No. 149 142 RESOLUTION NO 150 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CYPRESS RECOMMENDING APPROVAL OF ZONE CHANGE NO Z-101 (KING MAZUR) WHEREAS the Cypress City Planning Commission held a public hearing on January 2 1964 at 7.30 P.M to consider an application for amendment to the Zoning Ordinance to change the zone from R-1 (One -family Residential) to C-2 (General Commercial) on that property generally located on the northeast corner of Juanita Ave. and Ball Road, requested by King Mazur, 9776 Garden Grove Blvd , Garden Grove, California, known as Zone Change No Z-101, and, WHEREAS one person appeared in favor of the request and no protests were heard, and, WHEREAS the Planning Commissinn determined the zone change would be in the best interest of the City for the following reasons: 1 The property fronts on a major street 2 The zoning of this property would not detrimentally affect the adjacent area 3 The property is surrounded on two sides by existing commercial zones (C-2) 4 Strip commercial is indicated on the Master Land Use Plan for this general area.
